The NCAA News

The following chart highlights legislative actions taken by the Division I Management Council during its October 21-22 meeting in Indianapolis. Legislative proposals that were considered at this meeting are arranged according to NCAA bylaw or constitution and are categorized as either having been approved a second time and forwarded to the Board of Directors for adoption, approved for the first time and distributed to the membership for comment, defeated, tabled, referred to another governance entity for additional review, rendered moot or withdrawn by the sponsor.

Constitution 4

Final approval

No. 02-16, exempting the Student-Athlete Reinstatement Committee from the requirement that no subdivision shall have more than 50 percent representation on any committee. (Effective date: Immediately.)

No. 02-33, clarifying that a conference staff member shall satisfy the "on-the-staff" requirement only if he or she is employed at one of the multisport conferences recognized as part of the governance structure in Constitution 4. (Effective date: Immediately.)

No. 02-34, revising the composition of the Board of Directors, Management Council and AEC Cabinet, as specified, to list the Big West Conference as Division I-AAA instead of as Division I-A. (Effective date: Immediately.)

No. 02-38, defining the composition of the Division I-AA Football Governance Committee, as specified. (Effective date: Immediately.)

Initial approval

No. 02-100, confirming that each subdivision of Division I must meet the requirements of Constitution 4.5.1 when making appointments to the Management Council and the cabinets; further, to specify that the Management Council Subcommittee on Selection Review shall review the prospective appointments and take into account the history of appointments by conference and confirm to the Board of Directors that such appointments comply with the requirement set forth in Constitution 4.5.1. (Effective date: Immediately.)

No. 02-101, permitting Division I-AA or I-AAA conferences to appoint an alternate representative to the Division I Board of Directors who may attend when the appointed representative is absent. (Effective date: Immediately.)

No. 02-33-1, amending Proposal No. 02-33 to exempt service on the Men's and Women's Ice Hockey Committees and the Men's and Women's Ice Hockey Rules Committee.

No. 02-33-2, amending Proposal No. 02-33 to allow the Championships/Competition Cabinet to waive the requirement under specified circumstances.

Constitution 5

Initial approval

No. 02-99, establishing a "sunset" period for legislative proposals not forwarded to the Board of Directors within four legislative Management Council meetings unless the Management Council elects to extend the four-meeting time period. (Effective date: Immediately.)

Bylaw 11

Initial approval

No. 02-50, specifying that each member conference shall establish procedures for administering the annual coaches certification exam. (Effective date: Immediately.)

No. 02-52, permitting a Division I-AA head football coach to make an off-campus contact or evaluation with a prospective student-athlete at any time during a calendar week (Sunday through Saturday) during a permissible contact or evaluation period, provided no more than seven coaches (including the head coach) are engaging in off-campus recruiting activities at any one time during the calendar week. (Effective date: Immediately.)

Defeated

No. 01-06, permitting a Division I-A football institution to employ as a graduate assistant coach a student who is enrolled in a graduate program at another institution.

Bylaw 12

Final approval

No. 02-17 (as amended by Proposal No. 02-17-1), permitting a student-athlete in Division I-A football to enter a professional league's draft without jeopardizing eligibility in that sport, provided the student-athlete declares his intention to resume intercollegiate football participation within 72 hours after the date of the NFL draft declaration date of that year. (Effective date: Immediately.)

Initial approval

No. 02-46, permitting an enrolled basketball student-athlete attending a two-year collegiate institution to enter a professional league's draft one time during his or her collegiate career without jeopardizing eligibility in that sport, provided the student-athlete is not drafted by any team in that league and the student-athlete declares his or her intention to resume intercollegiate participation within 30 days after the draft. [Effective date: August 01, 2003 (for student-athletes entering a collegiate institution on or after August 01, 2003).]

No. 02-49, specifying that a professional team is one that provides any of its players more than the value of actual and necessary expenses, including other reasonable expenses incidental to participation. (Effective date: Immediately.)

No. 02-76, permitting an enrolled basketball student-athlete who has entered a professional league's draft pursuant to Bylaw 12.2.4.2.1 to participate in a predraft camp sponsored by a professional sports organization, provided the student-athlete has received written permission from the institution's director of athletics; further, to specify that the student-athlete may accept actual and necessary travel, and room and board expenses from a professional sports organization to participate in its predraft camp. (Effective date: Immediately.)

Bylaw 13

Final approval

No. 02-79, limiting evaluations in men's basketball that may occur during the April contact period at sites other than the prospective student-athlete's educational institution to Saturday or Sunday, and to specify that such evaluations may not occur on any weekend during which the PSAT, SAT or ACT national standardized tests are administered. (Forwarded to the Board of Directors as emergency legislation.) (Effective date: Immediately.)

Initial approval

No. 01-76 (as amended by Proposal No. 01-76-1), specifying that camp brochures are not restricted in content or design, but are restricted to a single two-sided sheet, not to exceed 17" X 22" when opened in full. (Effective date: August 1, 2003.)

No. 02-44, reducing from four to three the number of permissible telephone calls an institution may make to a women's basketball prospective student-athlete during the period of June 21 through July 31. (Effective date: August 1, 2003.)

No. 02-45, prohibiting institutional women's basketball staff members in attendance at nonscholastic certified events from having any communication with a prospect's coach or any other individual associated with the prospect as a result of the prospect's participation in basketball during the time period in which the prospect is participating in the certified event. (Effective date: August 1, 2003.)

No. 02-74, specifying circumstances in which an institution does not have to declare ineligible and seek reinstatement on behalf of an individual (that is, prospective or enrolled student-athlete) who received an improper benefit, provided the individual repays the value of the improper benefit. (Effective date: August 1, 2003.)

No. 02-75, specifying circumstances in which a de minimis violation will not render a prospective or enrolled student-athlete ineligible while retaining that such a violation shall be considered an institutional violation. (Effective date: August 1, 2003.)

No. 02-78, permitting a Division I-AA football noncoaching staff member with football-specific responsibilities to initiate and receive telephone calls from a football prospect related to general pre-enrollment administrative issues subsequent to the prospect signing a National Letter of Intent with the institution or, for those institutions not subscribing to the National Letter of Intent, subsequent to the prospect's signed acceptance of the institution's written offer of admission and/or financial aid. (Effective date: Immediately.)

Defeated

No. 01-19, permitting a member institution's coach, during a dead period, to serve as a broadcaster or commentator for events involving national teams, such as the Olympic Games or World Championships.

Tabled

No. 02-88, specifying that results of the medical examination conducted by an institution during a prospect's official or unofficial visit may not be used to determine the admission of the prospect. (Effective date: August 1, 2003.)

Referred

No. 02-89, specifying that camps conducted by the Fellowship of Christian Athletes are not subject to the regulations applicable to camps and clinics set forth in Bylaw 13.13. (Referred to the Championships/Competition Cabinet for further review.) (Effective date: August 1, 2003.)

Bylaw 14

Final approval

No. 02-2 (as amended by Proposal No. 02-2-3), eliminating the requirement in basketball and soccer that the evaluation of an international student-athlete's amateur status shall be based on a guide produced by the NCAA identifying teams and leagues in foreign countries that are professional. (Effective date: August 1, 2003.)

No. 02-22-B, increasing the minimum number of core-course units for a qualifier from 13 to 14, as specified; establishing an initial-eligibility index based on a core-curriculum GPA of 3.550, an SAT score of 400 or an equivalent ACT sum score to be determined by the ACT testing agency; and eliminating all references to partial qualifiers. (Effective date: Student-athletes first entering an institution on or after August 1, 2003, shall meet the current or new standard; student-athletes first entering an institution on or after August 1, 2005, shall meet the new standard.)

No. 02-23 (as amended by Proposal No. 02-23-2), requiring (1) that 24 semester or 36 quarter hours of academic credit be completed before the student-athlete enters his or her second year of collegiate enrollment; (2) that 18 semester or 27 quarter hours of academic credit (during the academic year) be completed in the previous academic year or since the beginning of the certifying institution's preceding regular two semesters or three quarters; and (3) that six semester or nine quarter hours of academic credit be completed the preceding regular academic term in which the student-athlete has been enrolled at any collegiate institution; further, permitting a student-athlete who satisfies the requirements of the missed-term exception or the medical-absence or international-competition waivers to be prorated nine semester or six quarter hours per term of actual attendance during an academic year. (Effective date: August 1, 2003, for student-athletes first entering an institution full time on or after August 1, 2003.)

No. 02-24-B (as amended by Proposal No. 02-24-B-2), increasing progress-toward-degree requirements from 25/50/75 to 40/60/80 (33/50/67 for student-athletes in a five-year degree program); requiring student-athletes entering their second year of collegiate enrollment to present 90 percent of the minimum GPA necessary to graduate from the institution; requiring student-athletes entering their third year of collegiate enrollment to present 95 percent of the minimum GPA necessary to graduate from the institution; and requiring student-athletes entering their fourth or subsequent year of collegiate enrollment to present 100 percent of the minimum GPA necessary to graduate from the institution. (Effective date: August 1, 2003, for those student-athletes first entering a collegiate institution full time on or after August 1, 2003.)

No. 02-25, deleting the two-year college transfer percentage of degree requirements for a partial qualifier or a nonqualifier in football and men's basketball. (Effective date: August 1, 2003, for those student-athletes first entering a collegiate institution on or after August 1, 2003.)

No. 02-26, reducing the number of credits in remedial, tutorial or noncredit course work that may be used to satisfy the minimum academic progress requirement from 12 semester/18 quarter hours to six semester/nine quarter hours. (Effective date: August 1, 2003, for those student-athletes first entering a collegiate institution on or after August 1, 2003.)

No. 02-18, permitting a student-athlete in men's water polo to compete in the institution's nonchampionship segment without using a season of competition, provided the student-athlete was academically eligible during the championship segment. (Effective date: Immediately.)

Initial approval

No. 02-47, specifying that percentage-of-degree requirements apply only to those years in which the student-athlete is enrolled at a national service academy. (Effective date: Immediately.)

No. 02-66, specifying that a graduate student who is otherwise eligible for regular-season competition shall successfully complete a minimum of six semester or quarter hours of academic credit the preceding regular academic term in which the student-athlete has been enrolled as a graduate student at any collegiate institution. (Effective date: Before the 2003 fall term; thus applicable to hours earned by graduate students during the 2003 fall term.)

No. 02-67, specifying that a student-athlete shall meet the initial-eligibility requirements for a qualifier in effect at the time of the student-athlete's initial full-time enrollment in a collegiate institution. (Effective date: August 1, 2003.)

No. 02-68, permitting a two-year college transfer student who was a qualifier to be eligible for competition at Division I institutions during the first academic year in residence, provided the student-athlete spent one full-time semester or quarter at the two-year college, presented a minimum cumulative grade-point average of 2.000 and satisfactorily completed 12 semester or quarter hours of transferable degree credit for each full-time academic term of attendance at the two-year college. (Effective date: August 1, 2003, for students first entering institutions of a full-time basis on or after August 1, 2003.)

No. 02-69, specifying that a fourth season of intercollegiate competition shall be granted to a student-athlete with a diagnosed learning disability, provided the student-athlete has completed at least 80 percent of his or her designated degree program at the beginning of the fifth academic year after the student-athlete's initial, full-time collegiate enrollment. (Effective date: August 1, 2003, for students first entering institutions of a full-time basis on or after August 1, 2003.)

No. 02-70, specifying that a student-athlete shall be required to successfully complete six semester or quarter hours of academic credit the preceding regular academic term in which the student-athlete has been enrolled at any collegiate institution. (Effective date: Before the 2003 fall term; thus applicable to hours earned by graduate students during the 2003 fall term.)

No. 02-73, specifying that the Committee on Student-Athlete Reinstatement has jurisdiction over waivers of the five-year rule for student-athletes of the national service academies. (Effective date: August 1, 2003.)

No. 02-77, specifying that the Academics/Eligibility/Compliance Cabinet may approve, for a student with a diagnosed learning disability, the use of all core courses completed before initial full-time collegiate enrollment; permitting the use of courses for students with disabilities provided the courses appear on the high-school's list of approved core courses; and specifying that students with disabilities may use test scores achieved during a nonstandard administration of the SAT or ACT. (Effective date: August 1, 2003. Applicable to individuals who enroll full-time at a collegiate institution after the 2003 fall term.)

No. 02-102, specifying that the Academics/Eligibility/Compliance Cabinet shall assume responsibility for annually reviewing the compliance forms (for example, student-athlete statement, drug-testing consent form and international student-athlete form). (Effective date: Immediately.)

No. 99-27, specifying that in basketball, an individual who does not enroll in a collegiate institution within one year after completion of secondary studies shall lose a season of competition for each year in which the individual has participated in organized basketball competition (except for military competition) after the one-year time period; further, an individual who engages in organized competition (except for military competition) after the one-year time period must fulfill one academic year in residence upon enrollment at an NCAA Division I institution.

No. 02-23-3, amending Proposal No. 02-23 to require institutions to conduct only a single midyear eligibility check on student-athletes after the fall semester or quarter to be determined not later than 10 days after the start of the winter quarter/spring semester.

No. 02-24-B-3, amending Proposal 02-24-B to require a 35/60/80 progression in progress toward degree rather than 40/60/80.

No. 02-24-B-4, amending the effective date of Proposal No. 02-24 to August 1, 2004.

No. 02-2-2, requiring basketball institutions that are recruiting and evaluating the eligibility of international student-athletes to use a guide that identifies teams and leagues in foreign countries that are considered professional under NCAA amateurism regulations; further, to specify that the international student-athlete form must be completed and signed before competition.

Tabled

No. 02-71, specifying that an institution shall not be eligible to enter a team or an individual competitor in an NCAA championship unless the institution has completed the Annual Academic Progress Rate in a survey form prescribed by the Board of Directors. (Effective date: August 1, 2004.)

No. 02-72, specifying that an institution shall not be eligible to enter a team or an individual competitor in an NCAA championship unless the institution has completed the NCAA Graduation Success Rate report by the deadline established by the Board of Directors. (Effective date: August 1, 2004.)

Moot

No. 02-22-A, increasing the minimum number of core-course units for a qualifier from 13 to 14, as specified; establishing an initial-eligibility index based on a core-curriculum GPA of 3.000, an SAT score of 620 or an ACT sum score of 52; and eliminating all references to partial qualifiers.

No. 02-22-C, increasing the minimum number of core-course units for a qualifier from 13 to 14, as specified, establishing a complete, comprehensive initial-eligibility index and eliminating all references to partial qualifiers.

No. 02-24-A, increasing progress-toward-degree requirements from 25/50/75 to 40/
60/80 (33/50/67 for student-athletes in a five-year degree program) and requiring student-athletes entering their second year of collegiate enrollment to achieve and maintain 90 percent of the minimum GPA necessary to graduate. Student-athletes entering their third year of college must achieve and maintain 100 percent of the cumulative minimum GPA required for graduation in the specified degree program.

No. 02-24-A-1, requiring a student-athlete entering his or her third year of enrollment to achieve 100 percent of the cumulative minimum grade-point average necessary to graduate from the student-athlete's institution and to require an institution to conduct a mid-year certification of its student-athletes not later than January 15.

No. 02-24-A-2, requiring student-athletes entering their second year of collegiate enrollment to maintain 90 percent of the minimum GPA necessary to graduate from the institution; requiring student-athletes entering their third year of collegiate enrollment to maintain 95 percent of the minimum GPA necessary to graduate from the institution; and requiring student-athletes entering their fourth or subsequent year of collegiate enrollment to maintain 100 percent of the minimum GPA necessary to graduate from the institution.

No. 02-24-B-1, requiring a student-athlete entering his or her third year of enrollment to achieve 100 percent of the cumulative minimum GPA necessary to graduate from the student-athlete's institution.

Withdrawn

No. 99-82, requiring that any participation as an individual or a team representative in organized sports competition by a student during each 12-month period after the student's 19th birthday and before enrollment at a collegiate institution will count as a season of competition in that sport; further, to except participation in high-school all-star contests from the application of the rule.

Bylaw 15

Final approval

No. 02-21, exempting a student-athlete's on- and off-campus employment earnings from both individual and institutional financial aid limits. (Effective date: August 1, 2003.)

No. 02-81, specifying that financial aid countable toward an institution's team limits includes only institutional financial aid based on athletics ability, outside financial aid for which athletics participation is a major criterion and educational expenses awarded by the U.S. Olympic Committee or a U.S. national governing body (or, for international student-athletes, expenses awarded by the equivalent organization of a foreign country); further, specifying that outside financial aid for which athletics is a major criterion must count against the institution's team limits, regardless of whether the student-athlete was recruited by the certifying institution. No. 02-83-A, establishing a student-athlete's individual maximum financial aid limit as the cost of attendance; further, specifying that a student-athlete may receive institutional financial aid based on athletics ability, outside financial aid for which athletics participation is a major criterion and educational expenses awarded by the U.S. Olympic Committee or a U.S. national governing body (or, for international student-athletes, expenses awarded by the equivalent organization of a foreign country) up to the value of a full grant-in-aid. Finally, to specify that a student-athlete may receive any other financial aid unrelated to athletics ability up to cost of attendance; or the value of a full grant-in-aid plus a Federal Pell Grant, whichever is greater. Bylaw 16

Initial approval

No. 02-51, permitting an institution to provide an additional meal or snack to student-athletes during the preseason practice period before the start of the academic year. (Effective date: Immediately.)

No. 02-64, permitting a student-athlete to retain frequent flyer points and/or miles earned during team travel. (Effective date: August 1, 2003.)

No. 02-65, permitting an institution to pay reasonable entertainment costs associated with required practice during vacation periods (for example, preseason period), provided such entertainment occurs within a 30-mile radius of the institution's campus or practice site and classes are not in session. (Effective date: August 1, 2003.)

Bylaw 17

Final approval

No. 01-83 (as amended by Proposal No. 01-83-1), decreasing from six to five the number of student-athletes in soccer from any one institution that may participate on the same outside team outside the academic year. (Effective date: Immediately.)

No. 02-28, redefining countable athletically related activities as specified. (Effective date: August 1, 2003.)

No. 02-29, exempting both games of a softball doubleheader between a member institution and a foreign team played in the United States. (Effective date: August 1, 2003.)

Initial approval

No. 02-57, eliminating the requirement in basketball that the postseason men's and women's National Invitation Tournaments must be certified in order for institutions to exempt participation from their maximum contest limitations. (Effective date: August 1, 2003.)

No. 02-84, amending the out-of-season conditioning and preseason practice legislation in football as specified. (Effective date: amended to August 1, 2004.)

No. 02-97, establishing an NCAA Division I Nonscholarship Football Championship. (Effective date: August 1, 2003.)

Defeated

* No. 99-112, permitting Divisions I-A and I-AA football student-athletes to participate in individual skill-related instruction outside the institution's declared playing season during the academic year, provided (a) the student-athlete requests such instruction; (b) such instruction does not involve the use of any pads or helmets; and (c) no more than four student-athletes are involved in skill-related instruction with their coaches at any one time in any facility. (Division I-A vote only; the proposal already had been defeated in Division I-AA.)

Bylaw 18

Final approval

No. 2000-26, permitting the respective divisional Management Councils to waive the minimum sports sponsorship requirements necessary to establish a National Collegiate Championship in an emerging sport for women. (The proposed change involves a common provision and, thus, must be approved by each of the Divisions I, II and III memberships acting independently.) (Effective date: August 1, 2003.)

Initial approval

No. 02-85, establishing a National Collegiate Women's Bowling Championship, effective 2003-04, and establishing a six-person Women's Bowling Committee. (Effective date: August 1, 2003.)

Bylaw 19

Final approval

No. 02-98, increasing the composition of the Committee on Infractions from nine to 10 members; further, increasing from one to two the number of committee members responsible for processing appeals. (Forwarded to the Board of Directors as emergency legislation.) (Effective date: Immediately.)

Bylaw 20

Final approval

No. 02-27, establishing six as the number of contests necessary to count the sport of equestrian for sports-sponsorship purposes. (Effective date: Immediately.)

No. 02-37, defining a Division I-A conference, as specified. (Effective date: August 1, 2005.)

Initial approval

* No. 02-48, reducing from 100 to 50 percent the percentage of Division I opponents an institution must schedule to satisfy the minimum number of contest requirements in men's swimming and men's indoor and outdoor track and field. (Effective date: August 1, 2003.)

No. 02-91, permitting Division I members to count provisional and reclassifying institutions as Division I opponents at the time those institutions are required to comply with the Division I membership scheduling requirements. (Effective date: July 1, 2004.)

No. 02-92, specifying that the application fee for provisional members shall be refunded, less the expenditure related to educational costs associated with the membership process, should the applicant fail to progress to active membership. (Effective date: August 1, 2003.)

No. 02-93, specifying that failure to meet Division I-A membership requirements results in the institution being placed in restricted membership status in the sport of football for one year. (Effective date: August 1, 2004.)

No. 02-94, revising the waiver criteria for Division I membership requirements to reflect the current governance structure; further, specifying that such waivers are not available for institutions failing to meet Division I-A membership requirements. (Effective date: August 1, 2003.)

Defeated

No. 02-63, amending the effective date of the Division I-A membership requirements (Proposal No. 01-123) from August 1, 2004, to August 1, 2005.

Bylaw 21

Final approval

No. 02-10, specifying that Championships/Competition Cabinet members' terms of service shall begin on the first day of July after the member's appointment. (Effective date: Immediately.)

No. 02-12, modifying the duties of the Committee on Competitive Safeguards and Medical Aspects of Sports, as specified. (Effective date: Immediately.)

No. 02-15, specifying that AEC Cabinet members' terms of service shall begin the first day of July after the member's appointment. (Effective date: Immediately.)

Initial approval

No. 02-53, establishing a term limit of four years for secretary-rules editors serving on sports rules committees, with the ability to be reappointed to a term not to exceed eight years; further, to establish a waiver to allow a secretary-rules editor's eight-year term limit to be extended by a maximum of four additional years. (The proposed change involves a common provision and, thus, must be approved by each of the Divisions I, II and III governance structures, acting independently.) (Effective date: Immediately.)

No. 02-54, exempting the Men's Gymnastics Committee from the requirement that no subdivision shall have any more than 50 percent representation on any committee; further, to eliminate the requirement that four members must be from Division I and two members must be selected at large. (Effective date: Immediately.)

No. 02-86, specifying that the six-member Women's Lacrosse Committee consist of two members from each of the three regions (Mid-Atlantic, Northeast and South). Effective date: August 1, 2003.)

No. 02-90, establishing an NCAA Men's Lacrosse Rules Committee comprising nine members, including the secretary-rules editor. (The proposed change involves a common provision and, thus, must be approved by each of the Divisions I, II and III governance structures, acting independently.) (Effective date: August 1, 2003.)

No. 02-96, establishing a Division I-AA/I-AAA Presidential Governance Committee, which would be composed of one president from each of the 20 Division I-AA and I-AAA conferences represented in the Division I governance structure, including the seven Division I-AA/I-AAA members of the Board of Directors. (Effective date: Immediately.)

No. 02-58, establishing an Association-wide playing-rules oversight panel appointed by the NCAA Executive Committee to resolve proposals involving player safety, financial impact or image of the game that do not have unanimous Division I, II or III support and to provide counsel to the NCAA staff about playing-rules issues, including implementation of rules and regulations. The composition of the committee would be eight members, including the chair of the Championships/Competition Cabinet, and two representatives each from Divisions II and III, including the Division II Championships Committee and Division III Championships Committee chairs.

Bylaw 22

Initial approval

No. 02-95, revising the once-every-three-year rules-compliance evaluation to once every four years. (Effective date: August 1, 2003.)

Bylaw 30

Final approval

No. 02-80, permitting softball contacts and evaluations in Hawaii during the quiet period. (Effective date: Immediately.)

Final approval

No. 02-55, permitting a conference in 2003-04 to retain eligibility for automatic qualification in any sport (other than men's basketball), provided the conference was eligible for automatic qualification in 2002-03 under the September 1999 automatic-qualification provisions and will be eligible for automatic qualification in 2004-05 under the September 2003 automatic-qualification provisions, and the conference and member institution sponsorship of that sport is unchanged over that period of time. (Effective date: Immediately.)

No. 02-56, deleting the legislation that sets forth the process for selecting the official conference representative when automatic qualification is not applicable. (Effective date: Immediately.)

No. 02-87, specifying that in instances where the final day of the women's rowing championship occurs on a Sunday, competition may begin before noon. (Effective date: Immediately.)
