Modification of wording

Pursuant to NCAA Constitution 5.4.1.1.1, the Division I Management Council has determined that the following proposal is consistent with the intent of the membership in adopting the original legislation and that sufficient documentation and testimonies exist to establish clearly that the original wording of the legislation was inconsistent with that intent.

The Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend intent-based legislation, subject to ratification by the NCAA Division I Board of Directors. Any proposal ratified by the Board shall be effective as of the date identified in the proposal and published in The NCAA News.

Those items that the Management Council has yet to review in legislative form are marked with an asterisk (*). Bold type indicates new wording; italicized type indicates wording removed.

*No. 1 Eligibility -- "4-2-4" College Transfers -- Basketball

Intent: In basketball, to specify that a student who is a "4-2-4" midyear transfer shall not be eligible for intercollegiate competition until the ensuing academic year.

Bylaws: Amend 14.5.6 by adding new 14.5.6.2, pages 160-161, as follows:

"14.5.6.2 Basketball -- Midyear Enrollee. In the sport of basketball, a student who satisfies the provisions of Bylaw 14.5.6, but initially enrolls as a full-time student subsequent to the conclusion of the institution's first term of the academic year, shall not be eligible for competition until the ensuing academic year."

[14.5.6.2 and 14.5.6.3 renumbered as 14.5.6.3 and 14.5.6.4, unchanged.]

*No. 2 Financial Aid -- Employee Dependent Tuition Waivers

Intent: To specify that employee-dependent tuition waivers granted to a student-athlete whose parent is employed by the certifying institution shall not be considered institutional financial aid, provided the parent has been employed as a full-time faculty or staff member at the certifying institution for a minimum of five years.

Bylaws: Amend 15.02.4.1, page 176, as follows:

"15.02.4.1 Institutional Financial Aid. The following sources of financial aid are considered to be institutional financial aid:

"(a) All funds administered by the institution, which include but are not limited to the following:

[15.02.4.1-(a)-(1) through 15.02.4.1-(a)-(3) unchanged.]

"(4) Employee dependent tuition benefits, unless the parent of a student-athlete has been employed as a full-time faculty/staff member for a minimum of five years prior to the student-athlete's initial full-time enrollment;"

[15.02.4.1-(a)-(5) through 15.02.4.1-(a)-(8) unchanged.]

[Remainder of 15.02.4.1 unchanged.]
