Legislative actions taken during the Division I Management Council’s April 10 meeting in

legislation
• No. 06-3 Amateurism — Involvement with Professional Teams — Tryout Before Enrollment — Pre-draft Basketball
Intent: In basketball, to permit a prospect to accept actual and necessary expenses from a professional sports organization to attend that organization’s pre-draft basketball camp, regardless of the length of the camp.
Effective date: Immediate.

• No. 06-4 Recruiting — Contacts and Evaluations — Contact period Exception — Institutions With Official Admissions Notification Dates After Final Contact Period
Intent: To eliminate the waiver of contact periods for institutions with established admissions acceptance dates that occur after the normal contact deadline; further, to establish an exception to permit an institution that does not subscribe to the National Letter of Intent in a particular sport and has an official admissions notification date that occurs after the end of the final contact period of the academic year to extend the final contact period of the academic year through 30 days after the institution’s official admission notifications date.
Effective date: Immediate.

• No. 06-5 Ethical Conduct — Gambling Activities — Sanctions — Timing of Reinstatement Request
Intent: To eliminate the requirement that a request for reinstatement of a student-athlete’s eligibility may be submitted only on fulfillment of the minimum one-year period of ineligibility for instances in which a student-athlete solicits or accepts a bet or participates in any gambling activity that involves intercollegiate athletics or professional athletics through a bookmaker, a parlay card or any other method employed by organized gambling.
Effective date: Immediate.

• No. 06-6 Recruiting — Unofficial Visit — Activities — Eligibility Ramifications
Intent: To specify that a prospect’s eligibility would be affected and that an institution would be required to seek reinstatement of the prospect’s eligibility in cases involving violations related to the types of activities that may occur on an unofficial visit (for example, personalized recruiting aids, game-day simulations).
Effective date: Immediate.

• No. 06-7 Committees — Women’s Lacrosse Committee — Composition
Intent: To specify that the committee shall consist of one representative from each of the four regions (Northeast, Mid-Atlantic, South and West/Midwest) and two representatives selected at large; further, to specify that no more than two committee members shall be from any one region.
Effective date: Immediate.

• No. 06-8 Committees — Women’s Basketball Committee — Composition
Intent: To specify that the committee shall consist of one member from each of the four regions and six members selected at large; further, to specify that no more than three members shall be from any one region.

• No. 06-9 Legislative Process — Process for Adoption or Amendment of Bylaws — Management Council Action — Initial Review — Single Vote
Intent: To specify that the Management Council, on initial review of a legislative proposal, shall conduct a single vote to accomplish one of the following actions: (a) approve and forward the proposal directly to the Division I Board of Directors for possible adoption; (b) forward the proposal to the membership for review and comment; or (c) defeat the proposal.
Effective date: Immediate.

• No. 06-10 Playing and Practice Seasons — Annual Exemption — Gridiron Classic — Division I-AA Football
Intent: To eliminate the ECAC Football Classic as an annual contest exemption and establish the Gridiron Classic as an annual exemption for representatives from the Northeast Conference and the Pioneer Football League.
Effective date: Immediate.

Amateurism
• No. 05-26 Amateurism — Promotional Activities — Institutional, Charitable, Educational or Nonprofit Promotions
Intent: To revise the restrictions related to the use of a student-athlete’s name, picture or appearance in institutional, charitable, educational or nonprofit promotional activities, as specified.
Management Council action: Withdrawn (the Council noted that the Division I Academics/Eligibility /Compliance Cabinet’s agents and amateurism subcommittee wants to further review issues related to this proposal).
• No. 05-67-1 Amateurism — Promotional Activities — Permissible Continuation of Modeling and Other Nonathetically Related Promotional Activities After Enrollment — Sports Other Than Football and Men’s Basketball
Intent: To amend Proposal No. 2005-67 to remove, in sports other than football and men’s basketball, the condition that a student-athlete’s involvement in modeling and other nonathletically related promotional activities must be initiated before his or her enrollment at a member institution.
Management Council action: Defeated.
• No. 05-67 Amateurism — Promotional Activities — Permissible — Continuation of Modeling and Other Nonathetically Related Promotional Activities After Enrollment
Intent: To remove the condition that a student-athlete’s involvement in modeling and other nonathletically related promotional activities must be initiated before his or her enrollment at a member institution.
Management Council action: Defeated.
• No. 05-99 Amateurism — Promotional Activities — Promotion by Third Party of Highlight Film, Videotape or Media Guides
Intent: To allow institutions to designate a third party to sell photographs of student-athletes in the same manner as the sale of highlight films and media guides.

Awards and benefits
• No. 05-101 Awards And Benefits — Medical Expenses — Permissible
Intent: To specify that permissible medical expenses (including surgical expenses, medication, rehabilitation, physical therapy expenses and dental expenses) shall be limited to athletically related injuries or illnesses that occur during the academic year or summer.
Management Council action: Tabled.
• No. 05-102 Awards And Benefits — Medical Expenses — Permissible — Medical Insurance
Intent: To permit an institution to purchase a medical insurance policy to cover the medical expenses for any injury or illness sustained by the student-athlete.
Management Council action: Tabled.
Eligibility
• No. 05-49-B Eligibility — Progress Toward Degree — Nontraditional Courses
Intent: To permit the use of up to six semester or nine quarter credits of nontraditional courses (for example, distance-learning, correspondence, extension and credit-by-examination courses) per year completed at an institution other than a student-athlete’s certifying institution to meet 24/36 credit-hour and/or percentage-of-degree requirements, provided the courses satisfy the current legislation on distance-learning courses, receive prior approval by the appropriate academic officials from the certifying institution and are accepted by the certifying institution for degree credit.

• No. 05-52 Eligibility — Five-Year Period of Eligibility — Transfer Status and Progress Toward Degree
Intent: To specify that a student-athlete who is registered as a full-time student on the first day of classes starts the five-year period of eligibility, is subject to progress-toward-degree requirements and is considered a transfer student.
Management Council action: Defeated upon reconsideration.
• No. 05-111 Eligibility — Transfer Regulations —
Intent: To eliminate the one-time transfer in baseball.
Management Council action: Defeated.
• No. 05-109 Eligibility — Transfer — One-Time Transfer Exception — Division I-AA Football
Intent: To specify that a football student-athlete who transfers from a Division I-A institution to a Division I-AA institution may qualify for the one-time transfer exception only if the student-athlete has two or more seasons of competition remaining.

Financial aid
• No. 03-24 (as amended by Proposal No.
Intent: To permit an institution to award athletically related financial aid to a student-athlete for a period of less than a full academic year when the student-athlete is enrolled in the final semester or the final quarter, as specified; further, to require an institution to offer full year awards in equal amounts for each term of the academic year.

• No. 05-47 Financial Aid — Summer Financial Aid —
Intent: To permit an institution to provide a student-athlete with tuition and fees to attend summer-session classes at a branch campus of the institution.

• No. 05-48 Financial Aid — Elements of Financial Aid — Determination of Off-Campus Room and Board Costs
Intent: To permit an institution to calculate off-campus room and board costs based on its policies and procedures for calculating the cost of attendance for all students.

Personnel/coaching limitations
• No. 05-77-B Personnel — Coaching Limitations — Sports Other Than Football — Recruiting Functions
Intent: To specify that in sports other than football, all recruiting coordination functions (for example, on-campus evaluation and selection of prospects, phone calls, correspondence) shall be performed by head or assistant coaches.

Playing and practice seasons
• No. 05-125 Playing and Practice Seasons — General Playing Season Regulations — Required Day Off — Basketball Exception
Intent: In basketball, to provide an exception to the required day off when the institution participates in three contests in a given week, provided the student-athletes do not engage in any countable athletically related activities for two days during either the preceding week or the following week.

• No. 05-127 Playing and Practice Seasons — Men’s Rowing
Intent: To establish men’s rowing as an NCAA-sponsored sport with an NCAA championship, a limit of five equivalencies and coaching limitations of three total coaches, two who can recruit off campus.

• No. 05-128 Playing and Practice Seasons — Number of Contests — Division I-AA Football
Intent: To permit Division I-AA football institutions to compete annually in 12 regular-season games.

• No. 05-129 Playing and Practice Seasons — Out-of-Season Activities — Skill Instruction — Divisions I-A and I-AA Football
Intent: In football, to permit student-athletes to engage in two hours of skill instruction per week outside the playing season, provided no more than four student-athletes participate in such sessions at any one time in any facility.
Management Council action: Defeated.
• No. 05-131-B-1 Playing and Practice Season — Out-of-Season Activities — Hours of Skill Instruction, Number of Participants and Exam-Period Limitation — Basketball
Intent: To amend Proposal No. 2005-131 to specify that, in basketball only, more than four student-athletes from the same team may be involved in skill-related instruction with their coaches from September 15 through April 15.

Intent: In sports other than football, to permit more than four student-athletes to engage in skill-related instruction outside the playing season with their coach(es) at any one time and to specify that all athletically related activities outside the playing season are prohibited one week before the beginning of the final examination period through the end of each student-athlete’s final exams; further, in women’s basketball, to specify that not more than two hours per week may be spent on skill-related instruction outside the playing season.

Intent: In sports other than football, to permit more than four student-athletes to engage in skill-related instruction outside of the playing season with their coach(es) at any one time and to specify that all athletically related activities outside the playing season are prohibited one week before the beginning of the final examination period through the end of each student-athlete’s final exams.

• No. 05-137 Playing and Practice Seasons — Preseason Practice — Five-Day Acclimatization Period — Academic Orientation — Division I-A Football
Intent: In Division I-A football, to permit an institution to conduct the required academic orientation period any time before or during the five-day acclimatization period when a student-athlete is enrolled in summer classes or participating in summer conditioning activities before the student-athlete’s first season of football eligibility at the certifying institution.
Effective date: Immediate.

• No. 05-138 Playing and Practice Seasons — Preseason Practice — Activities Before the Five-Day Acclimatization Period — Academic Orientation Day — Division I-A Football
Intent: In Division I-A football, to permit an institution to conduct an academic orientation day the day before the start of the five-day acclimatization period for those student-athletes beginning their initial season of football eligibility at the certifying institution.
Effective date: Immediate.

• No. 05-160-A Recruiting — Official Visit —Entertainment/Tickets on Official Visit — Student Host — Entertainment Allowance
Intent: To specify that costs incurred by an athletics department staff member who accompanies a prospect during entertainment on an official visit shall not be included in the official visit entertainment allowance; further, to specify that when an athletics department staff member serves as the prospect’s host, his or her entertainment costs must be included in the official visit allowance.
Effective date: Immediate.

• No. 05-160-B Recruiting — Official Visit — Entertainment/Tickets on Official Visit — Student Host — Entertainment Allowance
Intent: To specify that during an official visit, the cost of entertainment of no more than two athletics department staff members per activity who accompany a prospect is excluded from the entertainment allowance; further, to specify that when an athletics department staff member serves as a prospect’s host, his or her entertainment costs must be included in the official visit allowance.

• No. 05-161 Recruiting — Tryout Exceptions — Safety Exception — Summer Before Initial Full-Time Enrollment at the Certifying Institution
Intent: To permit a prospective student-athlete who is attending summer school before initial full-time enrollment to engage in activities permitted under the safety exception in the applicable sports.
Effective date: Immediate.

• No. 05-164 Recruiting — Sports Camps and Clinics — Employment of Prospects
Intent: In sports other than football, to permit an institution to employ a prospect in its summer camp or clinic, provided the prospect has signed a National Letter of Intent or the institution’s written offer of admission and/or financial aid, has graduated from high school and is enrolled in institution’s summer term before initial full-time enrollment.
