Division II noncontroversial legislation

The full version of the following changes to Division II legislation can be found in the Division II section of the September 26 issue of The NCAA News on NCAA Online.

Effective dates are August 1, 2006, unless otherwise noted.

Noncontroversial legislation

The NCAA Division II Management Council and Presidents Council have determined, pursuant to NCAA Constitution 5.3.1.1.1, that the following proposals are noncontroversial and necessary to promote the normal and orderly administration of the Association's legislation. The Division II Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend the adoption of noncontroversial amendments, subject to ratification by the Division II Presidents Council.

Proposals that are ratified by the Presidents Council shall be effective as of the date identified in the proposal. Once ratified, the proposals will be published in The NCAA News and submitted by the Presidents Council as legislation at the 2006 NCAA Convention.

 

NC-1: Membership -- Conditions and Obligations of Active Membership -- Certification of Insurance Coverage -- Effect of Violations

Intent: To specify that violations of the annual certification of insurance coverage for medical expenses resulting from athletically related injuries sustained by specified participants in covered events shall be considered institutional violations and shall not affect the student-athlete's or the prospective student-athlete's eligibility.

Effective date: Immediate.

NC-6: Recruiting -- Official Visit -- Test-Score Requirements

Intent: To specify that an institution may provide an official visit to a prospect who has provided a test score in writing on a high-school (or college) academic transcript (official or unofficial) or through the use of the applicable testing agency's automated-voice system.

Effective date: Immediate.

NC-7: Recruiting -- Official Visit -- Complimentary Admissions and Special Seating Arrangements

Intent: To specify that any violation of the complimentary admissions bylaw, including the prohibition on special seating arrangements, where the value of the excessive admissions is $100 or less, does not affect the eligibility of the prospective student-athlete, conditioned on the prospect repaying the value of the benefit to a charity of his or her choice.

Effective date: Immediate.

NC-9: Eligibility -- General Requirements -- Practice or Competition in World Youth Championships

Intent: To specify that a student-athlete participating in the World Youth Championships may receive a waiver of the full-time enrollment requirement for practice or competition.

Effective date: Immediate.

NC-11: Eligibility -- Four-Year College Transfers -- Exceptions -- Military Service, Church Mission

Intent: For a four-year college transfer, to modify the military service, church mission exception to the transfer residence requirement from an 18-month time period to 12 months.

Effective date: Immediate.

NC-12: Eligibility -- Transfer -- One-Time Transfer Exception -- Division III Transfer Student-Athlete

Intent: To permit a student-athlete who transfers from a Division III institution to a Division II institution, and qualifies for the one-time transfer exception, to receive athletically related financial aid during the first academic year in residence.

Effective date: August 1, 2005; for those student-athletes who transfer to a Division II institution for the 2005-06 academic year and thereafter.

NC-14: Financial Aid -- Exempted Government Grants -- United States Military Annuitant Pay

Intent: To exempt the United States Military Annuitant Pay and other family member service-related death benefits from a student-athlete's individual limit.

Effective date: Immediate.

NC-16: Awards and Benefits -- Awards -- Recognition by President, Governor or State Legislative Body

Intent: To permit an institution to provide actual and necessary expenses when a team (or its senior student-athletes) is accorded special recognition by a legislative body in the locale of the member institution.

NC-18: Awards and Benefits -- Complimentary Admissions and Ticket Benefits -- Recognition of Student-Athlete During Instituiton's Home Contest in Other Sports

Intent: To permit an institution to provide four complimentary admissions to a student-athlete who is being recognized during an institution's regular-season home intercollegiate athletics contest in a sport other than that in which the student-athlete participates.

Effective date: Immediate.

NC-19: Awards and Benefits -- Meals Incidental to Participation -- Summer Vacation Period

Intent: To permit an institution to provide an additional meal to student-athletes in conjunction with practice or competition during the institution's summer vacation period, and to permit the institution to provide a cash equivalent in lieu of the meal.

Effective date: Immediate.

NC-21: Awards and Benefits -- Expenses for Student-Athlete's Friends and Relatives -- Family Lodging

Intent: To permit an institution to reserve lodging for the family of a student-athlete for an institutional athletics event in which the student-athlete is participating.

Effective date: Immediate.

NC-23: Permissible Benefits, Gifts and Services -- Miscellaneous Benefits

Intent: To permit an institution to provide or arrange for miscellaneous benefits for a student-athlete, as specified.

Effective date: Immediate.

NC-24: Playing Seasons -- Women's Ice Hockey -- USA Hockey National Team Development Program Exception

Intent: To permit an institution to exempt either one ice hockey contest per year with a foreign opponent in the United States or with a team that is involved in the USA Hockey National Development Team Program.

Effective date: Immediate.

NC-28: Committees -- Sports Committees with Only Division II Championships Administration Responsibilities -- Appeals Committee

Intent: To change the composition of the five member Appeals Subcommittee to include two members of the Division II Championships Committee, two members of the Division II Management Council and the chair of the Championships Committee. The chair of the Appeals Committee shall be the same individual who serves as chair for the Championships Committee and shall vote only in the case of a tie.

Effective date: Immediate; for sports committee decisions occurring on or after August 1, 2004.

Moved from Presidents Council package to noncontroversial: Recruiting -- General Principles -- Entertainment

Intent: To permit an institution to provide entertainment, under specified conditions, to prospective student-athletes and his or her immediate family members on orientation or official visits.

PC-4: Recruiting -- Definitions and Applications -- Recruited Prospective Student-Athlete

Intent: To include the issuance of a National Letter of Intent or the institution's written offer of athletically related financial aid to the current list of actions that cause a prospective student-athlete to be considered recruited.

PC-5: Recruiting -- Contacts and Evaluations -- Four-Year College Prospects

Intent: To specify that permission to contact a four-year institution prospect is not required if the student-athlete is transferring from a non-NCAA or non-NAIA institution.

Effective date: Immediate.

PC-9: Recruiting -- Official Visit -- Visit to Off-Campus Contest

Intent: To eliminate the requirement that the Management Council must grant permission to permit the institution to visit off-campus contest sites on an official visit when the institution plays all home games off campus because of conditions beyond its control, and to permit institutions to self apply and document the legislation.

PC-10: Recruiting -- Official Visit -- Entertainment -- 30-Mile Limitation

Intent: To eliminate the 30-mile radius as a restriction when providing permissible entertainment for a prospect during an official visit.

PC-13: Recruiting -- Tryout Exceptions -- Private Lessons

Intent: To remove the 100-mile radius restriction as a condition for private lessons, provided to prospects conducted by an institution's golf or tennis coach.

PC-14: Recruiting -- Camps and Clinics -- Other Noninstitutional Privately Owned Camps/Clinics

Intent: To permit noncoaching staff members (for example, compliance coordinators), excluding noncoaching athletics staff members with sport specific responsibilities, to present educational sessions at noninstitutional camps/clinics not operated in accordance with restrictions applicable to institutional camps, provided the staff member does not make a recruiting presentation in conjunction with the appearance.

PC-15: Eligibility -- General Eligibility Requirements -- Admission and Enrollment

Intent: To clarify that in order to represent the institution in intercollegiate competition a student-athlete must be admitted to an institution in accordance with its admissions policies.

PC-22: Financial Aid -- Financial Aid from Outside Sources -- Athletics Participation Not Major Criterion

Intent: To permit the awarding agency to disburse aid for the recipient's educational expenses before or after the recipient's initial collegiate enrollment.

PC-24: Awards and Benefits -- Expenses for Student-Athlete's Friends and Relatives -- Complimentary Admission(s)

Intent: To permit an institution to provide a student-athlete with three complimentary admissions to one annual institutional awards banquet.

Modification of wording

The Division II Management Council, pursuant to its authority per NCAA Constitution 5.4.1.1.1, has determined that the following proposal is consistent with the intent of the membership in adopting the original legislation and that sufficient documentation and testimony exists to establish clearly that the original wording of the legislation was inconsistent with that intent.

The Division II Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend intent-based legislation, subject to ratification by the Division II Presidents Council. Any proposals ratified by the Presidents Council shall be effective as of the date identified in the proposal, published in The NCAA News and submitted by the Presidents Council as legislation at the 2006 NCAA Convention.

M-1: Organization -- Definitions and Applications --

Senior Woman Administrator

Intent: To specify that the position of senior woman administrator is not a requirement at an institution but, if appointed, should meet the guidelines, as established.

Effective date: Immediate.

M-2: Progress-Toward-Degree Requirements -- Fulfillment of Minimum Grade-Point Average Requirements

Intent: To specify that continuing transfer student-athletes must meet minimum grade-point average requirements at the certifying institution once the student-athlete triggers the fulfillment of credit-hour requirements pursuant to NCAA Bylaw 14.4.3.1.

Effective date: Immediate.

Administrative regulations

The Division II Management Council, subject to ratification by the Division II Presidents Council, may modify certain sections of Division II Bylaws 30 and 32. If approved by the Management and Presidents Councils, the revisions will be published in The NCAA News.

Adm-2: Executive Regulations -- Administration of NCAA Championships -- Awards

Intent: To amend the championships awards process to permit institutions to purchase additional participant and commemorative awards; further, to permit an institution to provide the awards to individuals at its discretion.

Effective date: Immediate.
