Arkansas Tech University must vacate all wins in which ineligible student-athletes competed in men’s and women’s basketball from 2009 through 2013, according to a decision issued by the NCAA Division II Infractions Appeals Committee, upholding the NCAA Division II Committee on Infractions penalty.
The Committee on Infractions previously found that the university failed to monitor its housing operations when it waived or paid $14,250 in housing security deposits for 57 prospects and student-athletes from 2009 to 2013.
In its appeal, the university argued the vacation of wins is not supported by the underlying violations in the case and represented an unwarranted departure from Division II infractions case precedent.
After reviewing the case record, the Infractions Appeals Committee found the vacation of records to be appropriate and consistent with case precedent when weighed against the totality of the violations in the case. The committee noted the violations led to significant competitive advantages for the men’s and women’s basketball teams.
The members of the Infractions Appeals Committee who heard this case were Richard D. Loosbrock, faculty athletics representative at Adams State University; Ann Jirkovsky, faculty athletics representative and assistant professor of psychology at Bellarmine University; LaKeisha C. Marsh, chair and attorney in private practice; Gregory Moore, commissioner at the Southern Intercollegiate Athletics Conference; and Morgan Walker, senior associate athletics director at California State University, San Bernardino.
