Division I membership to vote on basketball recruiting legislation

The Division I Board of Directors maintained its adoption of legislation preventing men’s basketball coaches from attending nonscholastic events in April. The legislation now goes to a vote of the Division I membership at the 2009 Convention in Washington, D.C.

In upholding its decision to adopt the legislation, the Board stayed consistent in its commitment to the academic success of student-athletes and prospective student-athletes and also followed the recommendation of the newly created Leadership Council. Supporters of the override point to financial concerns for programs that used the nonscholastic events as a “one-stop shop” for recruiting. The legislation took effect August 1.

The override vote will take place at the end of the Division I Legislative Forum at Convention. For a successful override, a five-eighths majority of those Division I delegates present and voting must cast votes to overturn the legislation.

The Board also approved in principle the appeals process for the harshest penalties contained in the Academic Performance Program. While the members would like to see some fine-tuning regarding the standard of review for institutional appeals, they agreed with the theory that only a very narrow subset of cases should ever reach a Board of Directors subcommittee on appeal.

Five Board members will serve on a subcommittee to hear the appeals of Committee on Academic Performance decisions. The subcommittee members will be appointed this fall.

The Board also:

• Approved as part of the governance restructuring a reorganization of the composition and responsibilities of the Division I Football Issues Committee. The group will consist of members from both the Football Bowl Subdivision and the Football Championship Subdivision. The representatives from the Football Bowl Subdivision will be responsible for the licensing of post season bowl games (a function previously performed by a subcommittee of the Championships/Competition Cabinet), while the representatives from the Football Championship Subdivision will be responsible for administering the Division I football championship. Members from both subdivisions will examine issues affecting the sport overall.

• Officially disbanded the Oversight and Monitoring Group, formed to oversee consideration by the governance structure recommendations from the Presidential Task Force on the Future of Division I Athletics. Chair Shirley Raines said the group has been successful in addressing the themes identified by the task force. To read about this group’s work, click here. The Board asked the Leadership Council to monitor the recommendations in the future.

• Sponsored legislation for the 2008-09 cycle that would require as a condition of Division I membership institutions to provide capital and operating expenditures data to the NCAA annually. The legislation was a recommendation of the presidential task force, and the vast majority of institutions have complied with the request in the last several years.
