Noncontroversial legislative proposals

Pursuant to NCAA Constitution 4.7.3-(d) and 5.3.1.1.1, the Division III Management Council has determined that the following proposals are noncontroversial and necessary to promote the normal and orderly administration of the Association's legislation.

The Division III Management Council, by a three-fourths majority of its members present and voting, shall have the authority to adopt noncontroversial amendments, subject to ratification by the Division III Presidents Council.

Proposals that are ratified by the Presidents Council shall be effective as of the date identified in the proposal, published in The NCAA News and submitted as legislation at the 2003 NCAA Convention.

Those items the Management Council has not yet reviewed in legislative form are marked with an asterisk.

All legislative citations and governing bodies are reflected as they now appear in the 2001-02 NCAA Division III Manual. Bold type indicates new wording; italicized type indicates wording removed.

No. 1 Membership -- Emerging Sport Timetable

Intent: To revise the emerging sports timetable from specific to general year references and to specify that an institution must comply with recruiting legislation during the first year.

Constitution: Amend 3.2.4.4.2, page 10, as follows:

"3.2.4.4.2 Emerging Sports Timetable. The following timetable shall govern the application of legislation to emerging sports for women:

"(a) 1994-95 Year One -- Recruiting legislation (see Bylaw 13), Ffinancial aid legislation (see Bylaw 15) and minimum contests and participants requirements for sports sponsorship (see Bylaw 20) applicable to emerging sports programs.

"(b) 1995-96 Year Two -- Amateurism legislation (see Bylaw 12), seasons of competition legislation (see Bylaw 14) and awards and benefits legislation (see Bylaw 16) applicable to emerging sports programs.

"(c) 1996-97 Year Three and thereafter -- Institutions must be in full compliance with all remaining NCAA legislation."

*No. 2 Membership -- Provisional Membership -- Determination of Provisional Member Status

Intent: To permit provisional member institutions to continue the four-year provisional member process with or without conditions as determined by the Membership Committee in instances of noncompliance with Division III and/or provisional membership regulations.

Constitution: Amend 3.6.4 by adding new 3.6.4.5, page 18, as follows:

"3.6.4.5 Determination of Provisional Membership Standing. A provisional member may be permitted to continue the four-year provisional member process with or without conditions as determined by the Membership Committee in instances of noncompliance with Division III and/or provisional membership regulations."

No. 3 Association-Wide Committees -- Memorial Resolutions Committee

Intent: To eliminate the Association-wide Memorial Resolutions Committee and to reassign the committee's duties to the Executive Committee.

A. Constitution: Amend 4.1.2, page 22, as follows:

"4.1.2 Duties and Responsibilities. The Executive Committee shall:

[4.1.2-(a) through 4.1.2-(j) unchanged.]

"(k) Call for an annual or Special Convention of the Association; and

"(l) Review and coordinate the catastrophic-injury and professional career insurance (disability injury/illness) programs; and

"(m) Compile the names of those individuals associated with intercollegiate athletics who died during the year immediately preceding the annual Convention.

B. Bylaws: Amend 21.1.4.1, page 240, as follows:

"21.1.4 Memorial Resolutions Committee

"21.1.4.2 Composition. The Memorial Resolutions Committee shall consist of five members, at least one from each membership division.

"21.1.4.2 Duties. The committee shall be responsible for compiling the names of those individuals associated with intercollegiate athletics who died during the year immediately preceding the annual Convention. The committee shall make its report each year; memorializing the individuals involved, during the business sessions of the annual Convention."

No. 4 Playing and Practice Seasons -- Definitions

Intent: To clarify that an institution is charged with a contest or date of competition if the institution's team competes against an outside team in addition to competing against another institution's team.

A. Bylaws: Amend 17.02.2, page 132, as follows:

"17.02.2 Contest. A contest is any game, match, exhibition, scrimmage or joint practice session with another institution's or an outside team, regardless of its formality, in which competition in a sport occurs between an intercollegiate athletics team or individual representing a member institution and any other outside team or individual not representing the intercollegiate athletics program of the same member institution."

B. Bylaws: Amend 17.02.5, page 132, as follows:

"17.02.5 Date of Competition. A date of competition is a single date on which any contest(s), with another institution's or an outside team or individual takes place. (See Bylaw 17.02.2.)"

C. Bylaws: Amend 17.02.9, page 133, as follows:

"17.02.9 Outside Competition. Outside competition is athletics competition against any other athletics outside team (including an alumni team) or individual that does not represent the intercollegiate athletics program of the same institution"

No. 5 Postseason Events -- Establishment or Continuation of Championships -- Exception for Women's Sports

Intent: To extend to 2008-09 the exception to establish a national collegiate championship or division championship in a women's sport if at least 40 institutions sponsor the sport.

Bylaws: Amend 18.2.4.1, page 214, as follows:

"18.2.4.1 Exception for Women's Sports during the 1994-95 through 2003-04 2008-09 Academic Years. A National Collegiate Championship or division championship may be established during the 1994-95 through the 2003-04 2008-09 academic years in a women's sport in which the Association does not already conduct a championship if at least 40 institutions sponsor the sport."

No. 6 Association-Wide Committees -- Student-Athlete Representation

Intent: To permit student-athletes to serve as full members on specified Association-wide committees.

A. Bylaws: Amend 21.1.1 pages 239-240, as follows:

"21.1.2 Competitive Safeguards and Medical Aspects of Sports, Committee on

"21.1.2.1 Composition. The Committee on Competitive Safeguards and Medical Aspects of Sports shall consist of 16 19 members, including five position allocated for men, five allocated for women and six unallocated. The membership of the committee shall be constituted as follows:

[21.1.2-(a) through 21.1.2-(i) unchanged.]

"(j) One member with expertise in the area of drug education; and

"(k) One student-athlete from each division (who shall have one combined vote) shall serve as a member of the committee and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility; and

[21.1.2-(k) relettered as 21.1.2-(l) unchanged.]

"21.1.2.1.1 Student-Athlete Representation. One student-athlete from each division shall serve as a member of the committee in an advisory capacity and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility."

B. Bylaws: Amend 21.1.5, page 240, as follows:

[Common provision, all divisions, divided vote]

"21.1.5 Minority Opportunities and Interests Committee

"21.1.5.1 Composition. The Minority Opportunities and Interests Committee shall consist of 12 15 members. There shall be six members from Division I, three members from Division II and three members from Division III. One student-athlete from each division (who shall have one combined vote) shall serve as a member of the committee and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility. Committee membership shall include a minimum of eight ethnic minorities, including at least four males and four females.

"21.1.5.1.1 Student-Athlete Representation. One student-athlete from each division shall serve as members of the committee in an advisory capacity and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility."

C. Bylaws: Amend 21.1.6, page 241, as follows:

[Common provision, all divisions, divided vote]

"21.1.6 Olympic Sports Liaison Committee

"21.1.6.1 Composition. The Olympic Sports Liaison Committee shall consist of 11 14 members, including at least one from each division. One student-athlete from each division (who shall have one combined vote) shall serve as a member of the committee and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility.

"21.1.6.1.1 Student-Athlete Representation. One student-athlete from each division shall serve as a member of the committee in an advisory capacity and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility."

E. Bylaws: Amend 21.1.8, page 241, as follows:

[Common provision, all divisions, divided vote]

"21.1.8 Research Committee

"21.1.8.1 Composition. The Research Committee shall consist of 10 13 members, including four representatives from Division I, two each from Divisions II and III and two unallocated. In addition, three positions shall be allocated for men, three allocated for women and four unallocated. The membership of the committee shall consist of at least three athletics administrators and at least three faculty athletics representatives with appropriate research experience. One student-athlete from each (who shall have one combined vote) shall serve as a member of the committee and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility.

"21.1.8.1.1 Student-Athlete Representation. One student-athlete from each division shall serve as a member of the committee in an advisory capacity and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility."

E. Bylaws: Amend 21.1.9, page 241, as follows:

[Common provision, all divisions, divided vote]

"21.1.9 Sportsmanship and Ethical Conduct, Committee on

"21.1.9.1 Composition. The Committee on Sportsmanship and Ethical Conduct shall consist of eight 11 members. One student-athlete from each (who shall have one combined vote) shall serve as a member of the committee and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility.

"21.1.9.1.1 Student-Athlete Representation. One student-athlete from each division shall serve as a member of the committee in an advisory capacity and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility."

F. Bylaws: Amend 21.1.11, page 241, as follows:

[Common provision, all divisions, divided vote]

"21.1.11 Women's Athletics, Committee on

"21.1.11.1 Composition. The Committee on Women's Athletics shall consist of 12 15 members, including six members from Division I, three members from Division II and three members from Division III. Four positions shall be allocated for men, four allocated for women and four unallocated. One student-athlete from each (who shall have one combined vote) shall serve as a member of the committee and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility.

"21.11.1.1 Student-Athlete Representation. One student-athlete from each division shall serve as a member of the committee in an advisory capacity and may serve on the committee up to two years after completion of his or her intercollegiate athletics eligibility."

*No. 7 Committee on Competitive Safeguards and Medical Aspects of Sports -- Duties

Intent: To modify the duties of the Committee on Competitive Safeguards and Medical Aspects of Sports, as specified.

Bylaws: Amend 21.1.2.2, page 240, as follows:

[Common provision, all divisions, divided vote]

"21.1.2.2 Duties. The committee, subject to the direction of the Executive Committee, shall:

"(a) Collect and develop pertinent information regarding desirable training methods, prevention and treatment of sports injuries, utilization of sound safety measures at the college level, drug education, and drug testing Promote and sponsor research to address relevant health and safety issues;

"(b) Disseminate such information as might be brought appropriately to the attention of the Association's membership and adopt recommended policies and standards designed to further the above objectives Promote education to enhance the health and safety of student-athletes; and

"(c) Supervise the Association's drug-education and drug-testing programs under the direction of the Executive Committee. Operate a national injury surveillance program to monitor injury trends and enhance safety in intercollegiate athletics;

"(d) Deter the use of NCAA banned substances in order to promote fair competition and safety;

"(e) Facilitate outreach activities to enhance student-athlete health and safety; and

"(f) Provide a health and safety perspective on relevant legislation and policy."

*No. 8 Committees -- Student-Athlete Advisory Committee -- Composition

Intent: To amend the composition requirements of the Division III Student-Athlete Advisory Committee to indicate that not more than one student-athlete from a playing conference may serve on the committee at any time.

Bylaws: Amend 21.8.6.10.1, pages 250-251, as follows:

"21.8.6.10.1 Composition. The student-athlete advisory committee shall consist of 24 members, including at least four members from each of the four geographical regions per Constitution 4.12.1.2 and eight members serving at large. The committee shall include at least 12 men, at least 12 women, and at least six ethnic minorities. No more than two one student-athletes from the same a playing conference (one male, one female) may be committee members serve on the committee at any time. Two Management Council members shall serve as ex officio members of the committee."

*No. 9 Committees -- Student-Athlete Advisory Committee -- Term of Office

Intent: To amend the term of office requirements for the Student-Athlete Advisory Committee, as specified.

Bylaws: Amend 21.8.6.10.2, page 251, as follows:

"21.8.6.10.2 Term of Office. A student-athlete member shall not serve more than three years on the committee and may not be reappointed for another term. Student-athletes may serve on the committee up to one year after completion of their intercollegiate athletics eligibility. A member shall commence service on the first day following the member's election. When a student-athlete member leaves the committee, the student-athlete shall be replaced by a student-athlete from his or her partner conference who may serve up to three years on the committee."

No. 10 Executive Regulation --
Banned Drugs

Intent: To add Phenylpropanolamine (PPA) to the list of banned substances under the category of "Stimulants."

Bylaws: Amend 31.2.3.1, pages 270-272, as follows:

"31.2.3.1 Banned Drugs. The following is the list of banned-drugs classes:

"(a) Stimulants:

Phenylpropanolamine (PPA)."

No. 11 Membership -- Eligibility for Membership -- Membership Moratorium

Intent: To remove the current membership moratorium on the election of new provisional members.

Constitution: Amend 3.1.3, page 8, as follows:

"3.1.3 Membership Moratorium. Effective For a two-year period beginning April 27, 2000, an institution shall not be elected to Division III provisional membership."
