Following are interpretations issued by the Interpretations Subcommittee of the Division II Legislation Committee and approved by the Division II Management Council.

No. 1 Definition of Institutional Staff Member

The unethical-conduct provisions set forth in NCAA Bylaw 10.1 applicable to institutional staff members include any individual who performs work for the institution or the athletics department, even if the individual is a student at the institution (for example, student manager, student trainer) and/or does not receive compensation from the institution for performing such services (for example, volunteer coaches, undergraduate assistant coaches and graduate assistant coaches). No. 2 Definition of Practice -- Transfer Exceptions

The subcommittee reviewed Bylaws 14.5.4.3.1, 14.5.4.3.2, 14.5.5.3.7, 14.5.5.3.8, 14.5.5.3.9, 14.5.5.3.10, 14.5.6.1-(c) and 17.02.1.1 and determined that a student-athlete who participated in countable athletically related activities, other than practice [as defined in Bylaw 17.02.1.1-(a)] and competition would be eligible to use the appropriate exceptions set forth in Bylaws 14.5.4.3 (exceptions or waivers for transfers from two-year colleges), 14.5.5.3 (exceptions or waivers for transfers from four-year colleges) and 14.5.6.1 (exceptions). No. 3 Use of Ergometers for Conditioning Activities in the Sport of Women's Rowing

The subcommittee determined that an ergometer (that is, a rowing machine) is not considered equipment related to the sport of rowing. Therefore, in the sport of rowing, any use of an ergometer during required conditioning activities that may occur during the academic year outside the playing and practice season is not limited to the two hours of permissible skill-instruction activities. No. 4 Calculation of Practice Sessions During Spring Football Practice Period

The subcommittee confirmed that during the spring football practice period, it is not permissible for student-athletes to engage in more than 20 hours of countable athletically related activities per Bylaw 17.02.1 (including conditioning activities and review of game film) during a given week. Further, all countable athletically related activities shall be prohibited during one calendar day per week. An institution, however, is not required to count as one of its 15 designated days any day during which countable athletically related activities are limited solely to required conditioning and weight-training activities. No. 5 Countable Aid -- Out-of-State Tuition Waivers

An institution may exempt an out-of-state tuition waiver from individual and institutional limits when a student-athlete receives an award based in any degree on athletics ability and another institutional grant only if the student-athlete would have been awarded the out-of-state tuition waiver had the athletically-related grant not been awarded. No. 6 Institution Contracting with an Outside Entity to Develop and Produce Day Planners

An institution may outsource the production of a day planner (that is permissible pursuant to 2001 Proposal No. 40) in the event the institution does not have an on-campus printing center and the institution develops the content, layout and design and only outsources the production (for example, printing and binding). [Reference: 2001 Proposal No. 40.]

Management Council interpretation

The following interpretation was issued by the Division II Management Council:

Transportation to Enroll

An institution may provide transportation from the nearest bus or train station or major airport to the campus on the occasion of the student-athlete's initial arrival at the institution to attend classes, including the student-athlete's initial arrival to attend classes in a summer term.
