Following are legislative drafts of interpretations issued by the Interpretations Subcommittee of the Legislation Committee and approved by the Management Council. These were recommended by the Legislation Committee for incorporation into the Division II Manual. This recommendation has been approved by the Management Council and President Council. The items that have not yet been reviewed in legislative form are marked with an asterisk.
The page numbers in the proposals refer to the 2000-2001 NCAA Division II Manual.

*No. 1 Representatives of an Institution's Athletics Interests -- Corporate Entities
Constitution:
Amend 6.4, pages 48-49, as follows:"6.4 Responsibility for Actions of Outside Entities
"6.4.1 Independent Agencies or Organizations. An institution's "responsibility'' for the conduct of its intercollegiate athletics program shall include responsibility for the acts of an independent agency or organization, including corporate entities (for example, apparel and equipment companies), when a member of the institution's executive or athletics administration, or an athletics department staff member, has knowledge that such agency or organization is promoting the institution's intercollegiate athletics program.
"6.4.2 Representatives of Athletics Interests. An institution's "responsibility'' for the conduct of its intercollegiate athletics program shall include responsibility for the acts of individuals when a member of the institution's executive or athletics administration has knowledge or should have knowledge that such an individual:
"(a) Has participated in or is a member of an agency or organization, including corporate entities (for example, apparel and equipment companies), as described in Constitution 6.4.1;"

Bylaws:
Amend 13.02.10, page 74, as follows:"13.02.10 Representative of Athletics Interests. Representative of Athletics Interests. A "representative of the institution's athletics interests" is an individual who is known (or who should have been known) by a member of the institution's executive or athletics administration to:
"(a) Have participated in or to be a member of an agency or organization, including corporate entities (for example, apparel and equipment companies), promoting the institution's intercollegiate athletics program;"

Immediately.**No. 2 Recruiting -- Tryouts -- Local Sports Clubs
Bylaws:
Amend 13.12.2.4, page 92, as follows:"13.12.2.4 Local Sports Clubs. In sports other than basketball, an institution's coach may be involved as a participant or in instructional or coaching activities in the same sport for a local sports club or organization located in the institution's home community, provided all prospects participating in said activities are legal residents of the area (within a 50-mile radius of the institution). Further, in club teams involving multiple teams or multiple sports, the 50-mile radius is applicable only to the team with which the institution's coach is involved; however, it is not permissible for the coach to assign a prospect who lives outside the 50-mile area to another coach of the club. A coach may be involved with a local sports club located in the institution's home community that includes prospects participating in a sport other than the coach's sport, regardless of where such prospects reside. A coach also may be involved in activities with individuals who are not of prospect age (that is, before the ninth grade), regardless of where such individuals reside."

Amend 14.2.4.2.1, page __, as follows:"14.2.4.2.1 Academic Year in Residence. An individual who utilizes a season(s) of competition per 14.2.4.2, shall fulfill an academic year in residence at the certifying institution before being eligible to represent the institution in intercollegiate competition."

Immediately.**No. 4 Financial Aid -- Academic Honors Awards
Bylaws:
Amend 15.5.2.2.1, page 153, as follows:"15.5.2.2.1 Exception. Academic honor awards that are part of the institution's normal arrangements for academic scholarships, awarded independently of athletics interests and in amounts consistent with the pattern of all such awards made by the institution are exempt from a Division II institution's equivalency computation, provided:
"(a) The recipient was ranked in the upper 20 percent of the high-school graduating class or achieved a cumulative grade-point average of at least 3.500 (based on a maximum of 4.000) or a minimum ACT sum score of 100 or a minimum SAT score of 1,050 (if taken before April 1, 1995) or 1140 (if taken on or after April 1, 1995). An institution may exempt an academic honor award from both individual and institutional equivalency limits if the recipient qualifies for the award under minimum institutional criteria and satisfies any of the criteria set forth in 15.5.2.2.1-(a), regardless of whether the institution considered any of the qualifying criteria in making the award; or
"(b) The recipient does not qualify under (a) and has completed at least one academic year in college and achieved a cumulative grade-point average of 3.300 (on a 4.000 scale) for all academic work completed during the student's collegiate enrollment resulting in degree credits at the awarding institution."

Immediately.**No. 5 Financial Aid -- Multisport Participants
Bylaws:
Amend 15.5.3 by adding new 15.5.3.1, page ___, as follows:"15.5.3 Multisport Participants.
"15.5.3.1 Multisport Participant Receiving Athletically Related Institutional Aid. An institution shall divide countable athletically related aid equally among all sports in which the student-athlete participates in instances when the financial aid agreement does not specify how such aid should be counted toward institutional limits."
Bylaws: Amend 15.5.3 by adding new 15.5.3.2, page ___, as follows:
"15.5.3 Multisport Participants.
"15.5.3.2 Multisport Participant Receiving Nonathletically Related Institutional Aid. An institution shall divide nonathletically related institutional aid in the same proportion that athletically related aid is divided for purposes of the institutional limits in the sports in which the student-athlete participates."

Bylaws:
Amend 30.11.3, pages 305-306, as follows:"30.11.3 Football. The following contact and evaluation periods apply to football in Division II:
"(a) June 1 to the beginning of the prospect's high-school or two-year college football season (as determined by the first regularly scheduled practice immediately preceding the start of the regular season): Quiet Period
"(b) During the prospect's high-school or two-year college football season (as determined by the first regularly scheduled practice immediately preceding the start of the regular season): Evaluation Period
"(c) November 1 through November 30 [except for (1) below]: Evaluation Period
"(1) For two-year college prospects, the conclusion of the prospect's two-year college football season through November 30: Contact Period
"(d) December 1 through 30 days after the Saturday after the initial date for signing the National Letter of Intent [except for (1) below}: Contact Period
"(1) During the period 48 hours before 7 a.m. on the initial date for signing the National Letter of Intent: Dead Period
"(e) The 31st day after the Saturday after the initial date for signing the National Letter of Intent through April 30: Quiet Period
"(f) May 1 through May 31: Evaluation Period
"(g) The following is an exception to the Division II football recruiting calendar: Authorized coaching staff members may evaluate a high-school football all-star game any time of the year provided the game occurs within the state in which the member institution is located."
