The NCAA Division II Management Council and Presidents Council have determined, pursuant to NCAA Constitution 5.3.1.1.1, that the following proposals are noncontroversial and necessary to promote the normal and orderly administration of the Association's legislation. The Division II Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend the adoption of noncontroversial amendments, subject to ratification by the Division II Presidents Council.
Proposals that are ratified by the Presidents Council shall be effective as of the date identified in the proposal. Once ratified, the proposals will be published in The NCAA News and submitted by the Presidents Council as legislation at the 2006 NCAA Convention.
Awards and Benefits -- Housing and Meals -- Nutritional Supplements
Intent: To clarify the categories of nutritional supplements that an institution may provide to student-athletes.
Additional information: The intent of NCAA Bylaw 16.5.1-(g) is to limit the nutritional supplementation an institution may provide to student-athletes to four categories: electrolyte drinks, carbohydrate boosters, energy bars, and vitamins and minerals. The current language includes additional language that may be unnecessary and unclear. Substituting the word "permissible" for "muscle-building" provides greater clarity.
Bylaws: Amend 16.5.1 , page 162 , as follows:
"16.5.1 Permissible. Identified housing and meal benefits incidental to a student's participation in intercollegiate athletics that may be financed by the institution are:
[16.5.1-(a) through 16.5.1-(f) unchanged.]
"(g) Nutritional Supplements. An institution may provide only nonmuscle-building permissible nutritional supplements to a student-athlete at any time for the purpose of providing additional calories and electrolytes, provided the supplements do not contain any NCAA banned substances. Permissible nonmuscle-building nutritional supplements do not contain any NCAA banned substances and are identified according to the following classes: carbohydrate/electrolytes drinks, energy bars, carbohydrate boosters and vitamins and minerals."
Committees -- Sports Committees with Only Division II Championships Administration Responsibilities -- Appeals Subcommittee
Intent: To establish an Appeals Subcommittee to hear and decide appeals of sports committees' decisions.
Bylaws: Amend 21.7.7 by adding new 21.7.7.3 , page 292 , as follows:
[Division II]
"21.7.7 Sports Committees with Only Division II Championships Administration Responsibilities. To conduct Division II championships in an efficient and orderly fashion, Division II sports committees shall be established and will report directly to the Division II Championships Committee (see Bylaw 21.7.6.2).

"21.7.7.3 Appeals Subcommittee. The Appeals Subcommittee shall hear and decide appeals of Division II sports committees' decisions.
"21.7.7.3.1 Composition Requirements. The Appeals Subcommittee shall consist of five members, including two members of the Division II Championships Committee (one must be the chair) and three members of the Division II Management Council (one must be the chair).
"21.7.7.3.2 Duties. The Appeals Subcommittee shall review and consider appeals of Division II sports committees' decisions. The subcommittee shall not have the authority to hear appeals of selection decisions."
Effective date: Immediate; for sports committee decisions occurring on or after August 1, 2004.
