Noncontroversial legislative proposals

The NCAA Division II Management Council and Presidents Council have determined, pursuant to NCAA Constitution 5.3.1.1.1, that the following proposals are noncontroversial and necessary to promote the normal and orderly administration of the Association's legislation.

The Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend the adoption of noncontroversial amendments, subject to ratification by the Division II Presidents Council. Proposals that are ratified by the Presidents Council shall be effective as of the date identified in the proposal. Once ratified, the proposals will be published in The NCAA News and submitted by the Presidents Council as legislation at the 2003 NCAA Convention.

The items marked with an asterisk have been approved by the Management Council and Presidents Council in concept, but have not yet been approved in legislative form. Other items have previously been approved in legislative form. The page numbers in the proposals refer to the 2002-03 NCAA Division II Manual.

*No. 1 Membership -- Eligibility for Membership --
Membership Moratorium

Intent: To remove the current membership moratorium relating to the election of new provisional members in Division II.

Constitution: Amend 3.1.3, page 8, as follows:

"3.1.3 Membership Moratorium. An institution shall not be elected to begin provisional membership in Division II on or after September 1, 2000. The moratorium shall be in effect until September 1, 2002."

*No. 2 Membership -- Loss of Member Status -- Termination or Suspension of Member Institution or Conference

Intent: To grant the Presidents Council authority to terminate, suspend or otherwise discipline an active member institution or conference.

A. Constitution: Amend 3.2.5.1, page 11, as follows:

"3.2.5.1 Termination or Suspension. The membership of any active member failing to maintain the academic or athletics standards required for such membership or failing to meet the conditions and obligations of membership may be suspended, terminated or otherwise disciplined by a vote of two-thirds of the delegates present and voting at an annual Convention Presidents Council. Membership shall not be suspended or terminated unless:

"(a) A notice of intention to suspend or terminate membership, stating the grounds on which such a motion will be based, is given in writing to the chair of the Presidents Council and to the chief executive officer of the member institution on or before the first day of November before the Convention; and

"(b) The Presidents Council approves the notification of intention to move for suspension or termination; and.

"(c) Such notice is included in the Official Notice of the annual Convention."

B. Constitution: Amend 3.3.5.1, page 13, as follows:

"3.3.5.1 Termination or Suspension. The membership of any member conference failing to maintain the academic or athletics standards required for membership or failing to meet the conditions and obligations of membership may be suspended or terminated or the member conference otherwise disciplined by a vote of two-thirds of the delegates present and voting at an annual Convention Presidents Council. *No. 3 Provisional Membership -- Conference -- Application

Intent: To specify that the Management Council will determine the provisional conference membership application fee, as indicated.

Bylaws: Amend 3.3.7.6.1, page 15, as follows:

"3.3.7.6.1 Application. A conference desiring to become a provisional member conference shall apply on or before June 15 on a form available from the national office. A nonrefundable application fee in the amount of $2,500 shall accompany the application. The amount of the fee will be determined annually by the Management Council based on a continual analysis of expenses associated with the provisional member educational assessment program. In addition, a check for annual dues also shall accompany the application."

*No. 4 Playing and Practice Seasons -- Permissible Dates
and Out-of-Season Activities

Intent: To clarify the first permissible practice and competition dates and to establish practice and competition end dates.

Bylaws: Amend 17.12, pages 208-210, as follows:

"17.12 Golf. Regulations for computing the golf playing season are set forth in Bylaw 17.1, General Playing-Season Regulations. (Also see Figures 17-1 and 17-2.)

"17.12.1.1 Exception. A member institution that counts golf as a fall sport, per 3.2.4.10.1 may utilize the playing-season dates for fall sports and must follow out-of-season regulations for fall sports during the spring. The institution shall be eligible for the NCAA Championship occurring the spring.

"17.12.2 Alternate Playing Season. In golf, a member institution that declares fall as its institution's championship segment per Bylaw 3.2.4.10.1, may use the playing season dates for sports that conduct a fall championship. The institution is eligible for the NCAA championship.

*No. 5 Playing and Practice Seasons -- Exempted Scrimmages

Intent: To permit institutions to conduct and exempt practice scrimmages conducted any time during the permissible playing and practice season.

(This proposal is presented in a nontraditional format for soccer. Appropriate revisions will be made in all relevant sections of Bylaw 17 affecting fall sports.)

Bylaws: Amend 17.18.3 by adding new 17.18.3.1, page 225, as follows:

"17.18.3.1 Exception -- Exempted Practice Scrimmages. An institution may conduct its practice scrimmages any time during the permissible playing and practice season."

*No. 6 Membership Requirements -- Financial Aid Limitations -- Minimum Awards -- Counting Financial Aid Awards to
Satisfy Minimum Requirement

Intent: To clarify that financial aid awarded by an institution for a sport classified as Division I may be used to satisfy the new minimum financial aid requirements for purposes of Division II membership.

Bylaws: Amend Bylaw 20.10.1.2 by adding new 20.10.1.2.2, as follows:

[20.10.1.2 and 20.10.1.2.1 unchanged.]

"20.10.1.2.1.2 Counting Sports Classified as Division I. For purposes of counting financial aid awarded to student-athletes, an institution may use a sport classified as Division I sport in order to satisfy the minimum financial aid requirements for Division II membership set forth in Bylaw 20.10.1.2."

*No. 7 Membership Requirements -- Minimum Sports
Sponsorship -- Effective Date

Intent: To amend the effective date of Proposal No. 17 (Parts B, C and D) to "August 1, 2002."

A. Bylaws: Amend 20.10.3, page 274, as follows:

"20.10.3 Sports Sponsorship. A member shall sponsor a minimum of:

"(a) Five varsity intercollegiate sports, including at least two team sports, based on the minimum requirements of Bylaw 20.10.3.5 and involving all-male teams or mixed teams of males and females and five varsity intercollegiate sports, including at least two team sports, based on the minimum requirements of Bylaw 20.10.3.5 and involving all-female teams; or

"(b) Four varsity intercollegiate sports, including at least two team sports, based on the minimum requirements of Bylaw 20.10.3.5 and involving all-male teams or mixed teams of males and females and six varsity intercollegiate sports, including at least two team sports, based on the minimum requirements of 20.10.3.5 and involving all-female teams."

B. Bylaws: Amend 20.10.3.1, page 274, as follows:

"20.10.3.1 Sport(s) Sponsored in Division I. One men's and one women's sport required in Bylaw 20.10.3-(a) or one men's and one women's sport required in Bylaw 20.10.3-(b) may be sponsored in Division I."

C. Bylaws: Amend 20.10.3.5.8, page 275, as follows:

"20.10.3.5.8 Indoor and Outdoor Track and Field. Institutions may receive credit for sponsoring both indoor and outdoor track and field provided each team participates in the minimum number of contests with at least the minimum number of participants as set forth in Bylaw 20.10.3.5. Institutions also may receive credit for sponsoring both indoor and outdoor track and field, provided its team participates in a total of eight indoor and outdoor meets during the year, including at least three indoor and three outdoor meets."

D. Bylaws: Amend 20.10.3.5, pages 274-275, as follows:

"20.10.3.5 Minimum Contests and Participants Requirements for Sports Sponsorship. In each sport, the institution's team shall engage in at least a minimum number of intercollegiate contests (against four-year, degree-granting collegiate institutions) each year. In the individual sports, the institution's team shall include a minimum number of participants in each contest that is counted toward meeting the minimum-contest requirement. The following minimums are applicable:

Effective date: Part A: August 1, 2005, for institutions that are Division II active or provisional members as of August 1, 2001; immediately for any institution applying for provisional membership or declaring its intent to reclassify to Division II on or after January 14, 2002.

Parts B, C, and D: August 1, 2005, for institutions that are Division II active or provisional members as of August 1, 2001; Immediately for any institution applying for provisional membership or declaring its intent to reclassify to Division II on or after January 14, 2002 August 1, 2002.

*No. 8 Committees -- Lacrosse Rules Committee, Men's

Intent: To establish an NCAA Men's Lacrosse Rules Committee comprising nine members, including the secretary-rules editor.

(The proposed change involves a common provision and, thus, must be approved by each of the Divisions I, II and III membership acting independently.)

Bylaws: Amend 21.2 by adding new 21.2.7, pages 281-283, as follows:

"21.2.7 Lacrosse Rules Committee, Men's. The Men's Lacrosse Rules Committee shall consist of nine members and shall be constituted as follows:

"(a) Four members shall be from Division I, one member shall be from Division II and three members shall be from Division III. One additional member shall serve as a nonvoting secretary-rules editor; and

"(b) One member shall be elected chair."

*No. 9 Membership Committee -- Duties

Intent: To permit the NCAA Division II Membership Committee to oversee the provisional membership process, including determinations regarding the progress of provisional members.

Bylaws: Amend 21.6.6.6, page 290, as follows:

"21.6.6.6 Division II Membership Committee.

[21.6.6.6.1 unchanged.]

"21.6.6.6.2 Duties. The committee shall:

"(a) Review and consider issues pertaining to the Division II membership requirements and membership compliance; and

"(b) Handle Convention tasks related to Division II business, which include examining the credentials of Division II delegates, determining (subject to appeal of the Division II membership) the authority of any Division II delegate to vote or otherwise represent a member institution at an annual or special Convention and counting the votes at an annual or special Convention.; and

"(c) Determine the status of provisional member institutions and whether an institution should progress to the next year of the provisional membership period (with or without conditions) or whether an institution should repeat a given year of the provisional membership period."

*No. 10 Committees -- Field Hockey Committee

Intent: To increase the field hockey committee from three to four members.

Bylaws: Amend 21.6.7.5, page 292, as follows:

"21.6.7.7 Field Hockey Committee. The Division II Field Hockey Committee shall consist of three four members."

*No. 11 Committees -- Men's Golf Committee

Intent: To increase the men's golf committee from three to five members.

Bylaws: Amend 21.6.7.7, page 292, as follows:

"21.6.7.7 Golf Committee, Men's. The Division II Men's Golf Committee shall consist of three five members."

*No. 12 Committees -- Women's Lacrosse Committee

Intent: To increase the women's lacrosse committee from three to four members.

Bylaws: Amend 21.6.7.10, page 292, as follows:

"21.6.7.10 Lacrosse Committee, Women's. The Division II Women's Lacrosse Committee shall consist of three four members."

*No. 13 Committees -- Men's and Women's Tennis Committee

Intent: To specify that the men's and women's tennis committee shall consist of eight members, including three positions allocated for men, three positions allocated for women and two positions unallocated.

Bylaws: Amend 21.6.7.15, page 293, as follows:

"21.6.7.15 Tennis Committee, Men's and Women's. The Division II Men's and Women's Tennis Committee shall consist of eight members. Four members of the committee shall represent men's tennis interests, and four members shall represent women's tennis interests, including three Three positions shall be allocated for men, three positions shall be allocated for women and two positions shall be unallocated.

*No. 14 Committees -- Wrestling Committee

Intent: To increase the wrestling committee from three to four members.

Bylaws: Amend 21.6.7.18, page 293, as follows:

"21.6.7.18 Wrestling Committee. The Division II Wrestling Committee shall consist of the three four Division II representatives to the common Wrestling Committee with playing rules and championships administration responsibilities (see Bylaw 21.3.10)."
