Association-wide legislative proposals

The following list indicates the status of Association-wide legislative proposals currently under consideration in the NCAA governance structure. Since the proposals involve common provisions, they must be acted upon by the Divisions I, II and III membership, acting independently. Additional information on the specific legislative proposals may be found on the Legislative Services Database (LSDBi) at www.ncaa.org.

Issue: Amend Bylaw 31.2.3.1 to add Phenylpropanolamine (PPA) to the list of banned substances under the category of "Stimulants."

Originating governance entity: Committee on Competitive Safeguards and Medical Aspects of Sports.

Status: Approved in Divisions I and III; in progress in Division II.

Issue: To conduct a year-round NCAA drug-testing pilot program in the second semester of 2001-02 in Division I and Division II baseball, with no penalty to the individual student-athlete for a positive drug test during this pilot phase. This action would require NCAA Bylaw 18.4.1.5.1 to be set aside for this pilot testing only, so that testing can occur with no penalty; this bylaw provides for a mandatory penalty for a positive drug test.

Originating governance entity: Committee on Competitive Safeguards and Medical Aspects of Sports.

Status: Approved in Division II; not applicable in Division III; in progress in Division I (Championships/Competition Cabinet declined to support; referred back to committee. Cabinet members expressed concern about the inconsistent message that would be sent to student-athletes if the NCAA did not impose penalties for positive tests while some institutions do impose penalties on baseball student-athletes who test positive. The cabinet requested additional research and suggested one means the committee could use to obtain its information would be to survey institutions that have drug-testing programs that include baseball student-athletes.)

Issue: Add emphasis to the drug-testing consent form language reflecting the requirement, under Bylaw 30.5 (b), to disseminate a copy of the list of banned-drug classes to each student-athlete. The following statement should be placed in the introduction to the Drug-Testing Consent Form, effective August 2002: "Per NCAA Bylaw 30.5 (b), the director of athletics or the director of athletics' designee shall disseminate a copy of the list of banned drug classes to each student-athlete."

Issue: Add testing for ephedrine to the year-round drug-testing program, effective August 2002 (Divisions I and II only).

Status: Approved in Divisions I and II; approved by the Executive Committee in the preliminary budget.

Issue: To accept the proposed drug-testing protocol changes, as recommended, for inclusion in the 2002 protocol book, effective August 2002.

Originating governance entity: Committee on Competitive Safeguards and Medical Aspects of Sports.

Status: Approved in all three divisions.

Issue: To expand educational efforts to heighten awareness of issues surrounding out-of-season conditioning, including an emphasis on information about hydration, heat, appropriate clothing, supplements, other topics related to conditioning and the value of the presence of an individual at workouts, other than the person conducting them, who has the unchallengeable authority to cancel or change the workouts as appropriate.

Originating governance entity: Division I Football Oversight Committee. (This topic is not being treated as an Association-wide issue. Each division will use its respective committees to address this recommendation.)

Status: Approved in Divisions I and II; Division III Management Council recommends that the committee expand the educational campaign regarding out-of-season conditioning to include a broader audience and all sports.

Issue: Mandate some form of eye protection in women's lacrosse as soon as practicable.

Status: In progress in all three divisions.

Issue: Eliminate the drug-testing announcement at the mandatory pre-championship administrator/coaches meeting as a deterrent to ergogenic drug use, effective August 2002.

Status: Approved in all three divisions.

Issue: To clarify in the drug-testing protocol, effective August 2002, the point at which a student-athlete is declared ineligible and not permitted to participate in competition.

Status: Approved in all three divisions.

Issue: Amend Bylaw 21.1.2.2 through non-controversial legislation to read: The committee, subject to the direction of the Executive Committee, shall: (a) Promote and sponsor research to address relevant health and safety issues; (b) Promote education to enhance the health and safety of student-athletes; (c) Operate a national injury surveillance program to monitor injury trends and enhance safety in intercollegiate athletics; (d) Deter the use of NCAA banned substances in order to promote fair competition and safety; (e) Facilitate outreach activities to enhance student-athlete health and safety; and (f) Provide a health and safety perspective on relevant legislation and policy.

Status: Approved in Divisions II and III; in progress in Division I (out for comment).

Issue: Add the phrase "by the NCAA and/or" to the student-athlete statement, Part IV: Results of Drug Tests, as follows, effective August 2002: "You affirm that you have not tested positive for banned substances by the NCAA and/or by a non-NCAA national or international athletics organization."

Status: Approved in all three divisions.

Issue: Fully funding the Resource Exchange Center by allocating $75,000 new drug-education funds for 2002-03 and an additional $10,000 (total $85,000) for 2003-04.

Originating governance entity: Committee on Competitive Safeguards and Medical Aspects of Sports.

Status: Executive Committee did not approve the new budget allocation.

Issue: Allocating the second year of previously requested Association resources ($200,000) to complete necessary upgrades to the NCAA Injury Surveillance System.

Originating governance entity: Committee on Competitive Safeguards and Medical Aspects of Sports.

Status: Approved in all three divisions.

Issue: Funding $100,000 to support an educational initiative addressing nutrition, optimal body composition and eating disorders that tie current Association efforts with continuing concerns of student-athletes.

Originating governance entity: Committee on Competitive Safeguards and Medical Aspects of Sports.

Status: Approved in all three divisions. Executive Committee approved $50,000 in preliminary budget process.

Issue: Providing additional Association-wide funding ($50,000) to enhance the existing NCAA Speakers Grant Fund.

Status: Executive Committee denied committee recommendation.

Issue: Providing funding ($5,000) to support an exploration and partner with other campus departments and nonprofit organizations to establish new initiatives in tobacco cessation, with an emphasis on cigarette use.

Status: Executive Committee denied committee recommendation.

Issue: Request that the presidential groups notify the sports committees responsible for the administration of the men's and women's basketball championships and the Student-Athlete Advisory Committee of its concern about the scheduling of regular-season contests at casinos.

Status: Approved in Divisions I and III; in progress in Division II.

Issue: Amending Bylaw 18.2.4.1 to extend the exception for women's sports through the 2008-09 academic year.

Originating governance entity: Committee on Women's Athletics.

Status: Approved in all three divisions.

Issue: Identifying rugby as an emerging sport for women.

Originating governance entity: Committee on Women's Athletics.

Status: Approved in all three divisions, though the Division III Presidents Council expressed concerns regarding health and safety issues related to the sport of rugby.

Issue: Eliminate the NCAA Clearinghouse Committee.

Originating governance entity: Initial-Eligibility Clearinghouse (Divisions I and II).

Status: Approved in all three divisions.

Issue: Adopting legislation that amends Bylaw 21.2.1.1 to establish a term limit of eight years for secretary-rules editors serving on sports rules committees and to create an exception for the "on the staff" requirement.

Originating governance entity: N/A.

Status: In progress in Division I. The "on the staff" exception was adopted. Thus, each division should now have the "on the staff" requirement exception. Divisions II and III have approved the establishment of term limits; however, Division I did not approve establishing term limits. This legislation requires approval in all three divisions and is therefore not effective.
