Conference Call No. 6

April 18, 2005

The Interpretations Subcommittee of the Division II Legislation Committee issued the following interpretations:

Involvement of an Athletics Department Staff Member with an Organization that Operates or Endorses a Scouting or Recruiting Service

The subcommittee determined that it is permissible for an institutional athletics department staff member to be affiliated with a third-party organization (for example, coaches association, administrator organization) that operates or endorses a recruiting or scouting service involving prospects, provided no individual institutional athletics department staff members are involved in the operation, endorsement or oversight of the service and access to the service is available to all coaches or institutions on an equal basis regardless of affiliation with the third-party organization. [Reference: NCAA Division II Bylaw 11.3.2.2 (recruiting service consultants).]

Prospects and Institutional Fund-Raisers

The subcommittee determined that pursuant to NCAA Division II Bylaw 13.01.5 (recruiting by representatives of athletics interests) and Division II Bylaw 13.2.1 (offers and inducements -- general regulation) it is not permissible for institutions to involve prospective student-athletes who have signed a National Letter of Intent in institutional fund-raisers or promotional activities in the summer prior to initial full-time collegiate enrollment.
