Noncontroversial legislative proposals

The NCAA Division II Management Council and Presidents Council have determined, pursuant to NCAA Constitution 5.3.1.1.1, that the following proposals are noncontroversial and necessary to promote the normal and orderly administration of the Association's legislation. The Division II Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend the adoption of noncontroversial amendments, subject to ratification by the Division II Presidents Council.

Proposals that are ratified by the Presidents Council shall be effective as of the date identified in the proposal. Once ratified, the proposals will be published in The NCAA News and submitted by the Presidents Council as legislation at the 2003 NCAA Convention.

The items marked with an asterisk have been approved by the Management Council and Presidents Council in concept, but have not yet been approved in legislative form. Other items have previously been approved in legislative form. The page numbers in the proposals refer to the 2001-02 NCAA Division II Manual.

*No. 7 Organization -- Division II Management Council -- Duties and Responsibilities

Intent: To clarify the duties and responsibilities of the Management Council and Management Council Subcommittee, as specified.

A. Bylaws: Amend 4.6.2, page 25, as follows:

"4.6.2 Duties and Responsibilities. The Management Council shall:

[4.6.2-(a) through 4.6.2-(i) unchanged.]

"(j) Hear and act on appeals of the findings of major violations by the Division II Committee on Infractions involving Division II institutions;

"(k j) Review appeals by member institutions of decisions made by a Division II committee or the NCAA staff regarding the application of NCAA legislation to a particular situation when no other committee, subcommittee or conference has the authority to act (excluding actions of any committee that has final authority over issues subject to appeal); and

"(l k) Recommend the appointment of such committees or subcommittees as may be necessary for executing the provisions of this constitution or the Division II bylaws, subject to ratification by the Presidents Council."

B. Bylaws: Amend 4.6.2, page 25, by adding new 4.6.2.1, as follows:

"4.6.2.1 Duties of the Management Council Subcommittee. The Management Council Subcommittee shall:

"(a) Hear and act on appeals of the findings of major violations by the Committee on Infractions involving Division II institutions;

"(b) Hear and act on appeals regarding decisions of the Membership Committee involving the provisional membership status of Division II provisional member institutions or conferences;

"(c) Hear and act on appeals regarding decisions of the Academic Requirements Committee on initial-eligibility waivers involving Division II prospective student-athletes;

"(d) Hear and act on appeals regarding decisions of the Academic Requirements Committee on satisfactory-progress waivers involving Division II student-athletes; and

"(e) Hear and act on waiver requests in situations in which no other committee, subcommittee or conference has authority to act (for example, Administrative Review Subcommittee waivers)."

*No. 9 Financial Aid -- Maximum Institutional Grant-In-Aid Limitations by Sport -- Counters

Intent: To specify that if circumstances change and a medically exempted student-athlete subsequently practices or competes in intercollegiate athletics, the student-athlete shall become a counter only at the institution in which the incapacitating injury or illness occurred (as opposed to any institution).

Bylaws: Amend 15.5.1.1.3, page 152, as follows:

"15.5.1.1.3 Change in Circumstances. If circumstances change and the student-athlete subsequently practices or competes at any the institution at which the incapacitating injury or illness occurred, the student-athlete again shall become a counter, and the institution shall be required to count that financial aid under the limitations of this bylaw in the sport in question during each academic year in which the financial aid was received."

*No. 10 Playing and Practice Seasons -- Permissible Out-of-Season Activities

Intent: To clarify the "window" of opportunity for practice and competition in the nonchampionship segment.

A. Bylaws: Amend 17.7.7, page ___, as follows:

[17.7.7-(a) unchanged.]

"(b) Nonchampionship Segment Activities. during the segment in which the NCAA Championship does not occur, student-athletes may participate in any practice or competition activity as permitted by other legislation provided such activity is restricted to a maximum of 24 days that occur within a period of 45 consecutive calendar days, omitting vacation and examination days officially announced on the institution's calendar and days during which the institution is closed due to inclement weather, as long as no practice or competition occurs on such days. The 45 consecutive calendar days must be within the dates set forth in 17.7.5 and 17.7.6."

[Note: This proposal is presented in a nontraditional format. Appropriate revisions will be made in all relevant sections of Bylaw 17 affecting fall sports (that is, field hockey, soccer and volleyball.]

B. Bylaws: Amend 17.11.7, page ___, as follows:

[17.11.7-(a) unchanged.]

"(b) Nonchampionship Segment Activities. during the segment in which the NCAA Championship does not occur, student-athletes may participate in any practice or competition activity as permitted by other legislation provided such activity is restricted to a maximum of 24 days that occur within a period of 45 consecutive calendar days, omitting vacation and examination days officially announced on the institution's calendar and days during which the institution is closed due to inclement weather, as long as no practice or competition occurs on such days. The 45 consecutive calendar days must be within the dates set forth in 17.7.5 and 17.7.6."

[Note: This proposal is presented in a nontraditional format. Appropriate revisions will be made in all relevant sections of Bylaw 17 affecting spring sports, except outdoor track and field (that is, baseball, lacrosse, women's rowing, softball and tennis).]

*No. 12 Membership -- Emerging Sports for Women -- Revenue Distribution and Sports Sponsorship

Intent: To preclude an institution from using an emerging sport for women as a countable sport for revenue distribution and minimum sports sponsorship criteria; further, to eliminate legislation relevant to the sport of rowing as an emerging sport for women.

Bylaws: Amend 20.02.5, pages 267-268, as follows:

"20.02.5 Emerging Sports for Women. The following shall be considered emerging sports for women and countable for purposes of revenue distribution (i.e., for sports sponsorship and grants-in-aid):

[20.02.5-(a) through 20.02.5-(b) unchanged.]

"20.02.5.1 Additional Emerging Sports. The Presidents Council periodically shall identify future emerging sports for women that shall be countable sports for revenue distribution and minimum sports sponsorship criteria and shall establish procedures to determine minimum contests and maximum grants in those sports.

"20.02.5.3 Rowing. Students who were enrolled in a collegiate institution during the 1996-97 academic year are subject to the eligibility legislation for student-athletes participating in the sport of rowing that was in effect at the time of the student's initial enrollment [see Bylaw 14.01.5 (compliance with legislation for emerging sports)]."

*No. 14 Membership -- Minimum Financial Aid Requirement -- Single-Gender Programs

Intent: To specify that institutions that sponsor athletics programs for only one gender must satisfy at least one half of the one of the components of the proposed financial aid requirement.

Bylaws: Amend 20.10.1, page 274, as follows:

"20.10.1.2.2 Single-Gender Programs. Institutions that sponsor and conduct athletics programs for only one gender must award at least one half of the minimum requirements set forth in 20.10.1.2-(a)-(c)."

*No. 17 Committee on Competitive Safeguards and medical Aspects of Sports -- Duties

Intent: To modify the duties of the Committee on Competitive Safeguards and Medical Aspects of Sports, as specified.

Bylaws: Amend 21.1.2.2, page 280, as follows:

[Note: The proposed change involves a common provision and, thus, must be acted upon by the Divisions I, II and III membership acting independently.]

"21.1.2.2 Duties. The committee, subject to the direction of the Executive Committee, shall:

"(a) Collect and develop pertinent information regarding desirable training methods, prevention and treatment of sports injuries, utilization of sound safety measures at the college level, drug education, and drug testing Promote and sponsor research to address relevant health and safety issues;

"(b) Disseminate such information as might be brought appropriately to the attention of the Association's membership and adopt recommended policies and standards designed to further the above objectives Promote education to enhance the health and safety of student-athletes; and

"(c) Supervise the Association's drug-education and drug-testing programs under the direction of the Executive Committee. Operate a national injury surveillance program to monitor injury trends and enhance safety in intercollegiate athletics;

"(d) Deter the use of NCAA banned substances in order to promote fair competition and safety;

"(e) Facilitate outreach activities to enhance student-athlete health and safety; and

"(f) Provide a health and safety perspective on relevant legislation and policy."
