Noncontroversial legislative proposals

The NCAA Division II Management Council and Presidents Council have determined, pursuant to NCAA Constitution 5.3.1.1.1, that the following proposals are noncontroversial and necessary to promote the normal and orderly administration of the Association's legislation. The Division II Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend the adoption of noncontroversial amendments, subject to ratification by the Division II Presidents Council.

Proposals that are ratified by the Presidents Council shall be effective as of the date identified in the proposal. Once ratified, the proposals will be published in The NCAA News and submitted by the Presidents Council as legislation at the 2002 NCAA Convention.

The items marked with an asterisk have been approved by the Management Council and Presidents Council in concept, but have not yet been approved in legislative form. Other items have previously been approved in legislative form. The page numbers in the proposals refer to the 2000-01 NCAA Division II Manual.

*No. 1 Loss of Active Membership -- Four-Sport/Three-Season Requirement

Intent: To revise the penalty for noncompliance with four-sport/three-season requirement.

Constitution: Amend 3.2.5.3, page 11, as follows:

"3.2.5.2 Failure to Meet Four-Sport/Three-Season Requirement. If an active member no longer institution fails to meets the four-sport/
three-season requirement for either men or women in an academic year it shall be placed in 'restricted membership' in all sports during the subsequent academic year. If the institution still cannot certify compliance with the four-sport/three-season requirement at the end of that year, it shall be reclassified immediately as a corresponding member."

*No. 2 Provisional Membership -- Self-Study and Annual Review

Intent: To modify the annual report deadline to a "postmark" date.

Constitution: Amend 3.6.4.2, page 17, as follows:

"3.6.4.2 Self-Study and Annual Review. During the first year of provisional membership, a provisional member shall complete a comprehensive institutional self-study and evaluation of the member's intercollegiate athletics program. A provisional member also shall provide, on an annual basis, a written report to be reviewed by the Membership Committee describing the institution's progress in meeting active membership requirements. The annual report shall be received in the national office postmarked not later than June 15 each year. The annual report shall be completed in accordance with the requirements set forth in the Division II Educational Assessment Program."

No. 3 Management Council and Student-Athlete Advisory Committee -- Composition

Intent: To specify that the current position on the Management Council and SAAC allocated for independent institutions be converted to an at-large position whenever the total number of independent institutions falls below six.

Bylaws: Amend 4.6, pages 24-25, as follows:

"4.6 Division II Management Council

"4.6.1 Composition. The Management Council shall be comprised of one administrator or representative from each of the Division II multisport voting conferences, one administrator or representative of Division II independent institutions provided there are at least six Division II independent institutions, and two 'at large' positions to enhance efforts to achieve diversity of representation. The members shall be representatives of Division II active member institutions. The members of the Council shall include:

"4.6.1.2 Independent Institutions. The position reserved for a representative of independent institutions may not be filled by an individual from the same independent institution in successive terms. B. Bylaws: Amend 21.6.6.8.1, page 294, as follows:

"21.6.6.8 Division II Student-Athlete Advisory Committee

"21.6.6.8.1 Composition. The Division II Student-Athlete Advisory Committee shall consist of one representative from each of the Division II multisport voting conferences, one representative of Division II independent institutions provided there are at least six Division II independent institutions, two at-large positions to enhance efforts to achieve diversity of representation and two members of the Division II Management Council. A student-athlete representative initially must be a full-time undergraduate or graduate student at a Division II institution, as defined by the regulations of the institution, and must be a student-athlete or a former student-athlete in a Division II sport. Each conference representative must be initially enrolled as an undergraduate or graduate student at a Division II institution in the applicable conference. The two Management Council members shall serve as ex officio, nonvoting members of the committee. A Division II conference may permit a representative to complete his or her term after the individual has left undergraduate or graduate school at a Division II institution in the conference, provided such service does not extend the individual's term, as set forth in the individual's original appointment.

"21.6.6.8.1.1 Position Allocated for Independent Institutions. If the total number of independent institutions falls below six, the position allocated for independent institutions shall become an at-large position as soon as the position becomes vacant."

*No. 4 Permissible Academic and Support Services -- Day Planners

Intent: To allow an institution to purchase commercially produced day planners for student-athletes at a cost not to exceed $7.

Bylaws: Amend 16.3.1, page ___, as follows:

"(i) Organized day planners that are nonelectronic, and, if are developed and produced by the institution (as opposed to being purchased commercially). commercially produced, do not exceed a cost of $7 per planner.

No. 5 Playing and Practice Seasons -- Indoor/Outdoor Track and Field -- Length of Playing Season

Intent: To clarify the length of the playing season for institutions sponsoring both indoor and outdoor track and field.

Bylaws: Amend 17.25.1, pages 241-242, as follows:

"(b) An institution that sponsors both indoor and outdoor track and field and participates in at least the minimum number of contests with at least the minimum number of participants required to count both sports in meeting division membership requirements is limited to a 156-day season for indoor and outdoor track and field combined, which may consist of two segments (each consisting of consecutive days) and which may exclude only required off days per Bylaw 17.1.6.4 and official vacation, holiday and final-examination periods during which no practice or competition shall occur.

*No. 6 Division II Championships -- Women's Rowing

Intent: To establish a Division II Women's Rowing Championship and committee.

A. Bylaws: Amend 18.3, pages 257-258, as follows:

"18.3 Current Championships. The Association will administer 84 national championships in 2000-01. Ten are National Collegiate Championships. Additionally, there are 25 Division I championships, 24 25 Division II championships and 25 Division III championships. (See Bylaw 31.02.2 for information about the classification and terminology of championships and see Constitution 5.3.10.1 and 5.3.10.2 for the voting requirements for the establishment of a new championship.) No. 7 Enforcement -- Penalties for Major Violations

Intent: To amend the penalty schedule related to major violations.

A. Bylaws: Amend 19.6.1, page 266, as follows:

"(d) An institutional fine for each violation, with the monetary penalty ranging in total from $500 to $5,000 except when an ineligible student-athlete participates in an NCAA championship or other post-season competition, in which case the $5000 limit shall not apply;

B. Bylaws: Amend 19.6.2.2, pages 267-268, as follows:

"19.6.2.2 Disciplinary Measures. In addition to those penalties prescribed for secondary violations, among the disciplinary measures, singly or in combination, that may be adopted by the committee (or the appropriate appeals committee per 19.3) and imposed against an institution for major violations are:

Intent: To permit student-athletes to serve as full members on specified Association-wide committees.

A. Bylaws: Amend 21.1.2, pages 238-284, as follows:

"21.1.2 Competitive Safeguards and Medical Aspects of Sports, Committee on

"21.1.2.1 Composition. The Committee on Competitive Safeguards and Medical Aspects of Sports shall consist of 16 19 members, including five positions allocated for men, five allocated for women and six unallocated. The membership of the committee shall be constituted as follows:

"21.1.5 Minority Opportunities and Interests Committee

"21.1.5.1 Composition. The Minority Opportunities and Interests Committee shall consist of 12 15 members. There shall be three members from Division II. One student-athlete from each division (who shall have one combined vote) shall serve as a member of the committee and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility. Committee membership shall include a minimum of eight ethnic minorities, including at least four males and four females.

"21.1.5.1.1 Student-Athlete Representation. One student-athlete from each division shall serve as members of the committee in an advisory capacity and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility."

C. Bylaws: Amend 21.1.7, pages 284-285, as follows:

"21.1.7 Olympic Sports Liaison Committee

"21.1.7.1 Composition. The Olympic Sports Liaison Committee shall consist of 11 14 members, including at least one from each division. One student-athlete from each division (who shall have one combined vote) shall serve as a member of the committee and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility.

"21.1.7.1.1 Student-Athlete Representation. One student-athlete from each division shall serve as a member of the committee in an advisory capacity and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility."

D. Bylaws: Amend 21.1.9, page 285, as follows:

"21.1.9 Research Committee

"21.1.9.1 Composition. The Research Committee shall consist of 10 13 members, including four representatives from Division I, two each from Divisions II and III and two unallocated. In addition, three positions shall be allocated for men, three allocated for women and four unallocated. The membership of the committee shall consist of at least three athletics administrators and at least three faculty athletics representatives with appropriate research experience. One student-athlete from each (who shall have one combined vote) shall serve as a member of the committee and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility.

"21.1.9.1.1 Student-Athlete Representation. One student-athlete from each division shall serve as a member of the committee in an advisory capacity and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility."

E. Bylaws: Amend 21.1.10, page 289, as follows:

"21.1.10 Sportsmanship and Ethical Conduct, Committee on

"21.1.10.1 Composition. The Committee on Sportsmanship and Ethical Conduct shall consist of eight 11 members. One student-athlete from each division (who shall have one combined vote) shall serve as a member of the committee and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility.

"21.1.10.1.1 Student-Athlete Representation. One student-athlete from each division shall serve as a member of the committee in an advisory capacity and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility."

Bylaws: Amend 21.2 by adding new 21.2.9, page 287, as follows:

*No. 11 Secretary-Rules Editors -- Term Limits

Intent: To establish a term limit of eight years for secretary-rules editors serving on sports rules committees.

A. Bylaw: Amend 21.2.1.1, page 286, as follows:

"21.2.1.1 Method of Selection. Each division's governance structure shall appoint members to serve on the rules committees without championships administration responsibilities, subject to the ratification of the Executive Committee. The Executive Committee also shall appoint the chair and secretary-rules editor of each committee. The secretary-rules editor may be reelected without restriction but is limited to a term not to exceed eight years in length and shall be a nonvoting member of the committee. The membership of each committee shall include representatives from each of the Association's membership divisions."

B. Bylaw: Amend 21.3.1.1, page 287, as follows:

"21.3.1.1 Method of Selection. Each division's governance structure shall appoint members to serve on the committees with playing rules and championships administration responsibilities, subject to the ratification of the Executive Committee. The Executive Committee also shall appoint the chair and secretary-rules editor of each committee. The secretary-rules editor may be reelected without restriction but is limited to a term not to exceed eight years in length and shall be a nonvoting member of the committee. The membership of each committee shall include representatives from each of the Association's membership divisions."

Committee -- Composition

Intent: To expand the Men's and Women's Ice Hockey Rules Committee to 13 members, as specified.

Bylaws: Amend 21.2.6, pages 286-287, as follows:

"21.2.6 Ice Hockey Rules Committee, Men's and Women's. The Men's and Women's Ice Hockey Rules Committee shall consist of eight 13 members and shall be constituted as follows:

"(a) Four Six members shall be from Division I, one member shall be from Division II, two four members shall be from Division III, one member shall be from Division II or III and an additional member shall be secretary-rules editor;"

*No. 13 Committees -- Men's and Women's Skiing Committee

Intent: To specify that the composition of the Men's and Women's Skiing Committee shall include two coaches who represent alpine skiing and two coaches who represent nordic skiing; further, to specify that the secretary-rules editor may be counted toward meeting this requirement.

Bylaws: Amend 21.3.5, page 288, as follows:

"21.3.5 Skiing Committee, Men's and Women's. The Men's and Women's Skiing Committee shall consist of seven members and shall be constituted as follows:

"(a) Two positions shall be allocated for men, two allocated for women and three unallocated; and

"(b) One member shall be selected from the West skiing region, two members shall be selected from the East skiing region, three members shall be selected at large and one member shall be secretary-rules editor. ;and

"(c) Two members shall be coaches who represent downhill alpine skiing and two members shall coaches who represent nordic skiing. The secretary rules editor may be counted towards satisfying this requirement."

*No. 14 Committees -- Core-Course Review Committee

Intent: To reduce the size of the Core-Course Committee from 18 to 15 members, as specified; further, to specify that the academic subcommittees shall consist of three members each, including two representatives from member institutions and one high-school representative.

Bylaws: Amend 21.5.4, pages 289-290, as follows:

"21.5.4 NCAA Core-Course Review Committee

"(a) The committee shall consist of 18 15 members who comprise subcommittees in the various academic disciplines as follows:

"(1) English-Four Three members;

"(2) Mathematics-Four Three members;

"(3) Natural/Physical Science-Four Three members;

"(4) Social Studies-Four Three members; and

"(5) Additional Academic Courses-Two members

"(b) The committee shall include five high-school representatives and 10 institutional representatives, with not less than four members be from either Division I or Division II;

"(c) Each subcommittee shall include two representatives from member institutions and one high-school representative;"

Term Limits

Intent: To specify that the term limits of the Foreign Student Records Committee members shall be three-year renewable terms.

Bylaws: Amend 21.5.5 by adding new 21.5.5.3, page 290, as follow:

"21.5.5 NCAA Foreign-Student Records Committee

[21.5.5.1 and 21.5.5.2 unchanged.]

"21.5.5.3 Terms. Committee members shall be appointed for one three year term. Members may be appointed to an additional term(s) on the committee after three years have elapsed. An individual who has served three consecutive terms on the committee may not serve further on that committee."

*No. 16 Committees -- "On-the-Staff Requirement" -- Secretary-Rules Editors

Intent: To exempt secretary rules-editors serving on sports rules committees from the "on the staff" requirement in order to be eligible for committee service.

Bylaw: Amend 21.6.1.1 by adding new 21.6.1.1.4, page 290, as follows:

"21.6.1.1.4 Secretary-Rules Editors. Individuals serving as secretary rules-editors on sports rules committee are not subject to the "on the staff" requirement set forth in Bylaw 21.6.1.1."

*No. 17 Sports Committees with only Division II Championships Administration Responsibilities -- Selection, Composition and Duties

Intent: To specify that if a member of a sports committee accepts a position that results in him/her moving to another region other than the one he/she was originally appointed to represent, that committee member shall not automatically represent the new region.

Bylaws: Amend 21.6.7.1.1 by adding new 21.6.7.1.1.3, page 295, as follows:

"21.6.7.1.1 Method of Selection. The members of each Division II sports committee and the Division II representatives on Association-wide and common rules committees shall be nominated by the Division II Nominating Committee and shall be selected by the Division II Championships Committee, subject to ratification by the Division II Management Council.

Intent: To eliminate all regulations related to the telecasting, cablecasting or televising of intercollegiate football games of member institutions.

A. Constitution: Amend 5.3.10.3, page 40, as follows:

"5.3.10.3 Football Television Plan. Only members that sponsor varsity intercollegiate football shall be permitted to vote on adoption of NCAA football television plans and on amendments to Bylaw 22 governing those plans."

B. Bylaws: Amend 22, page 297, as follows:

"22 Football Television Plans and Regulations

"22.01 General Principle. The telecasting, cablecasting or otherwise televising of intercollegiate football games of member institutions may be subject to the provisions enacted by the Association.

"22.02 Definitions and Applications

"22.02.1 National Telecast or Cablecast. A national telecast or cablecast is a release on a single date of a live game or games telecast or cablecast by a single television network, syndicator or programming entity into markets containing at least 20 million homes in at least 30 states, or containing at least 50 percent of the USA television homes as reported by the annual edition of Television and Cable Factbook (and all updates thereto issued prior to August 1 of the year in which the game or games are played).

"22.1 Football Television Plans. The telecasting, cablecasting or otherwise televising of member institutions' intercollegiate football games during the regular football season may be conducted pursuant to voluntary television plans for one or more of the divisions (i.e., Divisions I, II and III). Such plans may be prepared from time to time by the Management Council and approved by majority vote of those voting in the respective divisions (see Bylaw 22.1.1).

"22.1.1 Division Control. Each division shall determine its own procedure for the formulation and adoption of any television plan. Majority approval is required within each division before a plan may be adopted by that division. The majority approval of a Division I plan shall require a majority vote of Division I-A representatives on the Board of Directors present and voting as well as a majority of Division I-A and Division I-AA representatives on the Board of Directors present and voting together. The members of a division may approve such a plan by mail referendum (see Constitution 5.3.11.3).

"22.2 Football Telecast/Cablecast Regulations. Regardless of whether a division adopts a football television plan for a particular season, all forms of telecasting, cablecasting or otherwise televising of the intercollegiate football games of member institutions during the regular football season shall be governed by the following:

"22.2.1 Simultaneous Telecast/Cablecast of Friday Night Games. There shall be no simultaneous telecasting or cablecasting of regular-season intercollegiate football games on Friday nights. Any afternoon football telecast or cablecast on Friday must be completed by 7 p.m. local time in each location in which the program is received.

"22.2.2 Mutual Consent for Telecast/Cablecast of Games. A member institution shall not be obligated to telecast or cablecast any of its intercollegiate football games, home or away. A member institution may not make any commitment for the simultaneous or delayed telecasting or cablecasting of any game without the prior written consent of its opponent institution.

"22.2.3 Assessment against National Telecast
/Cablecast Gross Rights Fee. The gross rights fee paid to each member institution for a national telecast or cablecast of an intercollegiate football game shall be subject to an assessment of four percent, paid by the home institution to the NCAA to fund the costs of the NCAA postgraduate scholarship program and football-related services performed by the NCAA.

"22.2.3.1 Waiver. The Executive Committee shall have the authority to waive this assessment on an annual basis."
