Division II incorporations/interpretations

The NCAA News

Following are legislative drafts of interpretations issued by the Interpretations Subcommittee of the Legislation Committee and approved by the Management Council. These were recommended by the Legislation Committee for incorporation into the Division II Manual. The recommendations have been approved by the Management Council and President Council. The items that have not yet been reviewed in legislative form are marked with an asterisk.

The page numbers in the proposals refer to the 2003-04 NCAA Division II Manual.

Bold type indicates new wording; italicized type indicates wording removed.

Eligibility -- Fulfilment of Minimum Grade-Point Average Requirements -- Applicable Credit Hours

Bylaws: Amend 14.4.3.2 by adding new 14.4.3.2.2 , page 124 , as follows:

"14.4.3.2 Fulfillment of Minimum Grade-Point Average Requirements. A student-athlete shall meet the "satisfactory completion" provision of this requirement by maintaining a grade-point average that places the individual in good academic standing, as established by the institution for all students who are at an equivalent stage of progress toward a degree. To fulfill the "satisfactory completion" provision of this requirement, a student-athlete who first enters a Division II institution after the 1988-89 academic year must achieve the following cumulative minimum grade-point average (based on a maximum of 4.000) at the beginning of the fall term or at the beginning of any other regular term of that academic year, based on:

[14.4.3.2-(a) through 14.4.3.2-(d) unchanged.]

[14.4.3.2.1 unchanged.]

"14.4.3.2.2 Applicable Credit Hours. All credit hours (e.g., part time, transfer, advanced placement) that are accepted and appear on the student-athlete's transcript at the certifying institution shall be used in determining the number of semester or quarter hours completed and applicable toward the determination of minimum grade-point average requirements."

Effective date: August 1, 2004.

Eligibility -- Transfer Regulations -- Countable Athletically Related Activity

A. Bylaws: Amend 14.5.2, pages 127-128 , as follows:

"14.5.2 Conditions Affecting Transfer Status. A transfer student is an individual who transfers from a collegiate institution after having met any one of the following conditions at that institution:

[14.5.2-(a) through 14.5.2-(e) unchanged.]

"(f) The student reported for a regular squad practice [[including practice or conditioning countable athletically related activities (see Bylaw 17.02.1.1) that occur prior to certification per Bylaws 14.3.5.1 and 14.5.4.3.6)], announced by the institution through any member of its athletics department staff, before the beginning of any quarter or semester, as certified by the athletics director. Participation only in picture-day activities would not constitute "regular practice;"

"(g) The student participated in practice or competed countable athletically related activities (see Bylaw 17.02.1.1) in a given sport even though the student was enrolled in less than a minimum full-time program of studies; or"

[14.5.2-(h) unchanged.]

B. Bylaws: Amend 14.5.4.4.2 , page 130 , as follows:

"14.5.4.4.2 Nonrecruited Student Exception. The student transfers to the certifying institution and the following conditions are met:

[14.5.4.4.2-(a) and 14.5.4.4.2-(b) unchanged.]

"(c) The student-athlete has neither practiced nor competed not participated in countable athletically related activities (see Bylaw 17.02.1.1) in intercollegiate athletics before transfer, except that a student-athlete may have participated in limited preseason tryouts; and"

[14.5.4.4.2-(d) unchanged.]

C. Bylaws: Amend 14.5.4.4.3 , page 130 , as follows:

"14.5.4.4.3 Two-year Nonparticipation Exception. The student transfers to the certifying institution from a two-year college and, for a consecutive two-year period immediately before the date on which the student begins participation (practice and/or competition countable athletically related activities), the student has neither practiced nor competed in the involved sport in intercollegiate competition, or has neither practiced nor competed not participated in countable athletically related activities (see Bylaw 17.02.1.1) in organized noncollegiate amateur competition while enrolled as a full-time student in a collegiate institution. This two-year period does not include any period of time before the student's initial collegiate enrollment."

D. Bylaws: Amend 14.5.5.3.6, pages 131-132 , as follows:

"14.5.5.3.6 Discontinued/Nonsponsored Sport Exception. In a particular sport when the student transfers at any time to the certifying institution and participates in the sport on the intercollegiate level after any of the following conditions has occurred:

"(a) The student's original four-year collegiate institution dropped the sport ([in which the student has practiced or competed participated in countable athletically related activities (see Bylaw 17.02.1.1) at that institution in intercollegiate competition)] from its intercollegiate program; or"

[14.5.5.3.6-(b) unchanged.]

E. Bylaws: Amend 14.5.5.3.7 , page 132 , as follows:

"14.5.5.3.7 Two-Year Nonparticipation Exception. The student transfers to the certifying institution from another four-year college and, for a consecutive two-year period immediately before the date on which the student begins participation (practice and/or competition countable athletically related activities), the student has neither practiced nor competed not participated in countable athletically related activities (see Bylaw 17.01.2.2) in the involved sport in intercollegiate competition, or has neither practiced nor competed countable athletically related activities (see Bylaw 17.01.2.2) in organized noncollegiate amateur competition while enrolled as a full-time student in a collegiate institution. This two-year period does not include any period of time before the student's initial collegiate enrollment."

F. Bylaws: Amend 14.5.5.3.8 , page 132 , as follows:

"14.5.5.3.8 Return to Original Institution without Participation Exception. The student enrolls at a second four-year collegiate institution, does not practice or compete participate in countable athletically related activities (see Bylaw 17.02.1.1) in the involved sport at the second institution and returns to the original institution."

G. Bylaws: Amend 14.5.5.3.9 , page 132 , as follows:

"14.5.5.3.9 Nonrecruited Student Exception. The student transfers to the certifying institution, and the following conditions are met:

[14.5.5.3.8-(a) and 14.5.5.3.8-(b) unchanged.]

"(c) The student-athlete has neither practiced nor competed not participated in countable athletically related activities (see Bylaw 17.02.1.1) in intercollegiate athletics before transfer, except that a student may have participated in limited preseason tryouts."

Effective date: Immediately.

Financial Aid -- Reduction and Cancellation Not Permitted -- Decrease Not Permitted -- Prospective Student-Athlete

Bylaws: Amend 15.3.4.3.2 , page 154 , as follows:

[Division II]

"15.3.4.3.2 Decrease Not Permitted. An institution may not decrease a prospective student-athlete's or a student-athlete's financial aid from the time the prospective student-athlete or student-athlete signs the financial aid award letter until the conclusion of the period set forth in the financial aid agreement, except under the conditions set forth in Bylaw 15.3.4.1."

Effective date: Immediately.

Playing and Practice Seasons -- Discretionary Exemptions -- Official Scoring

Bylaws: Amend 17.1.9.2 by adding new 17.1.9.2.1 , page 183 , as follows:

[Division II]

"17.1.9.2 Discretionary Exemptions -- Sports Other Than Football. In sports other than football, the following may be exempted from an institution's maximum number of contests or dates of competition each year. An institution may exempt no more than three of the following from this list annually:

[17.1.9.2-(a) through 17.1.9.2-(d) unchanged.]

"17.1.9.2.1 Official Scoring. For purposes of Bylaw 17.1.9.2-(d), official scoring has occurred under any of the following conditions:

"(a) The signing of a scorebook by an official;

"(b) The score is released to the media or other appropriate entities; or

"(c) The score is used for individual or seasonal statistics."

Effective date: Immediately.

Playing and Practice Seasons -- Football -- Preseason Practice -- Weightlifting

A. Bylaws: Amend 17.11.2.3 by adding new 17.11.2.3.1 , page 203 , as follows:

[Division II, football only]

"17.11.2.3 Five Day Acclimatization Period. Preseason practice shall begin with a five-day acclimatization period for both first-time participants (e.g., freshmen and transfers) and continuing student-athletes. All student-athletes, including walk-ons who arrive to preseason practice after the first day of practice, are required to undergo a five-day acclimatization period. The five-day acclimatization period shall be conducted as follows:

[17.11.2.3-(a) through 17.11.2.3-(c) unchanged.]

"17.11.2.3.1 Weightlifting. Weightlifting is not considered an on-field activity under Bylaw 17.11.2.3."

B. Bylaws: Amend 17.11.2.4 by adding new 17.11.2.4.1 , page 203 , as follows:

[Division II, football only]

"17.11.2.4 Preseason Activities After Five-Day Acclimatization Period. The remaining preseason practice period shall be conducted as follows:

"17.11.2.4.1 Weightlifting. Weightlifting is not considered an on-field activity under Bylaw 17.11.2.4."
