Following is a compilation of editorial revisions as recommended through the Division III legislative process. The revisions are not substantive in nature and are intended to clarify or simplify existing legislation.

The items marked with an asterisk have been approved by the Management Council and Presidents Council in concept, but have not yet been approved in legislative form. Other items have previously been approved in legislative form. The page number in the proposals refer to the 2000-01 NCAA Division III Manual.

Bold type indicates new wording; italicized type indicates wording removed.

*No. 1 NCAA Membership -- Provisional Membership

Intent: To indicate that provisional membership shall not be less than a four-year period.

A. Constitution: Amend 3.02.3.2, pages 7-8, as follows:

"3.02.3.2 Provisional Member. A provisional member is a four-year college or university or a two-year upper-level collegiate institution accredited by the appropriate regional accrediting agency and that has applied for active membership in the Association. Provisional membership is a prerequisite for active membership in the Association. The institution shall be elected to provisional membership under the provisions of this article (see Constitution 3.6.3). Provisional members shall receive all publications and mailings received by active members in addition to other privileges designated in the constitution and bylaws of the Association. Provisional membership is limited to a three-year period shall not be less than a four-year period."

B. Constitution: Amend 3.6.1.1.1, page 17, as follows:

"3.6.1.1.1 Four-Year Provision. Provisional membership shall be limited to a four-year period not be less than a four-year period. At the end of the four-year period, a provisional member shall be eligible to apply for active membership (see Constitution 3.2.3)."

C. Bylaws: Amend 20.02.3, page 223, as follows:

"20.02.3 Provisional Membership. Provisional membership is a prerequisite for active membership. It is limited to a four-year period shall not be less than a four-year period. During the third and fourth years of provisional membership, an institution shall administer its athletics programs in accordance with the constitution, bylaws and other legislation of the Association."

*No. 2 Certification of Eligibility

Intent: To specify that institutions are required to certify the eligibility of a student-athlete prior to permitting his or her participation in intercollegiate competition.

A. Constitution: Amend 3.2.4.3, page 10, as follows:

"3.2.4.3 Certification of Eligibility/Declaration of Ineligibility. The active member is responsible for certifying the eligibility of student-athletes under the terms of the constitution, bylaws or other legislation of the Association before permitting a student-athlete to represent the institution in intercollegiate competition. Procedures for eligibility certification shall be approved by the chief executive officer, who may designate an individual on the institution's staff to administer proper certification of eligibility. The institution shall be obligated immediately to apply all applicable rules and withhold ineligible student-athletes from all intercollegiate competition (see Bylaw 14.11). See Bylaw 14.12 for procedures regarding restoration of eligibility."

B. Bylaws: Amend 14.01.1, page 89, as follows:

"14.01.1 Institutional Responsibility. An institution shall not permit a student-athlete to represent it in intercollegiate athletics competition, unless the student-athlete meets all applicable eligibility requirements and the institution has certified the student-athlete's eligibility."

C. Bylaws: Amend 14.10.1, page 104, as follows:

"14.10.1 Institutional Responsibility for Eligibility Certification. The chief executive officer is responsible for approving the procedures for certifying the eligibility of an institution's student-athletes under NCAA legislation. The chief executive officer may designate an individual on the institution's staff to administer proper certification of eligibility. Certification of eligibility must occur before allowing a student-athlete to represent the institution in intercollegiate competition. See Bylaw 14.01.1."

No. 3 4-2-4 Transfer Requirements

Intent: To specify that rather than needing to successfully complete a two-year program, 4-2-4 transfer student-athletes must successfully complete at least 24 semester or 36 quarter hours of transferable degree credit and spend at least two semesters or three quarters of attendance at the two-year college.

Bylaws: Amend 14.5.1.1, page 99, as follows:

"14.5.1.1 Exception. A student who has not previously participated in intercollegiate athletics and who transfers from a two-year or four-year collegiate institution to a Division III institution shall be immediately eligible, under the Association's transfer regulations, to compete for the institution, including NCAA championship competition. If the student has ever participated in intercollegiate athletics, the student must have been academically and athletically eligible had he or she remained at that institution. Further, a student who has ever participated in intercollegiate athletics and transfers from a four-year institution to a two-year college, and then to the certifying institution, also must have been athletically and academically eligible had he or she remained at the previous four-year institution or must have successfully completed the two-year program at least 24 semester or 36 quarter hours of transferable degree credit and spent at least two semesters or three quarters of attendance at the two-year college."

No. 4 Playing and Practice Seasons -- Nontraditional Segments

Intent: To clarify that an institution that divides its practice and playing season into two distinct segments and conducts its nontraditional segment in the relevant fall must complete all practice and competition by October 30 of the relevant academic year; further, to clarify that a member institution that conducts its traditional segment in the fall may not begin practice or competition during its nontraditional segment until February 1 of the relevant academic year.

[Note: This proposal is drafted in a nontraditional format. Appropriate editorial revisions will be made in Bylaw 17 to reflect the adoption of this legislation.]

A. Bylaws: Amend 17._.2, pages 138-207, as follows:

"17._.2 Preseason Practice

[17._.2-(a) unchanged.]

"(b) Nontraditional Segment. For an institution that conducts its nontraditional segment in the fall, September 7 or the institution's first day of classes for the fall term, whichever is earlier. For an institution that conducts its nontraditional segment in the spring, February 1. (See Bylaw 17.1.9.2.)"

B. Bylaws: Amend 17._.4, pages 138-207, as follows:

"17._.4 End of Regular Season. A member institution shall conclude all practice and competition (meets and practice meets) in each segment in ____ by the following dates:

[17._4-(a) unchanged.]

"(b) Nontraditional Segment. For an institution that conducts its nontraditional segment in the fall, October 30 (see Bylaw 17.1.9.2). For an institution that conducts its nontraditional segment in the spring, Tthe first date of final examinations for the regular academic year at the institution."

No. 5 Playing and Practice Seasons -- Basketball -- Scrimmages

Intent: To clarify that an institution may conduct its two informal basketball scrimmages at any time between the first permissible date for on-court practice and the conclusion of the basketball season.

Bylaws: Amend 17.5.5.3, page 146, as follows:

"17.5.5.3 Annual Exemptions. The maximum number of basketball contests shall exclude the following:

[17.5.5.3-(a) through 17.5.5.3-(d) unchanged.]

"(e) Scrimmages. Two informal practice scrimmages with outside competition in basketball conducted between November 1 the first permissible date for on-court practice and the conclusion of the basketball season; and"

[17.5.5.3-(f) unchanged]
