Noncontroversial legislative proposals

The NCAA Division II Management Council and Presidents Council have determined, pursuant to NCAA Constitution 5.3.1.1.1, that the following proposals are noncontroversial and necessary to promote the normal and orderly administration of the Association's legislation. The Division II Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend the adoption of noncontroversial amendments, subject to ratification by the Division II Presidents Council.

Proposals that are ratified by the Presidents Council shall be effective as of the date identified in the proposal. Once ratified, the proposals will be published in The NCAA News and submitted by the Presidents Council as legislation at the 2001 NCAA Convention. The items marked with an asterisk have been approved by the Management Council and Presidents Council in concept, but have not yet been approved in legislative form. Other items have previously been approved in legislative form. The page number in the proposals refer to the 1999-00 NCAA Division II Manual. Bold type indicates new wording; italicized type indicates wording removed.

*No. 1 Membership Moratorium

Intent: To establish a moratorium on the election of new provisional members in Division II and a moratorium on reclassification from Division I or III.

A. Bylaws: Amend 3.1 by adding new 3.1.3, page 8, as follows:

"3.1 Eligibility for Membership

[3.1.1 and 3.1.2 unchanged]

"3.1.3 Membership Moratorium. An institution shall not be elected to begin provisional membership in Division II on or after September 1, 2000. The moratorium shall be in effect until September 1, 2002."

B. Bylaws: Amend 20.5.1 by adding new 20.5.1.1, page 302, as follows:

"20.5.1 Reclassification Options. A member institution may request a change of division membership according to the provisions of this section. A member of Division I or Division III may petition to change its membership to Division II, and a member of Division II may petition to change its membership to either Division I or Division III.

"20.5.1.1 Membership Moratorium. A member institution may not request a change of division membership during the 2000-2001 and 2001-2002 academic years. The moratorium on reclassification shall be in effect until September 1, 2002."

*No. 2 NCAA Membership -- Affiliated Memberships and Corresponding Membership Applications

Intent: To specify that the Association's president has the authority to approve NCAA affiliated and corresponding membership applications.

A. Constitution: Amend 3.4.3, page 15, as follows:

"3.4.3 Election Procedures

"3.4.3.3 Election. Groups or associations may be elected to granted affiliated membership by majority vote of the delegates present and voting at an annual Convention or by majority vote of the Executive Committee the Association's president."

B. Constitution: Amend 3.5.3, page 16, as follows:

"3.5.3 Election Procedures

*No. 3 NCAA Organization -- Geographical
districts

Intent: To eliminate the reference to geographical districts in the applicable NCAA legislation.

Constitution: Amend 4.12, page 27, as follows:

"4.12 Geographical Districts and Regions

"4.12.1 Districts. The Association shall be divided into eight geographical districts to facilitate its work. They are as follows:

"(a) District 1 -- Connecticut, Maine, Massachusetts, New Hampshire, Rhode Island, Vermont;

"(b) District 2 -- Delaware, New Jersey, New York, Pennsylvania, Puerto Rico, West Virginia;

"(c) District 3 -- Alabama, District of Columbia, Florida, Georgia, Kentucky, Louisiana, Maryland, Mississippi, North Carolina, South Carolina, Tennessee, Virginia;

"(d) District 4 -- Illinois, Indiana, Michigan, Minnesota, Ohio, Wisconsin;

"(e) District 5 -- Iowa, Kansas, Missouri, Nebraska, North Dakota, Oklahoma, South Dakota;

"(f) District 6 -- Arkansas, New Mexico, Texas;

"(g) District 7 -- Arizona, Colorado, Idaho, Montana, Utah, Wyoming; and

"(h) District 8 -- Alaska, California, Hawaii, Nevada, Oregon, Washington.

"4.12.1.1 District Transfers. Active member institutions may be transferred from their regular geographical districts by majority vote of the Association's Executive Committee. An annual listing of the geographical transfers of active members shall appear in the NCAA Directory."

*No. 4 Amateurism -- Operation Gold Grants

Intent: To permit prospective and currently enrolled student-athletes to accept Operation Gold Grant Funds based on place finish at the 2000 Olympic Games.

A. Bylaws: Amend 12.1.1.1.4.1 by adding a new 12.1.1.1.4.1.1, page 60, as follows:

"12.1.1.1.4.1.1 Exception -- Operation Gold Grant. An individual (prospective student-athlete or student-athlete) may accept funds that are administered by the United States Olympic Committee pursuant to its Operation Gold Program based on the individual's participation in the 2000 Olympic games."

B. Bylaws: Amend 12.1.1.1.4.3 by adding a new 12.1.1.1.4.3.1, page 60, as follows:

"12.1.1.1.4.1.1 Exception -- Operation Gold Grant. An individual (prospective student-athlete or student-athlete) may accept funds that are administered by the United States Olympic Committee pursuant to its Operation Gold Program based on the individual's participation in the 2000 Olympic games."

C. Bylaws: Amend 12.1.1.1.5 by adding a new 12.1.1.1.5.1, page 60, as follows:

No. 5 Amateurism -- Exception for Commemorative Items

Intent: To permit student-athletes with eligibility remaining to receive commemorative items incidental to participation in the Olympic Games, World University Games, Pan American Games, World Championships and World Cup events.

Bylaws: Amend 12.1.1.4 by adding a new 12.1.1.4.11, pages 61-62, as follows:

"12.1.1.4.11 Commemorative Items for Student-Athletes Participating in Olympic Games, World University Games, Pan American Games, World Championships and World Cup events. It is permissible for student-athletes with eligibility remaining to receive commemorative items incidental to participation in the Olympic Games, World University Games, Pan American Games, World Championships and World Cup events through the applicable national governing body. These benefits may include any and all apparel, leisure wear, foot wear and other items that are provided to all athletes participating in the applicable event."

*No. 6 Awards -- Olympic Games

Intent: To permit a student-athlete to receive nonmonetary awards associated with participation in the Olympic Games at anytime, regardless of whether the student is enrolled as a regular student at the time of the Olympic Games.

Bylaws: Amend 16.1.1 by adding new 16.1.1.5, page 174, as follows:

"16.1.1.5 Olympic Games. It is permissible for a student-athlete to receive a nonmonetary award associated with participation in the Olympic games at any time regardless of when the Games are held or whether the student-athlete is enrolled as a regular student during the academic year."

*No. 7 Permissible Benefits -- Olympic Games

Intent: To permit family members of student-athletes participating in the Olympic Games to receive nonmonetary benefits provided to all family members of Olympians.

Bylaws: Amend 16.6.1.5, page 181, as follows:

"16.6.1.5 Family Travel to Olympic Games. A commercial company (other than a professional sports organization) or members of the local community may provide actual and necessary expenses for a student-athlete's spouse, parents, legal guardians or other relatives to attend the Olympic Games in which the student-athlete will participate. In addition, family members of student-athletes may receive nonmonetary benefits provided to the family members of all Olympic team members in conjunction with participation in the Olympic games."

Intent: To permit an institution to provide its student-athletes with reasonable refreshments in conjunction with student-athlete educational and business meetings.

*No. 9 Playing and Practice Seasons -- Basketball -- First Contest

Intent: To permit basketball exhibition contests against Division I and III institutions to be played on or after November 1.

Bylaws: Amend 17.5.3, page 210, as follows:

"17.5.3 First Contest. A member institution shall not play its first contest (game or scrimmage) with outside competition in basketball prior to the following dates, except as provided under 17.5.3.1:

"(1) NCAA Division I or III member institution(s). An exhibition contest against a Division I or III institution exempted per 17.5.5.2-(h) may be played on or after November 1."

*No. 10 Playing and Practice Seasons -- Gymnastics

Intent: To establish the end of the regular playing season in gymnastics as the conclusion of the USA Gymnastics or National College Gymnastics Association (NCGA) Collegiate Gymnastics Championship, whichever is later.

Bylaws: Amend 17.12.4, page 231, as follows:

"17.12.4 End of Regular Playing Season. A member institution shall conclude all practice and competition (meets and practice meets) in the sport of gymnastics by the conclusion of the National Collegiate Gymnastics Championships USA Gymnastics or National College Gymnastics Association (NCGA) Collegiate Gymnastics Championships, whichever is later."

Annual Exemptions -- Gymnastics

Intent: To specify that an institution may exempt one season-ending gymnastics tournament, which may include the NCAA Championship, the USA Collegiate National Championship, the National College Gymnastics Association Collegiate Gymnastics Championship or the Women's Gymnastics National Invitational Tournament.

Bylaws: Amend 17.12.5.2, page 231, as follows:

"17.12.5.2 Annual Exemptions. The maximum number of dates of competition in the sport of gymnastics shall exclude the following (see Figure 17-15):

"(a) Season-Ending Tournaments

"(1) NCAA Championship. Competition in the NCAA gymnastics championships; Competition in one season-ending gymnastics meet (i.e., NCAA Championship, the USA Collegiate National Championship, the National College Gymnastics Association Collegiate Gymnastics Championship or the Women's Gymnastics National Invitational Tournament) after the end of the regular season between teams that are not identified until the close of that regular season."

No. 12 Division II Championships -- Women's Lacrosse

Intent: To establish a Division II Women's Lacrosse Championship, effective with the 2001 championship.

A. Bylaws: Amend 18.3, pages 323-324, as follows:

"18.3 Current Championships

The Association will administer 82 national championships in 2000-01. Nine Eight are National Collegiate Championships. Additionally, there are 24 Division I championships, 23 24 Division II championships and 24 Division III championships. (See 31.02.2 for information about the classification and terminology of championships and see 5.3.11.1 and 5.3.11.2 for the voting requirements for the establishment of a new championship.) Intent: To clarify the reinstatement conditions for a student-athlete, rendered ineligible through a positive drug test, who later transfers and competes at non-NCAA institutions.

Bylaws: Amend 18.4.1.5.1, page 283, as follows:

"18.4.1.5.1 Duration of Ineligibility. A student-athlete who tests positive (in accordance with the testing methods authorized by the Executive Committee) shall be charged with the loss of a minimum of one season of competition in all sports if the season of competition has not yet begun for that student-athlete or a minimum of the equivalent of one full season of competition in all sports if the student-athlete tests positive during his or her season of competition (i.e., the remainder of contests in the current season and contests in the subsequent season up to the period of time in which the student-athlete was declared ineligible during the previous year). The student-athlete shall remain ineligible for all regular-season and postseason competition during the time period ending one calendar year (i.e., 365 days) after the student-athlete's positive drug test, and until the student-athlete retests negative (in accordance with the testing methods authorized by the Executive Committee) and the student-athlete's eligibility is restored by the Eligibility Subcommittee Student-Athlete Reinstatement Committee. If the student-athlete immediately transfers to a non-NCAA institution while ineligible and competes in collegiate competition within the 365-day period at a non-NCAA institution, the student-athlete will be ineligible for all NCAA regular season and postseason competition until the student-athlete does not compete in collegiate competition for a 365-day period. Furthermore, the student-athlete must retest negative (in accordance with the testing methods authorized by the Executive Committee) and the student-athlete's eligibility must be restored by the Student-Athlete Reinstatement Committee. If the student-athlete transfers to another NCAA institution while ineligible, the institution from which the student-athlete transferred must notify the institution that the student-athlete is ineligible. If the student-athlete tests positive a second time for the use of any drug, other than a "street drug" as defined in 31.2.3.1, he or she shall lose all remaining regular-season and postseason eligibility in all sports. If the student-athlete tests positive for the use of a "street drug" after being restored to eligibility, he or she shall be charged with the loss of a minimum of one additional season of competition in all sports and also shall remain ineligible for regular-season and postseason competition at least through the next calendar year. In addition, a student-athlete who has previously tested positive for performance-enhancing drugs as a result of a drug test administered by any other athletics organization and subsequently tests positive (in accordance with the testing methods authorized by the Executive Committee) shall be subject to these ineligibility provisions."

Intent: To specify that the position allocated for secondary interests be filled by the National Federation of State High School Association's (NFSHSA) staff liaison to the Sports Medicine Advisory Board.

National Youth Sports Program Committee

Intent: To expand the National Youth Sports Program Committee from five to nine members, as specified.

Bylaws: Amend 21.1.6.1, page 312, as follows:

"21.1.6.1 Composition. The National Youth Sports Program Committee shall consist of five nine representatives from active member institutions or conferences of the Association, including two positions allocated for men, two allocated for women and one five unallocated, and an appropriate number of ex officio members representing the federal government. The representatives, with the exception of the Division III Management Council representative, shall have recent experience in the administration of a National Youth Sports Program. The membership of the committee shall be constituted as follows:

"(a) Five members from Division I, with at least one member each from Division I-A, Division I-AA, and Division I-AAA. The remaining two members shall be at-large representatives. It is preferred that all Division I representatives represent an institution that hosts a National Youth Sports Program or have three years prior experience working with the National Youth Sports Program; and

"(b) Two members from Division II and two members from Division III. One member from each division being appointed shall be a member of the Management Council. The other member representing each division shall be appointed at-large and represent an institution that hosts a National Youth Sports Program or have three years prior experience working with the National Youth Sports Program."

*No. 17 Committees -- Men's and Women's Ice Hockey Rules Committee

Intent: To establish a men's and women's ice hockey rules committee, as specified.

"(a) Four members shall be from Division I, one member shall be from Division II, two members shall be from Division III and an additional member shall be secretary-rules editor,; and

"(b) Within Divisions I and III, one half of the members shall represent men's ice hockey interests and one-half of the members shall represent women's ice hockey interests; and

"(bc) One member shall be elected chair."

Intent: To revise the composition of the women's ice hockey committee as specified.

Intent: To establish the composition of the women's water polo committee as specified.

Bylaws: Amend 21.3.9, page 317, as follows:

"21.3.9 Water Polo Committee, Women's. The Women's Water Polo Committee shall consist of six members, including the secretary rules editor. There shall be three members from Division I, one member from Division II, one member from Division III and one member shall be selected at large."

No. 20 Student-Athlete Reinstatement Committee -- Term of Office -- Division II

Intent: To specify the term of office for members of the Student-Athlete Reinstatement Committee, is now four years instead of three years with a reappointment option.

Bylaws: Amend Bylaw 21.7.6.4.1, by adding new 21.7.6.4.1.1, page 321, as follows:

"21.7.6.4.1.1 Term of Office. Members of the Student-Athlete Reinstatement Committee shall be elected for one three-year term. An individual may be immediately reelected to a second three-year term."

No. 21 Committee Composition -- Student-Athlete Advisory Committee -- Division II

Intent: To allow a student-athlete, upon approval from his or her conference, to complete a term of service after the individual has left the institution.

Bylaws: Amend 21.7.6.8.1, page 322-323, as follows:

"21.7.6.8.1 Composition. The Division II Student-Athlete Advisory Committee shall consist of one representative from each of the Division II multisport voting conferences, one representative of Division II independent institutions, two at-large positions to enhance efforts to achieve diversity of representation and two members of the Division II Management Council. A student-athlete representative initially must be a full-time undergraduate or graduate student at a Division II institution, as defined by the regulations of the institution, and must be a student-athlete or a former student-athlete in a Division II sport. Each conference representative must initially be enrolled as an undergraduate or graduate student at a Division II institution in the applicable conference. The two Management Council members shall serve as ex officio, nonvoting members of the committee. A Division II conference may permit a representative to complete his or her term after the individual has left undergraduate or graduate school at a Division II institution in the conference, provided such service does not extend the individual's term, as set forth in the individual's original appointment."
