State legislation relating to intercollegiate athletics

This report summarizes legislation currently pending before state legislatures that could affect or is of interest to staff members of intercollegiate athletics programs and student-athletes. Set forth below is a list of four bills from three states. The report includes two bills that have been recently introduced and two pending bills where legislative action has occurred since the publication of the April 24, 2000, NCAA News. Newly introduced bills are marked with an asterisk (*).

The State Legislation Report is based largely on data provided by the Information for Public Affairs online state legislation system as of April 21, 2000. The bills selected for inclusion in this report were drawn from a larger pool of measures that concern sports and, therefore, do not necessarily represent all of the bills that would be of interest to individual member institutions. Bills pending before the governing bodies of the District of Columbia and U.S. territories are not available on an online basis and are not included in this report.

Two bills have become law since the last report. In Arizona, legislation was enacted that amends existing law to prohibit the State Lottery Commission from establishing a lottery based on the results of any sporting event. In Florida, the governor signed legislation that makes changes to the law related to student academic standards for participation in interscholastic extracurricular activities.

Arizona H 2381 (Author: Gardner)

Gambling/sports lottery. Amends existing law to prohibit the State Lottery Commission from establishing a lottery based on the results of any sporting event. Establishes a minimum age of 21 years old for purchasing a lottery ticket, effective in 2003.

Status: 1/10/2000 introduced. 2/29/2000 passed as amended by House. 4/6/2000 passed as amended by Senate. 4/10/2000 to Conference Committee. 4/12/2000 Conference Committee Report adopted by Senate. 4/13/2000 Conference Committee report adopted by House. 4/19/2000 signed by governor.

Florida S 92 (Author: Sullivan)

High-school extracurricular/academic standards. Amends existing law related to student academic standards for participation in interscholastic extracurricular activities. Requires a minimum grade-point average of 2.000 in the previous semester or a cumulative grade-point average of 2.000 in certain specified courses in order to participate in extracurricular activities. Establishes an academic-performance contract between the student, the school district, the appropriate governing association and the student's parents or guardian, if the student's cumulative grade-point average falls below 2.000 in certain specified courses. States that the academic-performance contract must require that the student attend summer school between grades 9 and 10 or grades 10 and 11, as necessary.

*New York A 5511 / S 7448 (Authors: DiNapoli/LaValle)

Athletics facilities/golf courses. Requires the operator of any golf course upon which any pesticide has been applied to post, in a conspicuous place, signs that state the date of application and the trade name of any pesticides applied. Establishes that the signs must be posted on the first and 10th tees and where greens fees are paid. Provides for the posting of signs for three days from the time the pesticide is applied.

Status: A 5511: 2/25/2000 introduced. S 7448: 4/14/2000 introduced. Referred to Senate Committee on Environmental Conservation.
