Below is a compilation of editorial revisions as recommended through the Division II legislative process. The revisions are not substantive in nature and are intended to clarify or simplify existing legislation.

The items marked with an asterisk have been approved by the Management Council and Presidents Council in concept, but have not yet been approved in legislative form. Other items have previously been approved in legislative form. The page number in the proposals refers to the 2000-01 NCAA Division II Manual.

Bold type indicates new wording; italicized type indicates wording removed.

*No. 1 Financial Aid -- Multisport Participants

Intent: To clarify that counting financial aid for multisport participants applies to all sports in which a student participates.

Bylaws: Amend 15.5.3, page ___, as follows:

"15.5.3 Multiple-Sport Participants. A counter who participates in two or more sports shall be counted in one or both more sports as specified on the individuals financial aid agreement."

*No. 2 Awards and Benefits -- Principle of Restitution

Intent: To establish a general principle of restitution for all Bylaw 16 provisions.

A. Bylaws: Amend 16.01.1 by adding new 16.01.1.1, page 159, as follows:

"16.01.1.1 Restitution for Receipt of Impermissible Benefits. For violation of Bylaw 16 in which the value of the benefit is $50 or less, the eligibility of the student-athlete shall not be affected conditioned upon the student-athlete repaying the of the benefit to a charity of his or her choice. The student-athlete, however, shall remain ineligible from the time the institution has knowledge of receipt of the impermissible benefit until the student-athlete repays the benefit. Violations of the bylaw remain institutional violations per Constitution 2.8.1, and documentation of the student-athlete's repayment shall be forwarded to the enforcement staff."

B. Bylaws: Amend 16.1.8, page __, as follows:

[This proposal is presented in a nontraditional format. Appropriate editorial revisions will be made throughout Bylaw 16 to reflect the adoption of this legislation.]

"16.1.8 Eligibility Ramifications -- Restitution for Receipt of Improper Benefits. No. 3 Playing and Practice Seasons -- Tryouts -- Enrolled Student

Intent: To clarify permissible tryout activities for enrolled students.

Bylaws: Amend 17.02.12, pages 181-182, as follows:

[17.02.12-(a) through 17.02.12-(e) unchanged.]

"(f) Competition against the member institution's team is permissible, provided such competition occurs during the academic year and is considered a countable athletically related activity per Bylaw 17.02.1.1;"

[17.02.12-(f) through 17.02.12-(g) relettered as 17.02.12-(g) through 17.02.12-(h) unchanged.]

*No. 4 Committee on Infractions -- Vice-Chair

Intent: To permit the Committee on Infractions to designate internally a vice-chair, who will act on behalf of the chair in his or her absence.

A. Bylaws: Amend 19.1.1, page 264, as follows:

"19.1.1 Composition of Committee. The committee shall be composed of nine members, seven of whom shall be at present or previously on the staff of an active member institution or member conference of the Association, two of whom shall be from the general public and shall not be associated with a collegiate institution, conference, or professional or similar sports organization, or represent coaches or athletes in any capacity. One of the members shall serve as chair and one member shall serve as vice-chair. One nonpublic member shall be elected as the coordinator of appeals. Two positions shall be allocated for men, two allocated for women and five unallocated."

B. Bylaws: Amend 19.1.2.2, page 264, as follows:

"19.1.2.2 Authority of Committee Chair. In the interim between meetings of the committee, the chair shall be empowered to act on behalf of the committee, subject to committee approval at its next meeting. If at any time, at a meeting or between meetings, the chair is unavailable to act as such, the member of the committee longest in service who is available vice-chair is empowered to exercise the functions of the chair."
