Division II Noncontroversial legislative proposals -- Entire version

The NCAA Division II Management Council and Presidents Council have determined, pursuant to NCAA Constitution 5.3.1.1.1, that the following proposals are noncontroversial and necessary to promote the normal and orderly administration of the Association's legislation. The Division II Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend the adoption of noncontroversial amendments, subject to ratification by the Division II Presidents Council.

Proposals that are ratified by the Presidents Council shall be effective as of the date identified in the proposal. Once ratified, the proposals will be published in The NCAA News and submitted by the Presidents Council as legislation at the 2005 NCAA Convention.

The page numbers in the proposals refer to the 2004-05 NCAA Division II Manual.

NCAA Membership -- Provisional and Reclassifying Members -- Application and Annual Report Due Date

Intent: To modify the deadline date for provisional and reclassifying members' applications and annual reports from June 15 to June 1.

A. Constitution: Amend 3.3.7.6.1, page 16, as follows:

"3.3.7.6.1 Application. A conference desiring to become a provisional member conference shall apply on or before June 15 1 on a form available from the national office. A nonrefundable application fee shall accompany the application. The amount of the fee will be determined annually by the Management Council based on an analysis of expenses associated with the provisional member educational assessment program. In addition, a check for annual dues also shall accompany the application."

B. Constitution: Amend 3.3.7.7.2, page 17, as follows:

D. Constitution: Amend 3.6.1.1.1.1, page 20, as follows:

"3.6.1.1.1.1 Exploratory Period. An institution may apply for provisional membership after completing a one-year exploratory period. The chief executive officer of the institution shall submit written notice of the institution's desire to begin the exploratory period. The notice shall be received in the national office (by mail) not later than June 15 1 one year before the June 15 1 application deadline when the institution desires to apply for provisional membership. A nonrefundable exploratory fee in the amount of $1,000 shall accompany the written notice."

E. Constitution: Amend 3.6.3.2, page 22, as follows:

[Division II]

"3.6.3.2 Application. An institution desiring to become a provisional member of Division II must complete a one-year exploratory period prior to submitting an application for provisional membership. The institution must notify the national office, in accordance with 3.6.1.1.1.1, in order to begin the exploratory period. Following the completion of the exploratory period, the institution may apply for provisional membership if all application requirements set forth in 3.6 are satisfied. The application shall be received in the national office (by mail) not later than June 15 1 after completion of the exploratory period. A nonrefundable application fee shall accompany the application form. The amount of the fee will be determined annually by the Management Council based on a continual analysis of expenses associated with the provisional member educational assessment program. In addition, a check in the appropriate amount for annual dues (see the current annual dues for active members per Constitution 3.7.3) also shall accompany the application. Should the applicant fail to qualify academically or fail election, the dues paid shall be refunded."

F. Constitution: Amend 3.6.4.2, page 22, as follows:

"3.6.4.2 Self-Study and Annual Review. During the first year of provisional membership, a provisional member shall complete a comprehensive institutional self-study and evaluation of the member's intercollegiate athletics program (Constitution 6.3.1.1 requires an institution recently granted active membership status to conduct a comprehensive self-study and evaluation of its intercollegiate athletics program no later than the end of the first year of active membership). A provisional member also shall provide, on an annual basis, a written report to be reviewed by the Membership Committee describing the institution's progress in meeting active membership requirements. The annual report shall be postmarked not later than June 15 1 each year. The annual report shall be completed in accordance with the requirements set forth in the Division II Educational Assessment Program."

G. Bylaws: Amend 20.4.2.2, page 267, as follows:

"20.4.2.2 Notification Requirement. When petitioning of reclassification on a single sport from Division I to Division II the institution shall submit its request to the Division II Membership Committee on a form approved by the committee. The form must be received in the national office (by mail or wired transmission) no later than June 15 1, preceding the year in which the institution will begin complying with the applicable division criteria."

H. Bylaws: Amend 20.5.1.1, page 267, as follows:

"20.5.1.1 Exploratory Year. An institution petitioning for change of division membership and desiring to become a member of Division II must complete a one-year exploratory period. Membership -- Exploratory Period -- Waiver

Intent: To permit the Membership Committee to waive the exploratory year for provisional member institutions or institutions seeking change of division membership to Division II.

A. Constitution: Amend 3.6.1.1.1.1 by adding new 3.6.1.1.1.1.1, page 20, as follows:

"3.6.1.1.1.1 Exploratory Period. An institution may apply for the provisional membership after completing a one-year exploratory period. Institutional Control --

Self-Study and Evaluation -- Extension

Intent: To permit the Membership Committee to grant an extension of the deadline for completing the Division II Institutional Self-Study Guide (ISSG) when extraordinary circumstances warrant.

Constitution: Amend 6.3.1 by adding new 6.3.1.2, page 52, as follows:

"6.3.1 Self-Study Report. Institutions shall conduct a comprehensive self-study and evaluation of their intercollegiate athletics programs at least once every five years, using the Institutional Self-Study Guide (ISSG). The report of the self-study and supporting documentation shall be available for examination on request by an authorized representative of the Association. Reasonable Refreshments -- Family Members

Intent: To permit an institution to provide family members and/or legal guardians of student-athletes reasonable refreshments on an occasional basis.

"16.6.1.6 Reasonable Refreshments. An institution may provide reasonable refreshments (e.g., soft drinks, snacks) on an occasional basis to the immediate family member(s) and/or legal guardians of a student-athlete."

Countable Athletically Related Activities

Intent: To clarify the definition of countable athletically related activities; further, to specify that administrative activities are not considered countable athletically related activities.

Playing and Practice Seasons -- Non-NCAA Postseason Championships Participation -- Gymnastics

Intent: In gymnastics, to exempt the USA Gymnastics Collegiate National Championships from the gymnastics playing and practice season regulations.

Playing and Practice Seasons -- General Playing-Season Regulations -- Annual Exemptions -- Hawaii, Alaska or Puerto Rico

Intent: To specify that any contest played in Hawaii, Alaska or Puerto Rico, either against or under the sponsorship of an active member institution located in Hawaii, Alaska or Puerto Rico, by a member located outside the area in question may be exempted annually from an institution's maximum number of contests or dates of competition.

End of Playing Season -- Basketball

Intent: In basketball, to specify that a member institution's last contest with outside competition shall not be played after the NCAA Division II Men's Basketball Championship game.

Dates of Competition -- Skiing

Intent: In skiing, to limit the total playing schedule with outside competition to 16 dates of competition for alpine events and 16 dates of competition for Nordic events, while maintaining individual limits on dates of competition.

Eligibility for Championships -- Ineligibility for Use of Banned Drugs -- Breach of Protocol

Intent: To specify that a student-athlete who is in breach of drug-testing protocol (e.g., no-show, tampering with a sample) shall be considered to have tested positive for the use of any drug other than a "street" drug.

A. Bylaws: Amend 18.4.1.5.1, pages 250-251, as follows:

[Division II]

"18.4.1.5.1 Duration of Ineligibility. A student-athlete who tests positive (in accordance with the testing methods authorized by the Executive Committee) shall be charged with the loss of a minimum of one season of competition in all sports, if the season of competition has not yet begun for that student-athlete or a minimum of the equivalent of one full season of competition in all sports, if the student-athlete tests positive during his or her season of competition (i.e., the remainder of contests in the current season and contests in the subsequent season up to the period of time in which the student-athlete was declared ineligible during the previous year). The student-athlete shall remain ineligible for all regular-season and postseason competition during the time period ending one calendar year (i.e., 365 days) after the student-athlete's positive drug test and until the student-athlete retests negative (in accordance with the testing methods authorized by the Executive Committee) and the student-athlete's eligibility is restored by the Student-Athlete Reinstatement Committee.

"18.4.1.5.1.1 Breach of NCAA Drug-Testing Program Protocol. A student-athlete who is in breach of the NCAA drug-testing program protocol (e.g., no show, tampering with sample) shall be considered to have tested positive for the use of any drug other than a "street" drug.

"18.4.1.5.1.2 Transfers. If the student-athlete transfers to another NCAA institution while ineligible, the institution from which the student-athlete transferred must notify the institution that the student-athlete is ineligible. If the student-athlete immediately transfers to a non-NCAA institution while ineligible and competes in collegiate competition within the 365-day period at a non-NCAA institution, the student-athlete will be ineligible for all NCAA regular season and postseason competition until the student-athlete does not compete in collegiate competition for a 365-day period. Furthermore, the student-athlete must retest negative (in accordance with the testing methods authorized by the Executive Committee) and the student-athlete's eligibility must be restored by the Student-Athlete Reinstatement Committee. If the student-athlete transfers to another NCAA institution while ineligible, the institution from which the student-athlete transferred must notify the institution that the student-athlete is ineligible.

"18.4.1.5.1.3 Testing Positive on Second Occasion. If the student-athlete, who tested positive for any drug other than a "street drug" as defined in Bylaw 31.2.3.1, tests positive a second time for the use of any drug, other than a "street drug" as defined in Bylaw 31.2.3.1, he or she shall lose all remaining regular-season and postseason eligibility in all sports. If the student-athlete tests positive for the use of a "street drug" after being restored to eligibility, he or she shall be charged with the loss of a minimum of one additional season of competition in all sports and also shall remain ineligible for regular-season and postseason competition at least through the next calendar year.

"18.4.1.5.1.4 Previous Positive Test Administered by Other Athletics Organization. In addition, a A student-athlete who has previously tested positive for performance-enhancing drugs as a result of a drug test administered by any other athletics organization and subsequently tests positive (in accordance with the testing methods authorized by the Executive Committee) shall be subject to these ineligibility provisions."

B. Administrative: Amend 31.2.3, pages 314-317, as follows:

[Division II]

"31.2.3 Ineligibility for Use of Banned Drugs. Bylaw 18.4.1.5 provides that a student-athlete who, as a result of a drug test administered by the NCAA, is found to have used a substance on the list of banned drugs shall be declared ineligible for further participation in postseason and regular-season competition during the time period ending one calendar year after the student-athlete's positive drug test. The student-athlete shall be charged with the loss of a minimum of one season of competition in all sports if the season of competition has not yet begun or a minimum of the equivalent of one full season of competition in all sports if the student-athlete tests positive during his or her season of competition (i.e., the remainder of contests in the current season and contests in the next season up to the period of time in which the student-athlete was declared ineligible during the previous year). Bylaw 18.4.1.5.2 also provides that the Executive Committee shall adopt a list of banned drugs and authorize methods for drug testing of student-athletes on a year-round basis.

"31.2.3.3 Previous Positive Test Administered by Other Athletics Organization. In addition, as stated in 18.4.1.5.1, a A student-athlete who previously tested positive for performance-enhancing drugs as a result of tests administered by any other athletics organization and subsequently tests positive (in accordance with the testing methods authorized by the Executive Committee) shall be subject to these ineligibility provisionsthe provisions of Bylaws 18.4.5.1.

"31.2.3.4 Banned-Drug List. The banned-drug list is subject to change. The institution and student-athletes shall be held accountable for all banned-drug classes set forth in 31.2.3.1 as well as the list located on the NCAA Web site (i.e., www.ncaa.org). In addition, a complete current listing of banned drugs may be obtained from the NCAA national office."

"21.1.1 Composition. The panel shall consist of 12 members, including six members from Division I and three representatives each from Divisions II and III. A single conference may not have more than one representative on the panel.

"21.1.2 Method of Selection. Three of the six Division I representatives shall be appointed by the Division I Championships/Competition Cabinet (these members must be current members of the Championships/Competition Cabinet) and one of those three must have experience working with playing rules. The remaining three shall be appointed by the Division I Collegiate Commissioners Association (CCA). Two of those three shall have experience working with playing rules. One of the three Divisions II and III representatives shall be appointed by the divisions' Championships Committees (these appointees must be current members of the divisions' Championship Committees). The remaining two representatives in Divisions II and III will be appointed at large and one of the two per each division shall have experience working with playing rules.

"21.1.2.1 Definition of "Working with Playing Rules." The following experience will be considered to be the equivalent of "working with playing rules:" officiating experience, previous service on a rules committee, previous service on a committee with responsibility for playing rules administration or coaching.

"21.1.3 Term of Office. At-large members of the panel will serve four-year terms.

Championships/Competition Cabinet and Championships Committee appointments will serve for the duration of their cabinet's or committee's term.

"21.1.4 Duties. The panel shall:

"(a) Oversee all NCAA playing rules committees. This includes approval of playing rules recommendations and oversight of other issues pertaining to playing rules;

"(b) Recommend the establishment and dissolution of playing rules committees;

"(c) Monitor playing rules maintained outside of the NCAA;

"(d) Be responsible for all research and communication pertaining to the administration of playing rules, including the advancement of budgetary recommendations from the playing rules committee and to ensure consistency among different sports, when appropriate (for example, policies controlling fighting or abusive language);

"(e) Review and act on requests from any division to exempt it from applying or delaying implementation of a playing rule for financial reasons; and

"(f) Review all playing rules changes pertaining to finances, safety and image of the game.

 

"21.1.5 Meetings. The Playing Rules Oversight Panel shall meet three times annually (e.g., March, June, August) after the playing rules committees meetings for each season are complete.

"21.1.6 Special Operating Rules

"21.1.6.1 Review Process. A recommendation from any rules committee shall be considered valid unless the Playing Rules Oversight Panel determines that the recommendation harms the image of the games, creates an unsafe environment for student-athletes or places an unreasonable financial burden on the membership.

"21.1.6.1.1 Rules Committee Involvement. The Playing Rules Oversight Panel may request that playing rules committee chairs and/or secretary-rules editors present their case to the Playing Rules Oversight Panel when proposed changes are controversial or unusually complicated."

An institutional staff member who performs both coaching and administrative functions may be counted as either an athletics administrator or a coach.
