Modification of wording

Pursuant to NCAA Constitution 5.4.1.1.1, the NCAA Division I Management Council has determined that the following proposals are consistent with the intent of the membership in adopting the original legislation and that sufficient documentation and testimonies exist to establish clearly that the original wording of the legislation was inconsistent with that intent.

The Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend intent-based legislation, subject to ratification by the NCAA Division I Board of Directors. Any proposal ratified by the Board shall be effective as of the date identified in the proposal and published in the NCAA News. Those items that the Management Council has yet to review in legislative form are marked with an asterisk.

1. Eligibility -- Progress Toward degree -- Credit-Hour Requirement

Intent: To specify that once a student-athlete initially enrolls as a full-time student, he or she must meet the 24-semester or 36-quarter hour and 18-semester or 27-quarter hour requirements before the start of the institution's third semester or fourth quarter after the student-athlete's initial full-time enrollment.

Bylaws: Amend Proposal No. 2002-23 as amended by Proposal No. 2002-23-2, Part B, 14.4.3.1, as follows:

"14.4.3.1 Fulfillment of Credit-Hour Requirements. Eligibility for competition shall be determined by the student-athlete's academic record in existence at the beginning of the fall term or at the beginning of any other regular term of that academic year, based upon satisfactory completion of at least:

"(a) Twenty-four semester or 36-quarter hours of academic credit before the student-athlete enters his or her second year of collegiate enrollment before the start of the institution's third semester or fourth quarter after the student-athlete's initial full-time enrollment,

[14.4.3.1-(b) through 14.4.3.1-(c) unchanged.]

"14.4.3.1.1 Application of Rule. For purposes of Bylaw 14.4.3.1-(b), once a student-athlete initially enrolls as a full-time student, he or she must meet the 18-semester/27-quarter hour requirement before the start of the institution's third semester or fourth quarter after the student-athlete's initial full-time enrollment. Further, the 18-semester/27-quarter hour requirement applies to each academic year in which a student-athlete is enrolled as a full-time student during any term of that academic year."

2. Eligibility -- Progress Toward degree -- Credit-Hour Requirement -- Regaining Eligibility

Intent: To specify that a student-athlete who does not meet the 24-semester or 36-quarter credit-hour requirement (before the beginning of the institution's third semester or fourth quarter after the student-athlete's initial full-time enrollment) may become eligible at the beginning of the next academic term by successfully completing 24 semester or 36 quarter hours during the previous two semesters or three quarters.

Bylaws: Amend Proposal 2002-23 as amended by Proposal No. 2002-23-2, Part B, 14.4.3.1, as follows:

"14.4.3.1 Fulfillment of Credit-Hour Requirements. Eligibility for competition shall be determined by the student-athlete's academic record in existence at the beginning of the fall term or at the beginning of any other regular term of that academic year, based upon satisfactory completion of at least:

[14.4.3.1-(a) through 14.4.3.1-(c) unchanged.]

"14.4.3.1.1 Regaining Eligibility. For purposes of Bylaw 14.4.3.1-(a), a student-athlete who does not meet the 24-semester or 36-quarter credit-hour requirement may become eligible at the beginning of the next academic term by successfully completing 24 semester or 36 quarter hours during the previous two semesters or three quarters."

3. Eligibility -- Progress Toward degree -- Credit-Hour Requirement -- Part-Time Enrollment

Intent: To eliminate Bylaw 14.4.3.1.2, which currently precludes student-athlete using hours earned while enrolled on a part-time basis to meet credit-hour requirements unless the student-athlete is held accountable for the term.

Bylaws: Amend Proposal No. 2002-23 as amended by Proposal No. 2002-23-2, Part B, 14.4.3.1.2, as follows:

"14.4.3.1.2 Part-time Enrollment. Semester or quarter hours earned by a student-athlete while enrolled in less than a full-time program of studies (per Bylaw 14.1.6.2.2) shall not be used to meet satisfactory-progress requirements of Bylaws 14.4.3.1, unless the student-athlete is held accountable for the term(s) of part-time enrollment at the time of certification."

4. Amateurism -- Involvement with Professional Teams --
Draft and Inquiry

Intent: To specify that the professional football draft exception pertains only to the National Football League.

Bylaws: Amend 12.2.4.2.2 , page 75, as follows:

[Federated provision, Divisions I-A and I-AA, divided vote]

"12.2.4.2.2 Exception -- Divisions I-A and I-AA Football. An enrolled student-athlete (as opposed to a prospective student-athlete) in the sports of Division I-A and I-AA football may enter a professional league's the National Football League draft one time during his collegiate career without jeopardizing eligibility in that sport, provided the student-athlete is not drafted by any team in that league and the student-athlete declares his intention to resume intercollegiate participation within 72 hours after the National Football League draft declaration date. The student-athlete's declaration of intent shall be in writing to the institution's director of athletics."

5. Eligibility -- Progress Toward Degree --
Fulfillment of Credit-Hour Requirement -- Transfer Student-Athletes

Intent: To specify that a transfer student-athlete must meet the credit-hour requirements to be eligible for competition and may use any hours of academic credit earned at any collegiate institution.

Bylaws: Amend Proposal No. 2002-23 Part B, 14.4.3.1, as follows:

"14.4.3.1 Fulfillment of Credit-Hour Requirements. Eligibility for competition shall be determined by the student-athlete's academic record in existence at the beginning of the fall term or at the beginning of any other regular term of that academic year, based upon satisfactory completion of at least:

[14.4.3.1-(a) through 14.4.3.1-(c) unchanged.]

"14.4.3.1.1 Midyear Transfer. To be eligible for competition the ensuing academic year, a midyear transfer student-athlete must meet the provisions of Bylaw 14.4.3.1 and may use transferable degree credit in addition to any hours of academic credit earned at the certifying any collegiate institution."
