Division II noncontroversial legislation

The NCAA Division II Management Council and Presidents Council have determined, pursuant to NCAA Constitution 5.3.1.1.1, that the following proposals are noncontroversial and necessary to promote the normal and orderly administration of the Association's legislation. The Division II Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend the adoption of noncontroversial amendments, subject to ratification by the Division II Presidents Council.

Proposals that are ratified by the Presidents Council shall be effective as of the date identified in the proposal. Once ratified, the proposals will be published in The NCAA News and submitted by the Presidents Council as legislation at the 2005 NCAA Convention.

NCAA Membership -- Provisional and Reclassifying Members -- Application and Annual Report Due Date

Intent: To modify the deadline date for provisional and reclassifying members' applications and annual reports from June 15 to June 1.

Membership -- Exploratory Period -- Waiver

Intent: To permit the Membership Committee to waive the exploratory year for provisional member institutions or institutions seeking change of division membership to Division II.

Institutional Control --

Self-Study and Evaluation -- Extension

Intent: To permit the Membership Committee to grant an extension of the deadline for completing the Division II Institutional Self-Study Guide (ISSG) when extraordinary circumstances warrant.

Awards and Benefits --

Reasonable Refreshments -- Family Members

Intent: To permit an institution to provide family members and/or legal guardians of student-athletes reasonable refreshments on an occasional basis.

Playing and Practice Seasons --

Countable Athletically Related Activities

Intent: To clarify the definition of countable athletically related activities; further, to specify that administrative activities are not considered countable athletically related activities.

Playing and Practice Seasons -- Non-NCAA Postseason Championships Participation -- Gymnastics

Intent: In gymnastics, to exempt the USA Gymnastics Collegiate National Championships from the gymnastics playing and practice season regulations.

Playing and Practice Seasons -- General Playing-Season Regulations -- Annual Exemptions -- Hawaii, Alaska or Puerto Rico

Intent: To specify that any contest played in Hawaii, Alaska or Puerto Rico, either against or under the sponsorship of an active member institution located in Hawaii, Alaska or Puerto Rico, by a member located outside the area in question may be exempted annually from an institution's maximum number of contests or dates of competition.

Playing and Practice Seasons --

End of Playing Season -- Basketball

Intent: In basketball, to specify that a member institution's last contest with outside competition shall not be played after the NCAA Division II Men's Basketball Championship game.

Playing and Practice Seasons --

Dates of Competition -- Skiing

Intent: In skiing, to limit the total playing schedule with outside competition to 16 dates of competition for alpine events and 16 dates of competition for Nordic events, while maintaining individual limits on dates of competition.

Eligibility for Championships -- Ineligibility for Use of Banned Drugs -- Breach of Protocol

Intent: To specify that a student-athlete who is in breach of drug-testing protocol (e.g., no-show, tampering with a sample) shall be considered to have tested positive for the use of any drug other than a "street" drug.

Committees -- Playing Rules Oversight Panel

Intent: To modify the playing rules process, as specified.

Committees -- Core-Course Review Committee

Intent: To eliminate the NCAA Core-Course Review Committee.

Committees -- Men's Lacrosse Committee

Intent: To increase the Division II Men's Lacrosse Committee from three to four members and to specify that each of the Division II lacrosse regions be represented on the committee.

Committees -- Sports Committees with Only Division II Championships Administration Responsibilities -- Composition Requirements --

Faculty Athletics Representative

Intent: To specify that the faculty athletics representative shall be considered an athletics administrator for purposes of the composition requirements for sports committees with only Division II championships administration responsibilities.
