The NCAA News

This report summarizes legislation currently pending before state legislatures that could affect or is of interest to staff members of intercollegiate athletics programs and student-athletes. Set forth below is a list of 66 bills from 30 states. The report includes 55 bills that have been recently introduced or prefiled and 11 pending bills where legislative action has occurred since the publication of the February 12, 2001, NCAA News. Newly introduced and prefiled bills are marked with an asterisk (*).

The State Legislation Report is based largely on data provided by the Information for Public Affairs online state legislation system as of February 20, 2001. The bills selected for inclusion in this report were drawn from a larger pool of measures that concern sports and, therefore, do not necessarily represent all of the bills that would be of interest to individual member institutions. Bills pending before the governing bodies of the District of Columbia and U.S. territories are not available on an online basis and are not included in this report.

The NCAA has not independently verified the accuracy or completeness of the data provided by Information for Public Affairs and is providing this summary as a service to its members. For further information regarding a particular bill, members should contact the state legislature concerned.

Two bills have been adopted since the last report. In Alaska, a resolution was adopted by the legislature that urges the NCAA Division I Management Council and the Board of Directors to recognize the positive contributions of the Great Alaska Shootout and the Top of the World Classic and to reject NCAA legislative proposal No. 2000-16. In Virginia, a joint resolution was approved that expresses the strong opposition of the General Assembly to the National Collegiate Athletic Association's pending amateurism deregulation proposals.

*Alabama H 105 (Author: Allen)

Athlete agents. Creates the Uniform Athlete Agents Act, a model state law developed by the National Conference of Commissioners on Uniform State Laws and endorsed by the NCAA and its membership. Establishes a uniform set of rules regulating athlete agents. Requires athlete-agent registration with a specified state agency. Provides for

reciprocal registration with those states that have substantially similar registration requirements. Contains a detailed application process providing consumer information. Establishes requirements for agency contracts between student-athletes and athlete agents. Lists a number of prohibited acts. Permits specified state agency to issue subpoenas for any material that is relevant to the administration of the act. Imposes criminal, civil and/or administrative penalties for violations of the act. *Alabama H 144 / S 299 (Authors: Allen / Smitherman)

Sports officials. Increases the punishment for the crimes of harassment, menacing, and assault in the first, second, and third degree if the crimes are committed against a sports official performing official duties at a sporting event.

*Alabama H 214 (Author: Hogan)

Athletic trainers. Provides for the continuation of the Alabama Board of Athletic Trainers.

*Alaska HJR 9 / SJR 5 (Authors: Committee on Health / Leman)

Arkansas H 1084 (Author: Biggs)

Athletic trainers. Amends existing law by replacing Arkansas State Board of Physical Therapy with the Arkansas State Board of Athletic Training. Makes changes to the board's composition, powers and duties.

*Arkansas H 1694 (Author: Rackley)

Scheduling of athletics contests. Requires the University of Arkansas, Fayetteville, to play annually against Arkansas State University in football. Establishes that Arkansas; Arkansas State; and the University of Arkansas, Little Rock, shall annually play at least one men's basketball game against each of the other two universities.

*Arkansas S 394 (Author: Malone)

*Arizona S 1180 (Author: Bennett)

*Connecticut S 824 (Author: LeBeau)

Athletics facilities. Provides funds for a ramp and roadway system that would allow for adequate traffic flow into the stadium at Rentschler field.

*Florida H 163 (Author: Prieguez)

Athletics facilities. Permits any publicly owned football facility at which a private or public university or college football team is based to retain the proceeds of sales taxes generated by the facility, its concessionaires, ticket sales, merchandising, ticket surcharges and other transactions for the purpose of renovating and modernizing the facility. Requires the facility to be located within a municipality that has been declared in a state of financial emergency within the preceding six years.

*Hawaii H 227 (Author: Takai)

Tickets. Prohibits a person from selling or offering to sell a ticket to an event at a price greater than the price charged at the place of admission or printed on the ticket. Imposes misdemeanor penalties on violators.

*Hawaii S 562 (Author: Sakamoto)

High-school extracurricular/home school. Allows home-schooled students to participate in extracurricular activities, including athletics, in public schools in the district in which they reside.

*Hawaii S 826 (Author: Matsuura)

Liability. Expands the scope of sport and recreational activities in the liability law. States that persons who participate in any sports or recreational activity assume the inherent risks in that sport or activity and are legally responsible for any damages or injuries that result from the inherent risks associated with the sport or activity.

Status: 1/22/2001 introduced. 2/6/2001 passed as amended by Senate Committee on Economic Development and Technology.

*Hawaii S 1097 (Author: Bunda)

Athletics facilities. Establishes a stadium task force to review the management of the stadium authority and the operations of the University of Hawaii, Manoa, in managing its arena and baseball stadium. Requests that the task force provide guidance for the combined operation of the stadium, the arena and the baseball stadium.

*Idaho H 254 (Author: Committee on Judiciary)

Sports officials. Provides that it is a misdemeanor offense to have offensive contact with a sports official during a sporting event.

*Idaho S 1063 (Author: Committee on Judiciary)

*Illinois H 375 (Author: Ryder)

*Illinois H 545 (Author: Daniels)

Internet gambling. Prohibits Internet gambling. Imposes Class A misdemeanor penalties on persons who engage in Internet gambling. Adds Internet gambling to the list of prohibited syndicated gambling activities. Imposes Class 3 felony penalties on persons who operate an Internet gambling business.

*Illinois S 50 (Author: Syverson)

Sports officials. Sets minimum fines of $1,000 and $2,000 for first and second offenses of battery against a sports official within or in the immediate vicinity of the athletics facility at which the sports official was an active participant.

Status: 1/30/2001 introduced. Referred to Senate Committee on Rules. 2/1/2001 referred to Senate Committee on Judiciary.

*Indiana H 2057 (Author: Klinker)

Athlete agents. Regulates athlete agents. Requires a person who acts as an athlete agent to hold a permit issued by the secretary of state. Allows the secretary of state to issue a permit to persons who meet certain requirements, including the posting of a bond. Imposes Class A misdemeanor penalties on persons who act as an athlete agent without a permit. Specifies certain requirements for agent contracts. Requires athlete agents and student athletes to notify the student-athlete's institution within 72 hours after executing an agent contract or before the student athlete participates in or practices for an intercollegiate competition. Specifies conditions under which an athlete-agent permit may be revoked or suspended. Provides causes of action under which an institution of higher learning may recover damages caused by an athlete agent or a student-athlete, or both.

*Kansas H 2126 (Author: Boston)

Sports officials. Establishes the crime of battery against a sports official. Imposes class B misdemeanor penalties on violators.

*Louisiana H 62 (Author: Faucheux)

Tickets. Eliminates the prohibition against selling such tickets for an amount in excess of the ticket price. Permits any municipality or local political subdivision to enact ordinances restricting or prohibiting the resale of tickets within a limited area of the location of the event.

*Massachusetts H 1578 (Author: Hall)

Tickets. Regulates the resale of tickets. Establishes the office of entertainment ticket seller and reseller licensing, enforcement and public protection. Prohibits ticket scalping, except for certain individuals and groups. Establishes licensing scheme for resale ticket brokers.

Status: 1/3/2001 introduced.

*Massachusetts H 1941 (Author: Rogers)

Tickets. Prohibits the resale of any ticket for more than $2 in excess of the price printed on the ticket within an area officially designated by and located upon the premises of such event.

*Massachusetts S 508 (Author: Lees)

Anabolic steroids. Regulates the use of anabolic steroids.

Status: 1/3/2001 introduced. Referred to Joint Committee on Health.

Maryland H 876 (Author: Rosenberg)

Sports officials. Amends the definition of athletics officials as it applies to immunity from civil actions, under certain circumstances.

Status: 2/9/2001 introduced.

*Michigan S 96 (Author: Jaye)

Coaches' salaries. Prohibits an institution of higher education from paying a coach of an athletics team an annual salary in excess of the annual salary of the governor.

Status: 1/31/2001 introduced.

Mississippi H 53 (Author: Chism)

High-school extracurricular/academic standards. Prohibits students who fail to maintain an average of 70 or higher in academic classes, other than honors classes, from participating in extracurricular activities. Requires that the suspension from extracurricular activities be at least three weeks in duration and cease after the student achieves at least a 70 average in each class during the suspension period.

Mississippi H 343 (Author: Reeves)

High-school extracurricular/home school. Authorizes local school districts to permit home-school students to participate in extracurricular activities. Requires the home-school student to reside within the attendance boundaries of the school in which the student is seeking registration.

Mississippi H 750 (Author: Watson and Eads)

Mississippi S 2230 (Author: Harden)

Athletics facilities. Prohibits the Mississippi Veterans Memorial Stadium Commission from charging Jackson State University any fee for the use of the stadium at athletics events when the university is the home or visiting team.

Sports officials/workers' compensation. Expands the exemption from coverage under the workers' compensation act to include officials employed at all amateur athletics events.

*Nebraska L 843 (Author: Brashear)

Sports officials. Creates criminal offenses for assault or battery upon a sports official. Prescribes felony penalties.

*Nevada AJR 2 (Author: Perkins)

Gambling. Urges Congress to refrain from enacting a measure to repeal the exemption that permits Nevada to license and regulate sports wagering on college sporting events.

*New York A 1316 (Author: Brodsky)

Athletics facilities. Creates a New York sports facilities authority, which will have exclusive authority and responsibility over state investment in sports related capital projects, and which is charged with preserving and expanding opportunities across New York state for sports events, facilities, and franchises.

Status: 1/16/2001 introduced. Referred to Assembly Committee on Tourism, Arts and Sports Development.

*New York A 2325/S 445 (Authors: McLaughlin/Maltese)

Performance-enhancing drugs. Makes it an unlawful practice for any retailer to sell or offer for sale the drug androstenedione, commonly known as andro, without a prescription.

*New York A 3436/S 2027 (Authors: Lentol/Santiago)

Liability. Provides that recovery for certain injuries or wrongful death arising out of voluntary participation in athletics shall be diminished by the percentage of culpable conduct attributable to the injured party or decedent.

*New York A 4350/S 1663 (Authors: Gromack/Larkin)

Internet gambling. Requires foreign corporations providing gambling or wagering over the Internet to file for authorization to do business in the state with the secretary of state. Requires the foreign corporation to state explicitly its intention to provide gambling or wagering.

*New York S 1224 (Author: Maziarz)

Sports officials. Makes the intentional causing of physical injury to a sports official a class D felony of assault in the second degree. Creates class B misdemeanor offense for aggravated harassment of a sports official when a person, with intent to annoy, harass, threaten or alarm a sports official, strikes or spits on such official.

North Dakota H 1054 (Author: Maragos)

Sports gambling. Excludes from the definition of gambling any lawful contest in which the entrant makes decisions based on the entrant's knowledge of the skill, speed, strength or endurance of others, and in which the reward is made only to entrants or to the owners of entries.

*Oregon H 2823 (Author: Witt)

Internet gambling. Punishes unlawful Internet gambling by a maximum imprisonment of one year, a $5,000 fine, or both. Imposes class C felony penalties on an unlawful Internet gambling business. Provides that all credit card debts arising through unlawful Internet gambling by any person within the State are void and uncollectible.

*Rhode Island H 5778/S 415 (Author: Carter/Izzo)

Athlete agents. Regulates athlete agents. Requires an athlete agent to register annually with the office of higher education. Limits athlete agent contact with student-athletes. Provides a list of prohibited acts. Permits institutions of higher education to pursue a civil action for damages resulting from unlawful actions of an athlete agent. Imposes criminal misdemeanor penalties on an athlete agent who violates the Act. Provides for a civil penalty of up to $10,000. Exempts attorneys licensed in the state from registering as an athlete agent provided the attorney retains an active policy of professional liability insurance.

*South Carolina H 3304/S 193 (Authors: Harrison/Giese)

*South Carolina S 3326 (Author: Wilder)

Athletic trainers. Proclaims the month of March 2001, as National Athletic Training Month in the state. Recognizes the athletic training profession and its importance in maintaining quality health care.

*Tennessee H 360 (Author: Buck)

Athlete agents. Exempts a Tennessee licensed attorney from the requirement of registering for a permit to act as a sports agent under the state's existing athlete-agent law.

Status: 1/31/2001 introduced.

*Tennessee S 1375 (Author: Jackson)

Recruitment of students. Creates an offense for an adult under certain circumstances to receive anything of value in exchange for the adult coercing, influencing or persuading or attempting to coerce, influence or persuade a minor to make a particular decision regarding the institution of higher education the minor will attend. Declares that violation of the Act shall be graded as theft and punished pursuant to the applicable state statute.

*Texas H 1357/S 627 (Authors: Berman/Staples)

Athletics fee. Permits the University of Texas System to impose an intercollegiate athletics fee on each student enrolled at the University of Texas at Tyler. Requires that the fee can only be imposed by a majority vote of the students at the university participating in a general student election. Sets limits on the amount of the fee. States that the fee may be used to develop and maintain the intercollegiate athletics program at the university.

Athlete agents. Amends existing law regulating athlete agents. Provides for reciprocal athlete-agent registration. Adds additional items to the list of required disclosures in the agent application. Provides for reciprocal renewal registration. Requires a notice provision in each athlete agent contract. Enables an institution of higher education to pursue a civil action against an athlete agent for damages as a result of the agent's violation of the Act.

Sports officials/assault. Modifies the state's criminal code by imposing criminal class A misdemeanor penalties against those committing an assault against a sports official.

Athlete agents. Creates the Uniform Athlete Agents Act, a model state law developed by the National Conference of Commissioners on Uniform State Laws and endorsed by the NCAA and its membership. Establishes a uniform set of rules regulating athlete agents. Requires athlete-agent registration with a specified state agency. Provides for reciprocal registration with those states that have substantially similar registration requirements. Contains a detailed application process providing consumer information. Establishes requirements for agency contracts between student-athletes and athlete agents. Lists a number of prohibited acts. Permits specified state agency to issue subpoenas for any material that is relevant to the administration of the act. Imposes criminal, civil and/or administrative penalties for violations of the act. Provides for a civil action by an educational institution against an athlete agent or a former student-athlete for damages caused by a violation of the Act.

Amateurism. Expresses the strong opposition of the General Assembly to the National Collegiate Athletic Association's pending amateurism deregulation proposals.

Athletic trainers. Creates the Washington Athletic Trainer's Act. Requires certification with the department of health before an athletic trainer can represent him or herself as a certified athletic trainer. Establishes application process. Authorizes secretary of health to establish standards and approval for educational programs in athletic training. Requires applicant to successfully complete an approved examination.
