A total of 76 proposals -- 44 in Division II and 32 in Division III -- are included in the Second Publication of Proposed Legislation for the 2001 Convention in Orlando, Florida.
The publication was mailed September 23 to the Divisions II and III memberships.
Included are 64 proposals produced from the division governance structures -- 38 sponsored by the Division II Presidents Council and 26 sponsored by the Division III Presidents Council.
Also included are six Division II proposals and six Division III proposals sponsored previously by the membership. Sponsors of those proposals were given an opportunity between August 15 and September 15 to change the proposals in any manner that is germane to the original proposals.
The Division II proposals include a six-proposal amateurism deregulation package developed by the Division II Amateurism Project Team and unanimously supported by the Division II Management and Presidents Councils. The package is designed to provide increased opportunities to athletes such as their ability to: (1) accept prize money based on place finish; (2) enter the draft and/or be drafted; (3) sign a contract for athletics participation; (4) accept pay for athletics participation; and (5) compete with professionals.
Division I also is considering an amateurism deregulation package, but it is not expected to be acted upon before April 2001.
The Division II proposals also include a five-proposal Bylaw 15 deregulation package that was developed by the Division II Legislation Committee.
Division III also will be considering a deregulation package. The NCAA Division III Interpretations and Legislation Committee developed a 14-proposal package that would deregulate legislation on institutional employees and their compensation. The package is designed to clearly state that personnel issues are to be handled through normal institutional channels rather than by NCAA legislation.
The Division III Presidents Council has approved the submission of these proposals to the membership as an "employment deregulation package." Thus, they will be voted on using a single vote unless a proposal is removed from the package.
Another important item among the Division III proposals is Proposal No. 2-49, which would simplify Division III financial aid legislation by deleting permissible financial aid awards given without consideration of need and the accompanying awards review process. Further, the proposal specifies that financial aid packaging for student-athletes must be consistent with packaging for students in general.
In addition, three proposals deal with championships, one that establishes 28 as the
minimum number of institutions that must sponsor a sport to create a Division III championship in an emerging women's team sport, and two others that establish Division III championships in women's ice hockey and women's rowing.
Amendments-to-amendments
The Second Publication of Proposed Legislation was mailed to chief executive officers, faculty athletics representatives, directors of athletics, senior woman administrators and compliance coordinators at Divisions II and III institutions. Conference commissioners also received copies.
From now until November 1, the Divisions II and III Presidents Councils can submit amendments to a proposal for the 2001 Convention.
Amendments also can be submitted by 15 active Division II member institutions (or two active conferences on behalf of 15 or more conference members) or eight active Division III member institutions (or one active conference on behalf of eight or more conference members).
Amendments-to-amendments at this stage of the legislative calendar must adhere to the traditional Association limitation -- they are not permitted to increase the change in legislation put forth in the circularized proposal.
Amendments-to-amendments must be received in the national office by 5 p.m. (Eastern time) November 1. No amendments-to-amendments may be submitted after that date, except that the Presidents Councils have the authority to submit amendments-to-amendments at the Convention if deemed necessary.
Forms for submitting amendments-to-amendments will be mailed with the Second Publication of Proposed Legislation to chief executive officers.
The Official Notice of the Convention, which will include all proposed legislation and properly submitted amendments-to-amendments, will be mailed to the Divisions II and III membership in November.
Following are the statements of intent for 64 new Divisions II and III proposals for the 2001 Convention that appear in the Second Publication of Proposed Legislation.
The list includes proposals produced from the Divisions II and III governance structures.

Division II legislative proposals
No. 2-1 Legislative Process -- Amendment-to-Amendment Requirements
Intent: To specify that amendment-to-amendments may be sponsored by one conference or eight active member institutions.

Activities Prior to
Initial Enrollment
Intent: To permit individuals to participate in certain activities prior to initial collegiate enrollment without jeopardizing eligibility and to specify that an individual may be charged with a season(s) of competition during each calendar year of participation in outside competition subsequent to high school graduation and prior to initial collegiate enrollment.

No. 2-4 Amateurism -- Educational Expenses
Intent: To permit individuals to accept educational expenses (i.e., tuition and fees, room and board and books) prior to collegiate enrollment from any individual or entity other than an agent, professional sports team/organization or representative of an institution's athletics interests, provided such expenses are disbursed directly through the recipient's educational institution (e.g., preparatory school, high school).

No. 2-5 Recruiting -- Telephone Calls
Intent: To permit an institution to make unlimited telephone calls to prospective student-athletes subsequent to the calendar day on which the prospect signed the institution's written offer of admission or financial aid, provided that date is not prior to the initial regular signing date for the National Letter of Intent program.

No. 2-6 Eligibility -- Restitution for
Receipt of Improper Benefit
Intent: To increase from $25 to $50 the dollar limit for which an institution does not have to declare an individual (i.e., prospective or enrolled student-athlete) ineligible and seek reinstatement when the individual receives an improper benefit, provided the individual repays the value of the improper benefit.

No. 2-13 10-Semester/15-Quarter Extension Request -- Eligibility for Practice
Intent: To permit a student-athlete who has exhausted his or her 10-semesters/15-quarters of eligibility to practice, but not compete, for 30 consecutive-calendar days provided the institution has filed a 10-semester/15-quarter extension request per NCAA Bylaw 30.6.1 with the NCAA national office.

Transfer Eligibility -- Two-Year Nonparticipation Exception
Intent: To modify the two-year college transfer legislation to permit a student-athlete to be immediately eligible at a Division II institution upon transfer, provided the student satisfies to provisions of the two-year nonparticipation exception applicable to "4-4" and "4-2-4" transfers.
