Noninstitutional publications

NCAA Divisions I and II institutions should note that during its January 10-11, 1997, meeting, the Council agreed to modify a November 10, 1994, NCAA Interpretations Committee minute to clarify that the prohibition against financially subsidizing a noninstitutional publication does not preclude an institution from purchasing subscriptions to give to members of its athletics booster club or organization. Accordingly, this interpretation now should read as follows:

a. A noninstitutional publication dedicated primarily to reporting on an institution's athletics program that contributes a percentage of subscription sales to an institution's athletics program or makes a flat-rate donation to the institution's athletics program is not, per se, considered to be an institutional publication for purposes of applying NCAA regulations.

b. A noninstitutional publication dedicated primarily to reporting on an institution's athletics program that makes any financial donations to an institution's athletics program is considered to be an athletics representative of the institution and is subject to applicable NCAA recruiting regulations in that area.

c. An institution may not, in any manner, financially subsidize a noninstitutional publication that reports on its athletics program without causing the publication to be considered an institutional athletics publication. Please note that the prohibition against financially subsidizing a noninstitutional publication does not preclude an institution from purchasing subscriptions to give to members of its booster club or organization.

1997 NCAA Convention Proposal No. 141 --
Resolution: First date of competition

NCAA Division III institutions should note that during its January 15, 1997, post-Convention meeting, the Council used its authority per NCAA Constitution 5.3.1.1.1 to adopt noncontroversial legislation pursuant to Proposal No. 141.

Effective immediately, amend the following bylaws to add the word "Friday" to the reference to Saturday and Sunday as the permissible first contest date preceding September 1, when September 1 falls on Monday for the following sports:

  • Bylaw 17.8.3.1-(b) (cross country)

  • Bylaw 17.10.3.1-(b) (field hockey)

  • Bylaw 17.12.3.1.1 (golf, when the traditional segment is in the fall pursuant to Bylaw 17.1.10.5)

  • Bylaw 17.18.3.1-(b) (soccer)

  • Bylaw 17.24.3.1.1 (tennis, when the traditional segment is in the fall pursuant to Bylaw 17.1.10.5)

  • Bylaw 17.26.3.1-(b) (women's volleyball)

    September 1 falls on a Monday in 1997. Accordingly, the first permissible contest date or date of competition (excluding exhibition scrimmages) in 1997 in the sports referenced above is Friday, August 29.
