Acting for the Division I Management Council, the Academics/Eligibility/Compliance Cabinet Subcommittee on Legislative Review/Interpretations issued the following interpretation:
Financial Aid/Initial Counters/Men's Basketball
Application of NCAA Proposal No. 01-119.
The subcommittee issued the following interpretations related to the application of Proposal No. 01-119:a. Effective August 1, 2003, the application of the NCAA Bylaw 15.5.4.1 (that is, the initial-counter legislation) is not contingent on the number of initial counters awarded by the institution during the 2002-03 academic year (that is, the slate is wiped clean beginning August 1, 2003).
b. An institution may qualify for an additional initial counter to be awarded during the 2003-04 academic year if the number of initial counters who graduate and depart the institution's team or depart the institution making appropriate progress to graduate within five years of initial full-time collegiate enrollment exceeds the number of initial counters either during the 2001-02 or the 2002-03 academic years. The subcommittee noted that a student-athlete who enrolled at the certifying institution before the 2001-02 academic year may be considered an initial counter based on the current definition set forth in Bylaw 15.02.3.1.
c. In determining whether an additional initial counter may be awarded in a given year, the institution shall count a student-athlete who graduated only if the student-athlete will not be returning to participate as a member of the institution's team. A student-athlete with remaining eligibility who graduates, but will continue participating on the team as a graduate student, shall be counted (in determining whether an additional initial counter may be awarded) during the year in which the student-athlete exhausts eligibility to participate in intercollegiate basketball competition.
