Modification of wording

The NCAA News

The NCAA Division II Management Council, pursuant to its authority per NCAA Constitution 5.4.1.1.1, has determined that the following proposals are consistent with the intent of the membership in adopting the original legislation and that sufficient documentation and testimony exists to establish clearly that the original wording of the legislation was inconsistent with that intent.

The Division II Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend intent-based legislation, subject to ratification by the Division II Presidents Council. Any proposal ratified by the Presidents Council shall be effective as of the date identified in the proposal, published in The NCAA News and submitted by the Presidents Council as legislation at the 2003 NCAA Convention.

The items have been approved by the Management Council and Presidents Council in concept, but have not yet been approved in legislative form. The page numbers in the proposals refer to the 2002-03 NCAA Division II Manual.

*No. 1 Amateurism -- Competition with Professionals

Intent: To specify that an individual shall not be eligible for intercollegiate athletics if the individual ever competed on a professional team after initial full-time collegiate enrollment, regardless of whether the individual knew (or had reason to know) that the team was a professional team.

A. Bylaws: Amend 12.1.1, page 62, as follows:

"12.1.1 Amateur Status. An individual loses amateur status and thus shall not be eligible for intercollegiate competition in a particular sport if the individual:

[12.1.1-(a) through 12.1.1-(d) unchanged.]

"(e) Subsequent to initial full-time collegiate enrollment, competes on any professional athletics team and knows (or had reason to know) that the team is a professional athletics team (per Bylaw 12.02.4), even if no pay or remuneration for expenses was received;"

[12.1.1-(f) through 12.1.1-(g) unchanged.]

B. Bylaws: Amend 12.2.3.2, page 66, as follows:

"12.2.3.2 Competition with Professionals. Subsequent to initial full-time collegiate enrollment, an individual shall not be eligible for intercollegiate athletics in a sport, if the individual ever participated competes on a professional athletics team and knew (or had reason to know) that the team was a professional team (per Bylaw 12.02.4) in that sport. However, an individual may compete on a tennis, golf, two-person sand volleyball or two-person synchronized diving team(s) with persons who are competing for cash or a comparable prize, provided the individual does not receive payment of any kind for such participation."

Effective date: August 1, 2003.

*No. 2 Recruiting -- Sports Camps and Clinics -- Employment in Own Institution's Camp or Clinic

Intent: To specify that a director of athletics' failure to provide prior approval for a student-athlete to work in the member institution's camp or clinic is a de minimus institutional violation.

Bylaws: Amend 13.13.2.1.2, page 98, as follows:

"13.13.2.1.2 Employment in Own Institution's Camp or Clinic. A member institution (or employees of its athletics department) may employ its student-athletes as counselors in camps or clinics, subject to the following conditions:

[13.13.2.1.2-(a) through 13.13.2.1.2-(b) unchanged.]

"13.13.2.1.2.1 Effect of Violations. Violations of Bylaw 13.13.2.1.2- (b) this bylaw shall be considered institutional violations per 2.8.1; however, the violation shall not affect the student-athlete's eligibility."
