Modification of wording

Division II

The NCAA Division II Management Council, pursuant to its authority per NCAA Constitution 5.4.1.1.1, has determined that the following proposals are consistent with the intent of the membership in adopting the original legislation and that sufficient documentation and testimony exists to establish clearly that the original wording of the legislation was inconsistent with that intent. The Division II Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend intent-based legislation, subject to ratification by the Division II Presidents Council. Any proposal ratified by the Presidents Council shall be effective as of the date identified in the proposal, published in The NCAA News and submitted by the Presidents Council as legislation at the 1999 NCAA Convention. Those items the Management Council has not yet reviewed in legislative form are marked with an asterisk (*).

Legislative citations and governing bodies are reflected as they now appear in the 1998-99 Division II NCAA Manual. Further, inasmuch as a federated provision may be amended separately by each division, all federated proposals will be reflected as a division-only voting line.

NO. 1 MEMBERSHIP -- RECLASSIFICATION

Intent: To indicate that an institution reclassifying from Division II to Division I is not eligible to receive NCAA Division II Enhancement Fund proceeds.

Bylaws: Amend 20.5.3.1, page 293, as follows:

"20.5.3.1 Reclassification from Division II to Division I. A member of Division II that has forwarded to the national office written notice of its intention to change its membership classification to Division I per 20.5.2.1 or that has petitioned to reclassify to Division I per 20.5.2.1.1 no longer shall be eligible to participate in any subsequent Division II NCAA championship and shall no longer be eligible to receive Division II Enhancement Fund proceeds."

NO. 2 STUDENT-ATHLETE ADVISORY COMMITTEE -- COMPOSITION -- DIVISION II

Intent: To indicate that a conference representative on the Division II Student-Athlete Advisory Committee must be enrolled as an undergraduate or graduate student at a Division II institution in the conference.

Bylaws: Amend 21.7.6.8.1, page 310, as follows:

"21.7.6.8.1 Composition. The Division II Student-Athlete Advisory Committee shall consist of one representative from each of the Division II multisport voting conferences, one representative of Division II independent institutions, two at-large positions to enhance efforts to achieve diversity of representation and two members of the Division II Management Council. A student-athlete representative must be a full-time undergraduate or graduate student at a Division II institution, as defined by the regulations of the institution, and must be a student-athlete or a former student-athlete in a Division II sport. Each conference representative must be enrolled as an undergraduate or graduate student at a Division II institution in the applicable conference. The two Management Council members shall serve as ex officio, nonvoting members of the committee."
