The NCAA News

Following are the minutes of the October 18-19 meeting of the Division III Management Council at the Hyatt Regency in Atlanta. All actions taken by the Management Council are included. Highlights of the meeting were reported in the November 8 issue of The NCAA News.

1. Announcements. John S. Biddiscombe, chair, reviewed the schedule and announced that a new Management Council member, Susan Bassett, would join the group on Tuesday, October 19.

2. Review of Roster, Future Meeting Schedule and Division III Newsletter. The Management Council reviewed its roster, Division III Newsletter and the future meeting schedule, noting a change in the dates for its October 2000 Management Council meetings to October 25-26, 2000.

3. Previous Minutes. The Management Council reviewed the minutes of its July 25-26, 1999, meeting; the August 5, 1999, Presidents Council meeting; the August 6, 1999, Executive Committee meeting; and the August 31, 1999, Administrative Committee teleconference.

It was voted that the minutes of the Management Council's July 25-26, 1999, meeting as amended; and the August 31, 1999, Administrative Committee teleconference Nos. 2 and 3 be approved.

4. Division III Strategic Planning. The Management Council recommended that the Presidents Council approve the Division III values, goals and priorities for 1999-00.

5. Committee/Subcommittee Reports.

a. Association-Wide Committees.

(1) Committee on Competitive Safeguards and Medical Aspects of Sports. The Management Council:

(a) Recommended that the committee discuss with the National Athletic Trainers Association (NATA) the feasibility of a survey or other vehicle to gain greater feedback on the impact of the proposed certification changes on Division III campuses. The survey could include:

i. Staffing coverage on Division III campuses.

ii. Impact of recreation and sports clubs for NATA coverage (state-by-state focus may be necessary).

(b) Recommended a 2001 NCAA Convention session to discuss impact of proposed NATA changes on Division III institutions.

(2) Honors Committee. The Management Council received an oral report on the work of the committee.

(3) Minority Opportunities and Interests Committee. The Management Council accepted the information as presented and noted that the Women of Color Summit was rescheduled to November 9, 1999. The Council also encouraged immediate development of a directory of current ethnic minority individuals as a resource for NCAA member institutions and conference offices.

(4) National Youth Sports Program Committee. The Management Council received an oral report on the work of the committee.

(5) Olympic Sports Liaison Committee. The Management Council received an oral report on the work of the committee.

(6) Postgraduate Scholarship Committee. The Management Council accepted the information regarding policies governing the eligibility of part-time postgraduate students, as requested by the Council in July.

(7) Research Committee. The Management Council received an oral report on the work of the committee.

(8) Committee on Sportsmanship and Ethical Conduct. The Management Council accepted the amended generic public address announcement to broaden the language and the committee's position to retain the term ÒsportsmanshipÓ in its title, as requested by the Council in July.

(9) Walter Byers Scholarship Committee. The Management Council received an oral report on the work of the committee.

(10) Committee on Women's Athletics. The Management Council:

(a) Deferred the recommendation to sponsor legislation to exempt the emerging sport of women's bowling from the requirement that a minimum of 40 institutions sponsor the sport in order for a championship to be established until its April 2000 meeting, noting:

n Support for the concept of establishing a bowling championship and its positive impact on minority participation.

n Adoption of 2000 NCAA Convention Proposal No. 2-58 would reduce the minimum period for meeting sports sponsorship in order to establish an NCAA championship from two years to one year.

n Requested that the committee promote the sport of bowling in an effort to increase sponsorship.

n Requested that the Committee on Women's Athletics provide updated sponsorship information at the Council's April meeting.

(b) Referred the issue of whether the NCAA should be responsible for the development of rules and officiating clinics in the sports of women's volleyball and men's and women's soccer to the Division III Championships Committee for further review, with input from applicable sports committees. Areas for review should include:

n Budget impact for the Association (for example, staffing, publishing and operating expenses).

n Impact on existing associations that currently are responsible for rules development.

(c) Accepted the information regarding a recent Title IX backlash by the media and various entities, supporting the development of a two-year educational campaign to dispel some of the myths regarding Title IX, provide accurate and truthful information about the law and promote the positive results that have occurred.

(d) Accepted information regarding the committee's review of the emerging-sport guidelines and the recommendation to add language, effective immediately, to require that emerging-sport proposals include information on general championship rules and format for the sport.

(e) Accepted the information regarding the ÒNCAA Summit on Athletics Opportunities for Minority WomenÓ that will be jointly hosted by the Committee on Women's Athletics and the Minority Opportunities and Interests Committee on November 9, 1999. The summit will address the lack of female minority representation of student-athletes, coaches and administrators in sport.

(f) Accepted the information regarding the continuing need to address the marketing, licensing and promotions issues outlined in the audit report of the NCAA Executive Committee's Ad Hoc Committee on Issues Related to Gender Equity and Diversity. The Council noted with concern that Host Communications, Inc., no longer has a woman in its leadership structure charged with addressing women's issues.

(g) Accepted information regarding the recommendation that the fall 2000 deadline for institutions to submit the EADA report be moved from October 15 to November 15.

b. Management Council Subcommittees.

(1) Academic Issues Subcommittee. The Management Council recommended that the subcommittee strictly adhere to the 60-day legislative criteria (NCAA Bylaws 14.1.6.2.1.3 and 14.1.7.3) for student-athletes who are beyond their fourth year of academic work.

(2) Administrative Review Subcommittee. The Management Council approved the subcommittee's actions on 11 appeals from June 1 through August 31, 1999.

(3) All-Star Contests Certification Subcommittee. The Management Council received an oral report of the work of the subcommittee, and noted that NCAA 2000 Convention Proposal No. 51 (2-40) was sponsored by the Presidents Council for a vote of the Division III membership.

(4) Convention Planning Subcommittee. The Management Council recommended that the Presidents Council:

(a) Approve the 2000 NCAA Convention schedule for Division III and remove the separate topic of ÒviolenceÓ from the Division III Forum on Sunday January 9, due to time constraints.

(b) Possibly include ÒviolenceÓ as a topic for discussion at the 2001 NCAA Convention.

(c) Schedule conference calls for November and December to finalize speakers and schedule.

(d) Recommend that the Division III budget and the possible impact of new resources be addressed at the 2000 NCAA Convention as part of the strategic-planning update.

(5) Playing and Practice Seasons Subcommittee. The Management Council:

(a) Recommended the Presidents Council approve sponsorship of proposed legislation for the 2001 NCAA Convention to amend Bylaws 17.8.6.1.1 (fencing), 17.12.6.1.1 (gymnastics), 17.15.6.1.1 (rifle), 17.16.6.1.1 (women's rowing) and 17.17.6.1.1 (skiing) to eliminate summer workout sessions consistent with other Division III sports.

(b) Referred the following issues to the Division III Interpretations and Legislation Committee for review:

i. Contest limitations:

n Dates of competition versus contests for all Division III sports, particularly the sport of lacrosse.

n Treating all national collegiate sports more consistently with all other Division III sports relative to playing and practice seasons legislation (for example, contest limits, start dates and overall playing seasons).

n Tournament exemptions in baseball and softball to create more consistency in their application.

n Exempted contests against foreign teams for consistency in all Division III sports.

n Scrimmage exemptions for consistency in all Division III sports.

ii. Standardization of playing and practice season start dates:

n Concluding the nontraditional segment in all sports prior to the first date of final exams, as opposed to the last date of final exams.

n A standardized, consistent start date of October 15 for all winter sports.

n A standardized, consistent start date of February 1 for all spring sports.

c. Division III Committees.

(1) Budget Committee. The Management Council reviewed the Division III budget-to-actual report and future potential expenditures.

(2) Championships Committee. The Management Council:

(a) Reviewed the automatic-qualification summary and noted:

i. Communication between the Championships and Membership Committees is critical relative to conference status and automatic-qualification process (for example, Middle Atlantic States, Commonwealth and Freedom Conferences). The chairs of the Championships and Membership Committees should be copied on all correspondence relative to conference status and conference-related automatic-qualification decisions.

ii. The Council expressed concern regarding a recent Division III memorandum sent by a sports committee that stated ÒIt is strongly recommended that games be completed the Saturday before selections to allow both the regional and national committees adequate time to conduct the selection process.Ó The Council noted that the recommendation to complete games by the Saturday before NCAA selections was opposed by the Championships Committee.

(b) Received information regarding the committee's review of the site-selection process, with a report to the Management Council in April 2000 and recommended that the Championships Committee:

i. Simplify the preliminary-bid form and make specific reference to the new Division III automatic-qualification process.

ii. Review the NCAA championship date for women's soccer and softball compared to the corresponding men's dates, which permit one additional week to conclude the regular season and conference championships.

(3) Financial Aid and Awards Committee. The Management Council:

(a) Recommended that the Presidents Council endorse the recommendation to provide a copy of the Division III Manual to the Office of Financial Aid/Enrollment Management Office at member institutions and request the committee submit the request for 2000-01 funding by the February 15 deadline.

(b) Endorsed the distribution of a membership survey of Division III financial aid practices and recommended:

n Distribute a survey (for example, Ò1997Ó version) that includes a general statement of current legislation before each question along with an educational cover memo encouraging broad input and collaboration.

n Mail survey to chief executive officers requesting signatures by CEO and financial aid officer, with copies of cover memo only to director of athletics, faculty athletics representative and senior woman administrator.

n Deadline for return -- December 10, 1999.

n Utilize Division III video conference on December 3 to remind membership of survey submission deadline.

(4) Committee on Infractions. The Management Council endorsed the redefinition of prospective student-athlete in principle and referred it to the Division III Interpretations and Legislation Committee for review.

(5) Interpretations and Legislation Committee. The Management Council:

(a) Recommended that the Presidents Council approve recommended Phase I deregulation for Bylaw 31 (deleting all references to Divisions I and II).

(b ) Approved the following interpretation, and requested publication in NCAA legislative database, The NCAA News Legislative Assistance Column and the Division III Newsletter:

ÒInvolvement of Institution's Coach and Two-Year College Prospect in Sanctioned Summer Baseball Leagues. (III) An institution's baseball coach may not coach an NCAA-funded summer baseball league team that has a team member who is a two-year college prospective student-athlete, inasmuch as the league is not considered competition that is organized and administered by the applicable governing body or athletics authority in accordance with Bylaw 13.12.3.4. [References: Bylaws 13.12.3.4 (state, regional, national or international training programs); 30.14.2 (summer baseball Ñ eligibility for participation); official interpretation, 01/29/98, Item No. 1; and an official interpretation of the previous NCAA Interpretations Committee, 11/28/94, Item No. 2.]Ó

(c) Approved the following interpretation, and requested publication in NCAA legislative database, The NCAA News Legislative Assistance Column and the Division III Newsletter:

i. ÒCalculating Practice Opportunities. (III) Division III institutions should count backward from the institution's first scheduled regular-season intercollegiate contest when utilizing the practice opportunity formula in determining the first permissible preseason practice date in those sports that use the practice-opportunity formula. In the sports of football and soccer, it is not permissible to count backward from the permissible preseason scrimmage(s) when calculating the first permissible preseason practice date. [References: Bylaws 17.02.11.1 (practice opportunities), 17.10.2.2 (first practice date Ñ Division III football), 17.10.5.2-(i) (annual exemptions Ñ Division III preseason scrimmage), 17.18.2 (preseason practice Ñ Division III soccer) and 17.18.5.1.1 (scrimmages/exhibition games Ñ Division III soccer).]Ó

ii. The Management Council agreed to broaden the interpretation to apply the principle for all sports that use the practice-opportunity formula in determining the first permissible preseason practice date. ÒIt is not permissible to count backwards from the permissible preseason scrimmage when calculating the first preseason practice date.Ó

(d) Approved the editorial revision to Bylaw 17.13.5.3-(i) to permit an institution to exempt two women's ice hockey contests against the U.S. women's national team during the season leading up to the 2002 Winter Olympics.

(6) Membership Committee. The Management Council:

(a) Approved the Empire Athletic Conference as a voting member conference.

(b) Approved the athletics consortium request from Emerson College and Massachusetts College of Liberal Arts, per Constitution 3.1.2.

(c) Approved the reclassification of Wilkes University's wrestling program from Division I to Division III effective immediately (1999-00 academic year).

(d) Approved the sponsorship of intent-based legislation to amend Constitution 3.6 to specify that the final two years of provisional membership must be completed consecutively.

(e) Approved the sponsorship of noncontroversial legislation to amend Constitution 3.6.4 to indicate that a provisional member may repeat a provisional year or years only one time during its provisional membership period. One year must elapse before reapplication.

(f) Unanimously supported the committee's recommendation to require New York City Technical College to repeat its first year of provisional membership.

(g) Unanimously supported the committee's recommendation to require Piedmont College to repeat its first year of provisional membership.

(h) Accepted the information regarding sending reminder letters to all Division III institutions (in addition to the 59 institutions as of September 1 that did not meet the five-sport/three-season requirement) to educate the membership regarding the increased minimum sports sponsorship requirement, effective August 1, 2001.

(i) Encouraged the committee to consider formalizing a process to apply to institutions not meeting the August 1, 2001, increased sports sponsorship requirements.

(j) Recommended the following revisions to the provisional member process and annual report:

i. Recommended a place to indicate the submission date on the provisional member annual report.

ii. Recommended the creation of a checklist to assist the staff and provisional members with the submission of a complete annual report.

(7) Nominating Committee. The Management Council recommended that the Presidents Council approve the appointments to the following committees:

(a) Division III Management Council Ñ William Eng, Baruch College; Christopher Bledsoe, New York University; Lon Boike, Clarke College; Kathryn Springsteen, Colby-Sawyer College, reelection.

(b) Division III Championships Committee Ñ Brad Bankston, Old Dominion Athletic Conference.

(c) Division III Financial Aid and Awards Ñ Lori Kerans, Millikin University; Terry Ruppert, Wilmington College (Ohio).

(d) Division III Interpretations and Legislation Committee Ñ Garnett Purnell, Wittenberg University.

(e) Division III Membership Committee Ñ Donna Ledwin, New Jersey Athletic Conference; Kay Whitley, Sul Ross State University.

(f) Division III Nominating Committee Ñ David Markee, University of Wisconsin, Platteville; Bob Williams, Swarthmore College.

(g) Division III Student-Athlete Advisory Committee Ñ Amy Ashbrock, Wilmington College (Ohio); Marcelle Roberson, Springfield College.

(h) Division III Student-Reinstatement Committee Ñ Mary Jo Gunning, Marywood University.

The Management Council also:

(i) Retained the requirement for one chief executive officer on the Nominating Committee, but endorsed sponsorship of a noncontroversial legislative proposal to delete the requirement that the chief executive officer must be a current or former member of the Management Council.

(j) Approved the distribution of a survey to identify gender and ethnic diversity in Division III as a component and follow-up to the January 11, 2000, Convention discussion on gender and diversity.

(8) Student-Athlete Advisory Committee. The Management Council received an oral report on the work of the committee.

(9) Student-Athlete Reinstatement Committee. The Management Council received an oral report on the work of the committee.

6. NCAA Legislation.

a. Review of Legislation Submitted by the Division III Membership for the 2000 Convention. The Management Council recommended that the Presidents Council:

(1) Take no position on Proposal No. 52 (2-43) Ñ Minimum Amount of Competition.

(2) Take no position on Proposal No. 87 (2-44) Ñ International Competition Ñ Summers, and requested the staff to contact the sponsors for clarification of rationale relative to Bylaw 30.7.1 requirements.

(3) Support Proposal No. 53 (2-46) Ñ Two-year College Transfer Ñ Two-year Nonparticipation Exception.

(4) Oppose Proposal No. 54 (2-54) Ñ Maximum Contest Limitations Ñ Student-Athlete Ñ Basketball, Field Hockey and Soccer.

b. Review of Proposed Legislation Sponsored by the Division III Presidents Council for the 2000 Convention. The Management Council recommended that the Presidents Council:

(1) Defer the decision to continue support of Proposal No. 57 (2-59) Ñ National Collegiate Championship Ñ Women's Ice Hockey, to its January pre-Convention meeting, requesting staff discussion and articulation of the details of the legislative proposal.

(2) Approve a proposed legislative grouping for membership voting, and the related identification of speakers.

c. Review of Noncontroversial Legislation Adopted by the Management Council per NCAA Constitution 5.3.1.1.1 for the 2000 Convention. The Management Council approved the sponsorship of the following noncontroversial legislation:

(1) To amend Bylaw 21.8.1.3 to specify that if an interim vacancy occurs and a committee member has equal to or more than one-half of a term remaining, then that committee member may be replaced on the committee by another representative of the same conference or institution only for the remainder of that term.

(2) To amend Bylaw 21.8.4 to specify that committee members shall recuse themselves from voting on issues that directly involve their institution, playing conference or another member of their conference.

(3) To separate the Division III Committee on Infractions and Student-Athlete Reinstatement Committee into two separate committees and to delete the reference to general public member on the Student-Athlete Reinstatement Committee.

(4) Draft legislation to amend Bylaw 21.8.6.1 to specify that at least one member of the Division III Membership Committee shall be a chief executive officer, one member shall be a faculty athletics representative and one member shall be a senior woman administrator; further, to specify that the committee shall coordinate educational activities for the Division III membership.

(5) Draft legislation to amend Bylaw 21.8.6.5.1 to specify that one member of the Legislation and Interpretations Committee shall be a faculty athletics representative and one member shall be a conference administrator.

(6) To amend Bylaw 21.8.7.11 to expand the Division III Women's Golf Committee from four members to five members.

(7) To amend Bylaws 17.5.4 and 17.13.4 to establish the conclusion of the Division III championships for basketball and ice hockey as the end of the regular playing season (as opposed to the Division I championship).

d. Review of Editorial Revisions Approved by the Management Council per Constitution 5.4.1.1.1. The Management Council approved a draft legislative editorial revision to amend Bylaw 17.21.1.1 to change all ÒswimmingÓ references in the Division III Manual to Òswimming and diving.Ó

7. Litigation Update. The Management Council reviewed a litigation update prepared by the NCAA general counsel.

8. NCAA Public Affairs Plan. The Management Council received an update on the Association's plan. An update to the Division III membership will occur at the 2000 NCAA Convention.

9. Policy Governing Participation in Media Interviews, Public Forums and Other Media Activities. The Management Council approved the updated policies and principles to be included in the NCAA committee handbook.

10. Committee/Subcommittee Assignments. The Management Council approved the following representatives to serve on Division III and Association-wide committees:

a. Division III Committees.

11. Acknowledgement of Management Council Chair-Elect and Vice-Chair-Elect. The Management Council congratulated its new chair, Walter Johnson, director of athletics, North Central College, and subsequent to the meeting its new vice-chair, Joy L. Reighn, director of athletics, Rowan University. Terms will commence at the close of the NCAA Convention.

12. Other Business. NCAA President Cedric W. Dempsey provided the Management Council an update on significant NCAA Association-wide issues, including:

a. Rights fee negotiations.

b. Gambling.

c. Marketing, licensing and promotions process.
