Modification of wording

Pursuant to NCAA Constitution 5.4.1.1.1, the NCAA Division I Management Council has determined that the following proposal is consistent with the intent of the membership in adopting the original legislation and that sufficient documentation and testimonies exist to establish clearly that the original wording of the legislation was inconsistent with that intent. The Management Council, by a two-thirds majority of its members present and voting, shall have the authority to recommend intent-based legislation, subject to ratification by the NCAA Division I Board of Directors. Any proposal ratified by the Board shall be effective as of the date identified in the proposal and published in The NCAA News. Those new items that the Management Council reviewed and approved in legislative form are marked with an asterisk.

No. 1 (revised) Eligibility of Championships -- Automatic Qualification

Intent: To clarify that in sports other than men's basketball, any new member added to a conference that maintains continuity of membership shall not represent the conference as the automatic qualifier until it has been a member of Division I for at least the two preceding academic years; further, to specify that in the sport of men's basketball, any new member added a to conference that maintains continuity of membership shall not represent the conference as the automatic qualifier until it has been a member of Division I for at least the eight preceding academic years.

A. Bylaws: Amend 31.3.4.2, page 407, as follows:

"31.3.4.2 Additional Requirements, Sports Other Than Men's Basketball. To be considered eligible for automatic qualification, a member conference (including a single-sport conference) must include six core institutions that satisfy continuity of membership. For the purposes of this legislation, core refers to an institution that has been an active member of Division I the eight preceding years. Further, the continuity-of-membership requirement shall be met only if a minimum of six core institutions have conducted conference competition together in Division I the preceding two years. There shall be no exceptions to the two-year waiting period. Further, when any new member added to a conference that is satisfying the continuity of membership requirements, that new member shall not represent the conference as the automatic qualifier until it has been a Division I member for at least two preceding academic years."

B. Bylaws: Amend 31.3.4.3, pages 407-408, as follows:

"31.3.4.3 Additional Requirements, Men's Basketball. The member conference must include seven core institutions that satisfy continuity of membership to be considered for automatic qualification in men's basketball. For the purposes of this legislation, core refers to an institution that has been an active member of Division I the eight preceding years. Further, the continuity-of-membership requirement shall be met only if a minimum of six core institutions have conducted conference competition together in Division I the preceding five years in men's basketball. There shall be no exception to the five-year waiting period. Further, any new member added to a conference that is satisfying the continuity of membership requirements shall not represent the conference as the automatic qualifier until the institution satisfies the requirement for a core member (i.e., active member of Division I for eight years)."

Intent: To clarify that in sports other than men's basketball, the continuity-of-membership requirement shall be met only if a minimum of six-core institutions have conducted conference competition together in Division I the preceding two years in the applicable sport; further, to clarify that an Division I active member, a provisional member or a member in the process of reclassifying to Division I as of September 1, 1999, that is classified as a core member prior to September 1, 2003, shall remain a core member subsequent to September 1, 2003, even if the institution has not been an active Division I member for eight years.

A. Bylaws: Amend 31.3.4.2, page 407, as follows:

"31.3.4.2 Additional Requirements, Sports Other Than Men's Basketball. To be considered eligible for automatic qualification, a member conference (including a single-sport conference) must include six core institutions that satisfy continuity of membership. "(b) Prior to September 1, 2003, the eight-year core principle does not apply to an institution that was a Division I active member, provisional member or a member in the process of reclassifying to Division I as of September 1, 1999. Such an institution would be subject to the provisions in effect on September 1, 1999. The institution may continue to be considered a core institution subsequent to September 1, 2003, even if the institution has not been an active member of Division I the eight preceding years."

B. Bylaws: Amend 31.3.4.3.2, page 408, as follows:

"31.3.4.3.2 Exceptions.

"(b) Prior to September 1, 2003, the eight-year core principle does not apply to an institution that was a Division I active member, provisional member or a member in the process of reclassifying to Division I as of September 1, 1999. Such an institution would be subject to the provisions in effect on September 1, 1999. The institution may continue to be considered a core institution subsequent to September 1, 2003, even if the institution has not been an active member of Division I the eight preceding years."
