Division II noncontroversial

The NCAA Division II Management Council and Presidents Council have determined, pursuant to NCAA Constitution 5.3.1.1.1, that the following proposals are noncontroversial and necessary to promote the normal and orderly administration of the Association's legislation. The Division II Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend the adoption of noncontroversial amendments, subject to ratification by the Division II Presidents Council.

Proposals that are ratified by the Presidents Council shall be effective as of the date identified in the proposal. Once ratified, the proposals will be published in The NCAA News and submitted by the Presidents Council as legislation at the 2006 NCAA Convention.

Amateurism -- Employment -- Specific Athletically Related Employment Activities -- Athletics Equipment Sales and Goodwill Tour Commissions

Intent: To remove the restriction that a student-athlete may not be employed to sell equipment related to the student-athlete's sport, unless specified conditions are met; further, to remove the restriction that a student-athlete representing the institution in a goodwill tour may sell specified items, but not on a commission basis.

A. Bylaws: Amend 12.4.2.2, page 68, as follows:

"12.4.2.2 Athletic Equipment Sales. A student-athlete may not be employed to sell equipment related to the student-athlete's sport, if his or her name, picture or athletics reputation is used to advertise or promote the product, the job or the employer. If the student-athlete's name, picture or athletics reputation is not used for advertising or promotion, the student-athlete may be employed in a legitimate sales position, provided he or she is reimbursed at an hourly rate or set salary in the same manner as a nonathlete salesperson."

B. Bylaws: Amend 12.4.2.3, page 69, as follows:

"12.4.2.3 Goodwill Tour Commissions. A student-athlete representing the institution in a goodwill tour during summer months, in conjunction with the tour, may sell such items as jackets, blazers or similar institutional promotional items to booster groups or other friends of the institution on a salary, but not a commission, basis."
