Noncontroversial legislative proposals

The NCAA Division II Management Council and Presidents Council have determined, pursuant to NCAA Constitution 5.3.1.1.1, that the following proposals are noncontroversial and necessary to promote the normal and orderly administration of the Association's legislation.

The Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend the adoption of noncontroversial amendments, subject to ratification by the Division II Presidents Council. Proposals that are ratified by the Presidents Council shall be effective as of the date identified in the proposal. Once ratified, the proposals will be published in The NCAA News and submitted by the Presidents Council as legislation at the 2003 NCAA Convention.

The items marked with an asterisk have been approved by the Management Council and Presidents Council in concept, but have not yet been approved in legislative form. Other items have previously been approved in legislative form. The page numbers in the proposals refer to the 2002-03 NCAA Division II Manual.

*No. 1 Amateurism -- Definition of Professional Team -- Olympic/
National Team

Intent: To provide an exception to permit individuals (prospective student-athletes or student-athletes) to compete on Olympic or national teams that may be competing for prize money or are being compensated by the governing body to participate in a specific event, provided the individual does not accept prize money or any other compensation (other than actual and necessary expenses).

Bylaws: Amend 12.2.3 by adding new 12.2.3.2.2, page 66, as follows:

"12.2.3 Exception -- Olympic/National Teams. It is permissible for an individual (prospective student-athlete or student-athletes) to participate on Olympic or national teams that are competing for prize money or are being compensated by the governing body to participate in a specific event, provided the student-athlete does not accept prize money or any other compensation (other than actual or necessary expenses)."

*No. 2 Association-Wide Playing Rules -- Oversight Panel

Intent: To establish an Association-wide playing-rules oversight panel appointed by the NCAA Executive Committee to resolve proposals involving player safety, financial impact or image of the game that do not have unanimous Division I, II or III support and to provide counsel to the NCAA staff about playing-rules issues including implementation of rules and regulations. Further, to establish the composition of the panel as eight members, including the chair of the Division I Championships/Competition Cabinet, and two representatives each from Divisions II and III, including the NCAA Division II Championships Committee and NCAA Division III Championships Committee chairs.

A. Bylaws: Amend 21.2.1 by adding new 21.2.1.3.1, pages 274-275, as follows:

[Common provision, all divisions, divided vote]

"21.2.1.3.1 Playing Rules Oversight Panel.

"21.2.1.3.1.1 Composition. The panel shall consist of eight members, including the chair of the Division I Championships/Competition Cabinet and two representatives each from Division II and Division III, including the Division II Championships Committee and the Division III Championships Committee chairs.

"21.2.1.3.1.2 Duties. The panel, subject to the discretion of the Executive Committee, shall be responsible for resolving issues involving player safety, financial impact or image of the game that do not have unanimous Division I, II or III support. In addition, the committee shall provide counsel to NCAA staff about playing rules and make recommendations regarding implementation of rules and related policies."

B. Bylaws: Amend 21.3.1.5 by adding new 21.3.1.5.1.1, pages 375-376, as follows:

[Common provision, all divisions, divided vote]

"21.3.1.5.1.1 Playing Rules Oversight Panel.

"21.3.1.5.1.1.1 Composition. The panel shall consist of eight members, including the chair of the Division I Championships/Competition Cabinet and two representatives each from Division II and Division III, including the Division II Championships Committee and the Division III Championships Committee chairs.

"21.3.1.5.1.1.2 Duties. *No. 3 Committee on Competitive Safeguards and Medical Aspects of Sports -- Composition

Intent: To increase the size of the Committee on Competitive Safeguards and Medical Aspects of Sports from 19 to 20 members; further, to specify that one member of the committee must have expertise in the area of drug testing.

Bylaws: Amend 21.1.2.1, pages 219-220, as follows:

[Common provision, all divisions, divided vote]

"21.1.2.1 Composition. The Committee on Competitive Safeguards and Medical Aspects of Sports shall consist of 19 20 members, including five positions allocated for men, five allocated for women and six unallocated. The membership of the committee shall be constituted as follows:

[21.1.2.1-(a) through 21.1.2.1-(i) unchanged.]

"(j) One member with expertise in drug testing."

[21.1.2.1-(j) through 21.1.2.1-(l) renumbered as 21.1.2.1-(k) through 21.1.2.1-(m), unchanged.]

*No. 4 Committees -- Men's Gymnastics Committee

Intent: To legislate the composition of the men's gymnastics committee, specifying that there are no divisional and subdivisional requirements for the composition of the committee.

Bylaws: Amend 21.3 by adding new 21.3.2, page 276, as follows:

[Common provision, all divisions, divided vote]

"21.3.2 Gymnastics Committee, Men's. The Men's Gymnastics Committee shall consist of six members. Four members shall be from Division I and two members shall be selected at large."

*No. 5 Common Committees -- Men's and Women's Skiing Committee

Intent: To specify that two members of the seven-person committee shall represent men's skiing interests and two members shall represent women's skiing interests; further, to exempt the men's and women's skiing committee from the administrator/coach requirements.

A. Bylaws: Amend 21.3.1.2 by adding new 21.3.1.2.1, page 275, as follows:

"21.3.1.2.1 Exception -- Men's and Women's Skiing Committee. The Men's and Women's Skiing Committee shall be exempt from the composition requirements set forth in Bylaw 21.3.1.2."

B. Bylaws: Amend 21.3.5, page 276, as follows:

"21.3.5 Skiing Committee, Men's and Women's. The Men's and Women's Skiing Committee shall consist of seven members and shall be constituted as follows:

"(a) Two positions members shall be allocated for represent men's skiing interests, two allocated for members shall represent women's skiing interests and three unallocated;"

[21.3.5-(b) and 21.3.5-(c) unchanged.]

*No. 6 Membership -- Reclassification from Division III

Intent: To specify that a Division III institution petitioning for reclassification to a Division II must be in compliance with all Division II legislation during the two-year reclassification period, including the Division II minimum financial aid requirements.

Bylaws: Amend 20.5.2.4, page 264, as follows:

"20.5.2.4 Compliance with Criteria. If the member has met all applicable membership criteria of this article for the division to which it intends to transfer and has complied for the two years before June 1 with all other division bylaw requirements, the member shall be transferred to the new division effective the September 1 that the institution selects as its effective date. Division III institutions accepted for reclassification must be in compliance with all Division II legislation during both years of the reclassification period, including the minimum financial aid requirements (see Bylaw 20.10.1)."
