Following is the report of the meeting of the Division I Management Council April 10-11 at the NCAA national office in Indianapolis. All actions taken by the Management Council are included. Highlights of the meeting were reported in the April 10 issue of The NCAA News.

7. NCAA President's Report.

FYI: Received a report of key issues, including baseball bats, South Carolina's use of the Confederate flag, gambling legislation and recent communication with the NABC Board of Directors.

FYI: Received a report from NCAA legal counsel concerning current litigation involving the Association.

9. Federal Relations Report.

MC ACTION: Received a report on key Congressional and governmental activities of concern to the NCAA.

10. Cabinet Reports.

a. Report of the February 1-3, 2000, Championships/Competition Cabinet Meeting.

MC ACTIONS: Received a report of the February 1-3, 2000, Championships/Competition Cabinet meeting and took the following actions:

(1) Division I budget requests from the Championships/
Competition Cabinet in priority order.
Received a report from the chair of the cabinet regarding the following budget priorities:

(a) Recommendation that the preliminary round game(s) of the Division I Men's Basketball Championship be treated as an official part of the tournament.

(b) Recommendation that four-team National Collegiate Women's Ice Hockey and Women's Water Polo Championships be established, effective with the 2000-01 academic year.

(c) Recommendation that the number of individuals in the regional qualifying tournaments of the Division I Women's Golf Championships be increased from 252 to 321; that the number of qualifying tournaments be increased from two to three; and that all eligible conferences receive automatic qualification into the regional tournaments.

(d) Recommendation that the Division I Men's Soccer Championship bracket be expanded from 32 to 48 teams.

(e) Recommendation that the squad sizes for the following women's championships be increased:

i. Field hockey: from 20 to 22 student-athletes.

ii. Women's gymnastics: from 13 to 15 student-athletes.

iii. Women's soccer: from 18 to 22 student-athletes.

iv. Women's softball: from 18 to 20 student-athletes.

v. Women's volleyball: from 12 to 15 student-athletes.

(f) Recommendation that the National Collegiate Women's Lacrosse Championship bracket be expanded from 12 to 16 teams.

(g) Recommendation that the Division I Men's Ice Hockey Championship be expanded from 12 to 16 teams.

(h) Recommendation that the Division I Men's Lacrosse Championship bracket be expanded from 12 to 16 teams.

(i) Recommendation that the Division I Men's and Women's Tennis Championships be extended by one day (from nine to 10 days).

(j) Recommendation that the diving qualifying meets of the Division I Men's and Women's Swimming and Diving Championships be extended by one day (from two to three days).

(k) Recommendation that the Association reimburse transportation expenses for teams participating in preliminary-round games (previously called play-in games) of NCAA team championships.

(l) Recommendation that a small replica of the championship trophy be given to all student-athletes who participate in an NCAA championship, including participants in regional competition of individual-team championships.

(m) Recommendation that the first- and second-round sessions of the Division I Women's Basketball Championship be conducted at 16 predetermined sites (with four teams each) at the earliest opportunity.

(n) Recommendation that the teams participating in the finals of the Division I Women's Volleyball Championship and the Women's College World Series receive one additional day per diem.

(o) Recommendation that the Management Council propose legislation to increase the size of the men's subcommittee of the Division I Men's and Women's Tennis Committee from six to eight members.

(2) Discussion of men's soccer bracket expansion.

(a) Noted that the Division I Budget Subcommittee had not recommended funding to expand any men's championship brackets.

(b) Considered a request that the men's soccer bracket be expanded to at least 40 teams, 48 if funding is available.

(c) Recommended that the Board reallocate funding from championships or other sources to expand the men's soccer bracket to 40 teams, for a cost of $100,000; and noted that expansion of the men's soccer bracket was the No. 2 priority of the cabinet, which could be funded in part by the additional day of per diem for women's volleyball and softball (Priority No. 12 -- $45,000). (Unanimous voice vote.) [See also the budget discussion, Item No. 14-c-(1)-(f) below.]

(3) Association-wide budget requests in priority order. Received a report regarding the following budget priorities:

(a) Recommendation that funds be allocated from the 2000-01 Association-wide budget to establish a nine-member NCAA Women's Volleyball Rules Committee.

(b) Recommendation that funds be allocated from the 2000-01 Association-wide budget to establish an officiating-improvement program in the sport of women's volleyball.

(c) Recommendation that funds be allocated from the 2000-01 Association-wide budget to upgrade the Injury Surveillance System over the next two years.

(4) Division I Men's and Women's Outdoor Track and Field Championships.

(a) Reviewed a recommendation that a regional qualifying system be implemented and that the number of participants be increased from 388 men and 388 women to 544 men and 544 women, effective with the 2002 championships.

(b) Noted that a regional qualifying system could increase the access of minorities to the championship, expressed concern about committing funding now for the 2001-02 budget and agreed that the cabinet should continue reviewing possible implementation and inclusion in budget requests for 2001-02.

(5) Committee on Competitive Safeguards and Medical Aspects of Sports. Requested that NCAA staff draft legislation for review in October that would permit the staff liaison to the Sports Medicine Advisory Board of the National Federation of State High School Associations to fill the competitive-safeguards committee position allocated for secondary school interests on an ongoing basis as an ex officio, voting member of the committee. (Unanimous voice vote.)

b. Academics/Eligibility/Compliance Cabinet.

(1) Report of February 16-17, 2000, meeting.

MC ACTIONS: Accepted the report of the February 16-17, 2000, Academics/Eligibility Compliance Cabinet and took the following actions:

(a) Summer baseball leagues. Approved the following allocation of funds provided by Major League Baseball to several summer baseball leagues as recommended: (Unanimous voice vote.)

Atlantic Collegiate Baseball League -- $25,000

Cape Cod Baseball League -- $95,000

Central Illinois Collegiate League -- $43,000

Coastal Plain League -- $20,000

Great Lakes Summer Collegiate League -- $38,000

New England Collegiate Baseball League -- $33,000

Northeastern Collegiate Baseball League -- $33,000

Valley Baseball League -- $48,000

(b) Review of initial-eligibility standards. Agreed to request the Board of Directors to use the appropriate subcommittees and cabinets within the NCAA governance structure in formulating permanent initial-eligibility standards. (Unanimous voice vote.)

(2) Minutes of Subcommittee on Legislative Review/Interpretations.

MC ACTION: Approved the minutes as submitted. (Unanimous voice vote.)

(3) Presentation concerning amateurism recommendations and the time line for consideration.

FYI: Rescheduled the presentation for the July meeting.

11. Second Review of Legislative Proposals Related to Basketball.

MC ACTIONS:

Preliminary discussion regarding the proposals.

* Received a report from Gene Smith, chair of the Management Council Subcommittee to Review the Basketball Working Group Report, regarding the reasons for establishing the Working Group in 1998, the process followed since the Management Council's and Board of Directors' October 1999 meetings and various communications with the commissioners, presidents and membership.

* Received a report from NCAA President Cedric W. Dempsey regarding his strong support for three elements of the basketball reform package and the Board of Directors' expectation that the president provide leadership on key issues.

* Received a report from Elsa Kircher Cole, NCAA general counsel, regarding the possible legal risks associated with some proposals and research data on the academic performance of student-athletes in various sports.

* Discussed concerns expressed about the process for reviewing the basketball proposals, including use of the full Management Council, input from the membership, the timing of the recommendations offered by the NCAA president and the role of the Board in influencing the outcomes.

Actions taken on the proposals.

a. Proposal No. 99-120-A -- Summer Financial Aid -- Division I Basketball. Intent: To permit a Division I institution to provide athletically related financial aid to a prospective basketball student-athlete to attend the institution's summer term prior to the prospective student's initial, full-time collegiate enrollment, provided he or she is enrolled in a minimum of six hours of academic course work that is acceptable degree credit toward any of the institution's degree programs. [Source: NCAA Division I Working Group to Study Basketball Issues.]

FYI: Proposal rendered moot by approval of Proposal No. 99-120-C.

b. Proposal No. 99-120-B (98-75) -- Financial Aid -- Summer School. Intent: In Division I, to permit an institution to award athletics aid to a student to attend an institution's summer term before the student's initial, full-time collegiate enrollment; further, to limit the recipient to not more than four additional summer terms of athletics aid. [Source: Southeastern Conference.]

MC ACTION: Defeated the proposal. (For 16.5, against 31.5, not present 3.) [See Vote No. 2.] (Before defeating the proposal, the Management Council amended the proposal to increase the minimum enrollment hours from five to six, preclude the use of physical education activity courses and change the effective date to August 1, 2000.) (Unanimous voice vote.)

c. Proposal No. 99-120-C -- Summer Financial Aid -- Division I Basketball. Intent: To permit a Division I institution to provide athletically related financial aid to a prospective basketball student-athlete to attend the institution's summer term before the prospective student's initial, full-time collegiate enrollment, provided he or she is enrolled in a minimum of six hours of academic course work (other than physical education activity courses) that is acceptable degree credit toward any of the institution's degree programs. [Source: Big Ten Conference.]

MC ACTIONS:

(1) Amended the proposal to change the effective date to August 1, 2000, for the summer of 2001. (For 41.5, against 6.5, not present 3.) [See Vote No. 3.]

(2) Gave final approval and forwarded the proposal to the Board for adoption as amended. (For 32.5, against 15.5, not present 3.) [See Vote No. 4.] (Effective date: August 1, 2000, for the summer of 2001.)

(3) Clarified that a maximum of five summers of aid could be awarded, that this proposal is to allow a five-year study regarding the impact on graduation rates for basketball student-athletes and that initial enrollment in six hours satisfies the intent of the legislation, although this issue will be monitored and reviewed as necessary by a committee responsible for basketball issues.

Student-Athlete Advisory Committee position: Supported the proposal, but preferred Proposal No. 99-120-B.

d. Proposal No. 99-121-A -- Financial Aid -- Division I Basketball -- Overall Counters. Intent: To establish an incentive-based financial aid model in which overall financial aid limits in the sport of Division I men's basketball shall be determined based on each institution's average four-year graduation rate in that sport, as specified. [Source: NCAA Division I Working Group to Study Basketball Issues.]

MC ACTION: Defeated the proposal. (For 6.5, against 41.5, abstain 1, not present 2.) [See Vote No. 7.]

Student-Athlete Advisory Committee position: Opposed the proposal.

e. Proposal No. 99-121-B (99-83) -- Division I Financial Aid Limitations -- Counters. Intent: In Division I, to continue to include a student-athlete in the institution's maximum award limitations (as set forth in NCAA Bylaws 15.5.2, 15.5.3, 15.5.4 and 15.5.5) for a specified period of time, if the student-athlete departs the team and would not have been eligible for intercollegiate competition had the student remained on the team. [Source: Southeastern Conference.]

MC ACTION: Defeated the proposal. (For 8, against 40, abstain 1, not present 2.) [See Vote No. 5.]

Student-Athlete Advisory Committee position: Opposed the proposal.

f. Proposal No. 99-121-C -- Financial Aid Limitations -- Division I Men's Basketball. Intent: In Division I, to continue to include a student-athlete in the institution's maximum award limitations in the sport of men's basketball for a specified period of time, if the student-athlete departs the institution and would not have been eligible for intercollegiate competition had the student remained at the institution. [Source: Big Ten Conference.]

MC ACTION: Defeated the proposal. (For 10, against 39, not present 2.) [See Vote No. 6.]

Student-Athlete Advisory Committee position: Opposed the proposal.

g. Proposal No. 99-121-D -- Financial Aid -- Division I Men's Basketball -- Overall Counters. Intent: To permit a Division I institution that achieves a graduation rate of 75 percent or higher in the sports of men's basketball to receive one additional counter (i.e., annual total of 14) in that sport. [Source: Pacific-10 Conference.]

MC ACTION: Defeated the proposal. (For 6, against 43, not present 2.) [See Vote No. 8.]

Student-Athlete Advisory Committee position: Opposed the proposal.

h. Proposal No. 99-122-A -- Financial Aid -- Initial Counters -- Division I Men's Basketball. Intent: To establish a limit of four on the number of initial counters in the sport of Division I men's basketball. [Source: NCAA Division I Working Group to Study Basketball Issues.]

MC ACTION:

(1) Amended the proposal to establish a limit of eight initial counters in men's basketball during any two consecutive years, with a limitation of five initial counters during any given year. (For 41.5, against 7.5, not present 2.) [See Vote No. 9.]

(2) Amended the proposal to specify that institutions that do not provide athletically related financial aid are not subject to the initial-counter limitations. (Unanimous voice vote.)

(3) Gave final approval and forwarded the proposal to the Board for adoption as amended. (For 36, against 13, not present 2.) [See Vote No. 10.] (Effective date: August 1, 2001.)

Student-Athlete Advisory Committee Position: Expressed concern that four initial counters per year is not sufficient when the number of graduates and players leaving due to transfer and professional draft may be more than four.

i. Proposal No. 99-122 - B -- Financial Aid -- Initial Counters -- Division I Men's Basketball. Intent: To establish a limit of four on the number of initial counters in the sport of Division I men's basketball and to exclude from such limits any student-athlete (recruited or nonrecruited) who is receiving financial aid that is certified by the financial aid office as having been granted without regard in any degree to athletics ability. j. Proposal No. 99-123 -- Initial-Eligibility -- Nonqualifiers -- Financial Aid -- Division I Basketball. Intent: To permit entering freshman student-athletes (men and women) in the sport of Division I basketball who are nonqualifiers to receive athletically related financial aid during the first academic year. [Source: NCAA Division I Working Group to Study Basketball Issues.]

MC ACTION: Defeated the proposal. (For 12.5, against 35.5, not present 3.) [See Vote No. 1.]

Student-Athlete Advisory Committee position: Supported the proposal, recognizing that it increases opportunities for the educationally less fortunate and that since the aid would count in team limits, coaches would select nonqualifiers who have a potential of succeeding academically.

k. Proposal No. 99-124-A -- Continuing Eligibility -- Division I Basketball. Intent: To require entering freshman student-athletes in the sport of Division I basketball to successfully complete a minimum of 12 hours by the conclusion of the student-athlete's first term of enrollment that are acceptable toward the student-athlete's degree program and achieve a minimum grade-point average of 2.000 in such credit hours. [Source: NCAA Division I Working Group to Study Basketball Issues.]

MC ACTION: Defeated the proposal. (For 4, against 45, not present 2.) [See Vote No. 12.]

Student-Athlete Advisory Committee position: Opposed the proposal.

l. Proposal No. 99-124-B -- Continuing Eligibility -- Division I Basketball. Intent: To require entering freshman student-athletes in the sport of Division I basketball to successfully complete a minimum of 12 hours by the conclusion of the student-athlete's first term of enrollment and achieve a minimum grade-point average of 2.000 based on all work taken at the conclusion of the student-athlete's first term of full-time enrollment; further, to clarify that prerequisites for specific courses acceptable for any degree credit may be used in meeting the minimum 12-hour requirement, provided such courses are acceptable for any degree program at the certifying institution [Source: Big Ten Conference.]

MC ACTION: Defeated the proposal. (For 6, against 43, not present 2.) [See Vote No. 11.]

Student-Athlete Advisory Committee position: Supported the proposal.

m. Proposal No. 99-125-A -- Eligibility -- Midyear Transfers -- Division I Basketball. Intent: To specify that all midyear transfers in the sport of men's and women's basketball shall not be eligible for intercollegiate competition until the ensuing academic year. [Source: NCAA Division I Working Group to Study Basketball Issues.]

MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (For 30.5, against 18.5, not present 2.) [See Vote No. 13.] (Effective date: August 1, 2000; for those student-athletes first entering the certifying institution on or after August 1, 2000.)

n. Proposal No. 99-125-B -- Transfer Eligibility -- Division I Basketball. Intent: To specify that all midyear four-year college transfers in the sport of Division I basketball shall be eligible for competition no earlier than the ensuing academic year; further to specify that a two-year college transfer in the sport of Division I basketball who is not a qualifier must spend an academic year in residence before being eligible for intercollegiate basketball competition. [Source: Pacific-10 Conference.]

o. Proposal No. 99-125-C -- Transfer Eligibility -- Division I Basketball. Intent: To specify that all midyear four-year college transfers in the sport of Division I basketball shall be eligible for competition no earlier than the ensuing academic year; further to specify that all two-year college transfers in the sport of Division I basketball must satisfy an academic year in residence prior to being eligible for intercollegiate basketball competition. p. Proposal No. 99-126-A -- Playing and Practice Seasons -- Division I Basketball. Intent: To establish Friday after Thanksgiving as the first permissible date on which Division I institutions are permitted to engage in any regular-season basketball competition (other than the permissible exhibition contests, certified events and Preseason NIT); further, to establish the first permissible on-court practice date as 34 days prior to the first regular-season contest date; finally, to establish 21 days after the first permissible on-court practice date as the first opportunity for participation in preseason exhibition contests and establish the first date for participation in a certified basketball event as seven days prior to the first regular-season contest date. [Source: NCAA Division I Working Group to Study Basketball Issues.]

MC ACTION: Defeated the proposal. (For 1, against 46, not present 4.) [See Vote No. 14.]

q. Proposal No. 99-126-B -- Playing and Practice Seasons -- Division I Basketball. Intent: To establish Friday before Thanksgiving as the first permissible date on which Division I institutions are permitted to engage in any regular-season basketball competition (other than the permissible exhibition contests, certified events and Preseason NIT); further, to establish the first permissible on-court practice date as 30 days before the first regular-season contest date; finally, to establish 21 days after the first permissible on-court practice date as the first opportunity for participation in preseason exhibition contests and establish the first date for participation in a certified basketball event as seven days before the first regular-season contest date. [Source: Pacific-10 Conference.]

MC ACTION: Defeated the proposal. (For 20.5, against 26.5, not present 4.) [See Vote No. 15.]

r. Proposal No. 99-127 -- Support Services -- CHAMPS/
Life Skills Program.
Intent: To specify that all Division I institutions shall be required to conduct NCAA CHAMPS/Life Skills programs (or an equivalent program) on its campus for all student-athletes. [Source: NCAA Division I Working Group to Study Basketball Issues.]

MC ACTIONS:

(1) Confirmed and clarified in the rationale statement that the life skills program needed to be available to all student-athletes, but did not require participation by all student-athletes.

(2) Gave final approval and forwarded the proposal to the Board for adoption. (For 38, against 10, not present 3.) [See Vote No. 16.] (Effective date: August 1, 2000.)

s. Proposal No. 99-128-A -- Recruiting Calendar -- Division I Men's Basketball. Intent: To revise the Division I men's basketball recruiting calendar as follows: [Source: NCAA Division I Working Group to Study Basketball Issues.]

A. Permit men's basketball coaches to contact prospective men's basketball student-athletes for 18 days within a 30-day period beginning the Thursday after Labor Day.

B. Establish a contact period Friday following the NCAA Division I Men's Basketball Championship game through nine days following the initial signing date for the spring signing of the National Letter of Intent.

[Note: This change would be accompanied by a request to the National Letter of Intent steering committee to alter the date for signing the spring National Letter of Intent from May 15 to May 1.]

C. Reduce the current July evaluation period from 24 to 14 days. The 14 days shall be selected at the discretion of the institution and designated in writing in the office of the director of athletics.

D. Increase the evaluation days during the academic year evaluation period from 40 to 50.

E. Establish a 10-day period (Wednesday through Sunday the last weekend in April and the first weekend in May) during which time men's basketball coaches may evaluate prospective student-athletes during their junior year in high school. During such time period, coaches would be permitted to engage in limited conversation with prospective basketball student-athletes in the presence of the high-school coach.

F. Permit Division I institutions to make one telephone call per prospect during the 10-day period beginning the Monday after Mother's Day of the prospect's junior year in high school (in lieu of one of the calls permitted between June 21 and July 31).

FYI: Proposal rendered moot by approval of Proposal No. 99-128-B.

t. Proposal No. 99-128-B -- Recruiting Calendar -- Division I Men's Basketball. Intent: To revise the Division I men's basketball recruiting calendar as follows: [Source: Big Ten Conference and Southeastern Conference.]

A. Eliminate the summer evaluation period.

B. Increase the number of evaluation days during the academic year evaluation period from 40 to 70.

C. Permit coaching staff members to evaluate only basketball activities and events approved, sanctioned, sponsored or conducted by the applicable state high-school association, national federation of state high-school associations or national junior college athletic association (other than contests that are part of the prospect's normal high-school, preparatory school or two-year college season).

D. Increase the time period for making contacts during the fall.

E. Eliminate all contacts or evaluations following the conclusion of nonscholastic basketball events.

MC ACTIONS:

(1) Defeated a motion to table the proposal. (For 17.5, against 32.5, not present 1.) [See Vote No. 17.]

(2) Noted that a delayed effective date would allow sufficient time for the interested groups to prepare for and establish an appropriate replacement recruiting calendar for implementation before the 2002 summer.

(3) Amended the proposal to change the effective date to August 1, 2001, and to modify the intent and rationale statements to indicate that the current summer evaluation period would be replaced, rather than eliminated. (For 36, against 14, not present 1.) [See Vote No. 18.]

(4) Agreed that the rationale for the proposal included a direction that the group considering the replacement of the summer evaluation period as presently constituted should consider the needs of: prospective student-athletes who are recruited in the fall of their senior year in high school; enrolled student-athletes, particularly freshmen and their need for college coaches to be on campus in the fall; and all Division I institutions to have balanced access to basketball prospective student-athletes. (For 35, against 13, abstain 2, not present 1.) [See Vote No. 19.]

(5) Noted that the group reviewing the new recruiting calendar should have clear representation requirements, report to the Management Council and consider input from the conferences.

(6) Defeated an amendment to change the 70 evaluation days in men's basketball during the academic year to 40. (For 7.5, against 42.5, not present 1.) [See Vote No. 20.]

(7) Gave final approval and forwarded the proposal to the Board for adoption as amended. (For 28, against 22, not present 1.) [See Vote No. 21.] (Effective date: August 1, 2001.)

u. Proposal No. 99-128-C -- Recruiting Calendar -- Division I Men's and Women's Basketball. Intent: To revise the Division I men's and women's recruiting calendar as follows: [Source: Pacific-10 Conference.]

A. Permit men's basketball coaches to contact prospective men's basketball student-athletes for 18 days within a 30-day period beginning the Thursday after Labor Day.

B. Establish a contact period Friday after the NCAA Division I Men's Basketball Championship game through nine days after the initial signing date for the spring signing of the National Letter of Intent.

v. Proposal No. 99-128-D -- Recruiting Calendar -- Division I Men's Basketball. Intent: To revise the Division I men's basketball recruiting calendar as follows: [Source: Pacific-10 Conference.]

A. Permit men's basketball coaches to contact prospective men's basketball student-athletes for 18 days within a 30-day period beginning the Thursday after Labor Day.

Intent: To revise the current women's basketball recruiting calendar as follows: to permit institutional coaching staff members to place one telephone call to a prospect [or the prospect's parents or legal guardian(s) between April 24 and May 15 of the prospect's junior year in high school and three calls from June 21 through July 31 (with no more than one telephone call per week). Intent: To revise the current Division I football recruiting calendar as follows: (a) to expand the spring evaluation period from April 15 through May 31 to permit four weeks of evaluation (Monday through Saturday) selected at the discretion of the institution; (b) to permit two evaluations per prospect during the spring evaluation period (one evaluation to assess the prospect's athletics ability and one evaluation to assess the prospect's academic qualifications); (c) to reduce the number of fall evaluations days from nine to six; and (d) to modify the winter contact period to provide for a total of 42 contact days (six contact weeks Sunday through Saturday) and reduce from seven to six the number of contacts per prospect during the period. MC ACTION: Approved a 4.1 percent inflationary adjustment to one of the alternatives for satisfying Division I financial aid minimums based on the most recent average tuition fee changes for four-year institutions, effective August 1, 2001. This would result in the following new minimums: Financial aid representing a minimum aggregate expenditure of $729,000 (with at least $364,500 in women's sports) in 2001-02, exclusive of grants in football and men's and women's basketball provided the aggregate grant value is not less than the equivalent of 38 full grants, with at least 19 full grants for women. If the institution does not sponsor men's or women's basketball, the minimum aggregate expenditure must be $481,500 in 2001-02 for the gender without the basketball program, but in no case fewer than the equivalent of 29 full grants for that gender. (Unanimous voice vote.)

c. Committee on Women's Athletics.

MC ACTIONS:

(1) Female participation in NCAA championships. Noted the committee's recommendation that the number of postseason opportunities for men and women in all NCAA divisions be equalized within the next five years, with special emphasis being placed on the expansion of championship opportunities for minority female student-athletes, and that the equalization of postseason opportunities be achieved before any new championships opportunities for men are funded.

(2) 2000-01 budget requests. Deferred action, until consideration of the budget report, on the following budget requests for the 2000-01 budget [See Item No. 14-c-(2) below]:

d. Minority Opportunities and Interests Committee.

(1) Approved the recommendation to change the policies and procedures of the Administrative Review Subcommittee to allow the student-athlete reinstatement staff to cast the tie-breaking vote in the event of a tie and to prohibit ex parte communication between institutional representatives and committee members about a pending case. c. Division I Budget Subcommittee.

MC ACTIONS:

(1) Division I budget discussion items.

(a) Reviewed a report from the Division I Budget Subcommittee containing recommendations to the Board regarding allocations for Division I championships.

(b) Noted that this report was formulated after review of the funding priorities of the Championships/Competition Cabinet and the recommendations from the NCAA staff, which suggested a short-term goal for the 2000-01 budget and championships emphasizing continued expansion of championship opportunities for Division I female student-athletes until female championship participation is at least 50 percent.

(c) Requested that the Board seek and consider recommendations from the Management Council and Championships/ Competition Cabinet before establishing long-term goals for Division I championships funding. (Unanimous voice vote.)

(d) Agreed that a portion of the Management Council July meeting should be devoted to a discussion of the budgeting process and philosophy regarding championship expansion.

(e) Recommended that the Board reallocate funding from championships or other sources to expand the men's soccer bracket to 40 teams, for a cost of $100,000; and noted that expansion of the men's soccer bracket was the No. 2 priority of the cabinet, which could be funded in part by the additional day of per diem for women's volleyball and men's baseball (Priority No. 12 -- $45,000). (Unanimous voice vote.)

(f) Noted that expanding the men's soccer bracket to 40 teams would reduce the number of required play-in games and recommended that the Board reallocate funding from championships or other sources for the remaining play-in games, which primarily occur in women's field hockey, soccer and softball. (Unanimous voice vote.)

(g) Referred to the Championships/Competition Cabinet a revised recommendation received from the chair of the Women's Basketball Committee regarding predetermined sites for the first and second rounds of the Division I women's basketball tournament. (Unanimous voice vote.)

(2) Association-wide budget discussion items.

(a) Reviewed a report from the Executive Committee Budget Subcommittee regarding Association-wide budget allocations, including recommendations from Association-wide committees and several NCAA staff members.

(b) Supported funding for existing programs with a proven track record of success, rather than the establishment of new programs; and recommended that the Executive Committee allocate new funding for the Ethnic Minority and Women's Enhancement Programs and the NCAA Fellows Leadership Development Program and not provide new funding for YES clinics, as the current clinics should be used to encourage increased ethnic minority participation. (c) Recommended that the Executive Committee allocate new funding for the current NACWAA/HERS program. (Unanimous voice vote.)

d. Selection Review Committee.

d. Subcommittee to Review Automatic-Qualification Requirements.

MC ACTIONS:

(1) Conference core members. Amended the requirement for conference automatic qualification in men's basketball to seven core institutions, rather than eight. (For 35.5, against 13.5, not present 2.) [See Vote No. 44.]

(2) One-year grace period. Established a one-year grace period to permit any conference whose membership falls below seven core institutions, provided the conference maintains continuity of membership, to remain eligible for automatic qualification into the Division I Men's Basketball Championship. (3) Multidivisional members and single sport conferences. Confirmed that single-sport conferences in existence on September 1, 1999, fall under the grandparenting provision and that multidivisional institutions can be considered "core" in a program sponsored at the Division I level.

e. Governance Subcommittee.

MC ACTIONS:

(1) Lengthening time frame for comment period. Gave initial approve and circulated for comment a proposal, which would extend the comment period from 60 to 90 days for all legislative proposals initially approved by the Management Council and clarify that a membership comment period is not applicable when the Management Council supports emergency or noncontroversial legislation. (Unanimous voice vote.)

(2) Legislative impact statement. Adopted, as an administrative procedure, a requirement that all legislative proposals from conferences and cabinets/committees contain a legislative impact statement, including the impact on the time commitment of student-athletes, consistent with direction from the Board of Directors. (Unanimous voice vote.)

f. Membership Subcommittee.

MC ACTIONS:

(1) Membership waivers. Approved the following waivers: (Unanimous voice vote.)

(a) Division I scheduling requirements in the sport of cross country for the University of Evansville, which did not meet the 50 percent requirement in cross country during the 1999 season due to the cancellation of one meet and the fact that another meet included a majority of Division II institutions.

(b) Division I minimum contest requirements in women's swimming for the University of Georgia, which failed to compete in the minimum number of contests during the past year, to allow the university to receive an additional revenue distribution "credit."

(2) Elimination of NCAA district references. Gave initial approval and forwarded to the membership for comment legislation to delete NCAA Constitution 4.12, which would delete the specification of geographical districts and regions. (Unanimous voice vote.)

(3) NCAA affiliated membership and NCAA corresponding membership applications. Gave initial approval and forwarded to the membership for comment legislation to amend Constitution 3.4.3.3 and 3.5.3.3 to grant the NCAA president the authority to approve NCAA affiliated membership and NCAA corresponding membership applications. (Unanimous voice vote.)

(4) Notification deadline for subdivisional movement. Gave initial approval and forwarded to the membership for comment legislation to require a Division I-AA institution that wishes to change to Division I-A membership designation to notify the NCAA national office in writing not later than June 1, two years before the September 1 when the change would be effective. (Unanimous voice vote.)

(5) Membership moratorium.

(a) Noted that the overall growth in Division I during the past 2 1/2 years has escalated -- 11 institutions, from 310 to 321, compared to five institutions over the previous five-year period and an overall growth of approximately 10 percent since 1983. This recent trend has prompted concern about:

i. Division I's ability to ensure continuation of the quality of regionally and nationally competitive athletics programs.

ii. Ensuring a commitment to Division I philosophies and enhancement of provisional-member educational programs.

iii. Development of meaningful education/compliance programs for reclassifying institutions.

iv. An evaluation of whether current multidivisional classification criteria are consistent with the expected commitment to Division I programs.

(b) Noted that a significant number of nonmember institutions have expressed interest in joining Division I, II or III. A two-year moratorium is necessary in order to coordinate the continued development of the new Division I governance structure with the anticipated membership expansion of the NCAA.

(c) Noted that new Division I legislation may be considered during the next year that could impact subdivisional criteria in Division I (i.e., distinctions between requirements for membership in Division I-A, I-AA or I-AAA).

(d) Noted that Division I conducts conference, regional and national competition and championships at the highest possible skill level, which has significant community, regional and national following. Care should be taken to preserve the success enjoyed by Division I athletic programs by ensuring that Division I standards and philosophies are met and embraced by potential new members. Quality competition is absolutely necessary to preserve the quality product of amateur athletics.

(e) Noted that a two-year moratorium is proactive and will provide for establishment of a plan for systematic and manageable growth of the division.

(f) Gave final approval and forwarded to the Board as emergency legislation a proposal to establish a two-year NCAA membership moratorium applicable to institutions wishing to apply for Division I provisional membership, reclassify from Division II to Division I or becoming a multidivisional member with a Division I sport. (Unanimous voice vote.) [See Proposal No. 2000-37 for the full text of the legislation.]

(6) Division I-A football attendance requirements. Gave final approval and forwarded to the Board as emergency legislation a proposal to amend NCAA Bylaw 20.9.6.3 to specify that a Division I institution shall satisfy football attendance requirements only if it averages more than 17,000 in actual paid attendance for home contests in the immediate four-year period and to eliminate all exceptions/waivers to those requirements; further, to require actual use of a ticket sold at a regularly established ticket price in order to count the ticket in computing attendance figures; further, to require the institution's annual audit to verify attendance to be conducted by an outside firm and verified by the national office staff; and, finally, if an institution fails to meet the requirements, it shall be placed in restricted membership category for a maximum of three years. (Division I-A only: For 19, against 5, not present 3.) [See Vote No. 47.] [See Proposal No. 2000-36 for the full text of the legislation.]

15. Action that May be Required from the April 9, 2000, Division I-AA Football Governance Committee Meeting.

A. Proposal No. 99-61 -- Incidental Expenses -- Certified Bowl Games -- Division I. The committee supported the proposal, which would permit an institution to allocate $20 per day in incidental expense money to student-athletes who remain on-campus to practice for a postseason bowl game. (For 9, against 1, abstain 2.)

[Following this action, the full Management Council referred the proposal to the Championships/Competition Cabinet. See Item No. 12-f above.]

B. Proposal No. 99-104 -- Recruiting Calendar -- Division I-A and I-AA Football. C. Proposal No. 99-58-1 -- Eligibility for Division I Championship. The committee gave initial approval to the proposal which would, only in Division I-AA football, require an institution to meet the minimum scheduling requirements for a period of two years to be eligible to enter a team or an individual in the NCAA Division I-AA Football Championship. (For 6, against 2, abstain 4.)

D. Proposal No. 2000-15 -- Playing and Practice Seasons -- Weekly-Hour Limitations -- Division I-A Football. The committee gave initial approval to the proposal for Division I-AA football, which would permit student-athletes to view a maximum of two hours of game film per week as part of the permissible eight hours of required weight-training and conditioning activities that may occur during the academic year outside of the playing season. (For 9, against 2, abstain 1.)

E. Notification deadline for subdivisional movement. The committee requests that the Management Council limit the recommendation from the Membership Subcommittee, which would establish a notification deadline for subdivisional movement, to Division I-AA institutions interested in moving to Division I-A. (Unanimous voice vote.)

[Following this action, the Management Council gave initial approval to the legislation as recommended by the committee. See Item No. 14-g-(4) above.]

F. Survey regarding a low/non-scholarship Division I-AA Football Championship. The committee reviewed the survey results from information collected in 1998 regarding the level of interest in conducting a low or nonscholarship Division I-AA championship and took no action.

G. Continued review of an application for a preseason Division I-AA certified event. The committee reviewed a letter submitted by J.T. Thompson, the promoter of the NAACP/HBCU Kick-off Classic, a proposed preseason exempted event for Division I-AA football, informing the committee that a final report regarding the event, including the information requested by the committee in January, would not be available for two to three weeks. The committee noted that October 15 is the normal deadline for completed applications, that flexibility had already been provided as this is the first request for a Division I-AA event, and that for an event to occur during the 2000 preseason, the certification requirement must be satisfied by the end of this academic year.

The committee noted and agreed that April 28, 2000, is the final deadline for receiving the completed application, including the required letter of credit and confirmation that the specified travel expenses and guarantee will be provided. Any information received after this date will not be considered for certification for 2000. (Unanimous voice vote.)

16. Initial Review of Legislative Proposals.

a. Proposal No. 98-37 -- Amateurism -- Developmental Training Expenses. Intent: To allow currently enrolled student-athletes (as well as prospective student-athletes) to receive funding to cover actual and necessary developmental training expenses that are approved by the U.S. Olympic Committee (USOC) or appropriate national governing body (NGB). [Source: Academics/Eligibility Compliance Cabinet (Ivy Group).]

MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption as emergency legislation. (Unanimous voice vote.) (Effective date: Immediately.)
