Modification of wording

The following are proposals that the NCAA Division III Management Council has agreed to sponsor as an intent-based modifications. The approved revision is consistent with the intent of the original legislation.

All legislative citations and governing bodies are reflected as they now appear in the 2001-02 NCAA Division III Manual.

Bold type indicates new wording; italicized type indicates wording removed.

No. 1 Eligibility -- Two-Year College Transfers -- Two-Year Nonparticipation Exception

Intent: To specify that a two-year college transfer may use the two-year nonparticipation exception, provided for a consecutive two-year period immediately prior to the date on which the student begins participation that he or she has neither practiced nor competed in organized noncollegiate amateur competition while enrolled as a full-time student.

Bylaws: Amend 14.5.4.1.1, pages 98-99, as follows:

"14.5.4.1.1 Two-Year Nonparticipation Exception. The student transfers to the certifying institution from a two-year college or from a branch school that conducts an intercollegiate athletics program and, for a consecutive two-year period immediately before the date on which the student begins participation (practice and/or competition), the student has neither practiced nor competed in the involved sport in intercollegiate competition, or and has neither practiced or competed in organized noncollegiate amateur competition while enrolled as a full-time student in a collegiate institution. This two-year period does not include any period of time prior to the student's initial collegiate enrollment."

No. 2 Playing and Practice Seasons -- Sports Subject to Segment Limitations

Intent: To specify that all team and individual sports for which the National Collegiate Championship in the only NCAA championships opportunity are limited to a playing and practice season of 21 weeks.

Bylaws: Amend 17.1.4, page 138, as follows:

"17.1.4 Sports Subject to Segment Limitations. Segment limitations are applicable to all team sports that are listed in under Bylaw 17.02.12.1 and all individual sports listed under Bylaw 17.02.12.2. In those sports for which the National Collegiate Championship is the only NCAA championships opportunity (see Bylaw 18.3), an institution's playing season shall be limited to the same length as Division I institutions, and this limitation shall be implied in all subsequent legislative references affecting the sport 21 weeks."

*No. 3 Championships -- Automatic-Qualification -- Principles

Intent: To amend the automatic qualification principles as specified.

Bylaws: Amend 31.3.4.1, pages 274-275, as follows:

"31.3.4.1 General Requirements. To be eligible for automatic qualification, a member conference must meet the following general requirements:

[31.3.4.1-(a) through 31.3.4.1-(g) unchanged.]

"(h) A conference that meets the automatic qualification requirements and is eligible to be selected to a championship via Pool A and/or Pool C may not elect instead to be selected via Pool B.

"(i) The method by which a conference determines its conference representative must be declared at the time of the automatic qualification declaration and must be objectively outlined."
