Management Council minutes
Following is a report of the October 18-19 meeting of the Division I Management Council at the Hyatt Regency in Atlanta. All actions taken by the Management Council are included. Highlights of the meeting were reported in the November 8 issue of The NCAA News.
1. Opening remarks.
2. Minutes of the July 26-27, 1999, Management Council meeting.

3. Division I Administrative Committee report on interim actions.

6. NCAA president's report.
MC ACTIONS:
7. Television negotiations and possible enhancement of the student-athlete experience.
a. Received a report of key issues including the progress of negotiations with television entities regarding broadcast and other media rights, and possible use of some of the new revenue to enhance the collegiate experience for student-athletes.
b. Directed the Management Council members of the Division I Budget Subcommittee to develop recommended priorities for assisting student-athletes if new funding becomes available, with a report to the Management Council in January.
7. Litigation update.
FYI: Received a written report from NCAA legal counsel concerning current litigation involving the Association.
8. Federal relations report.
MC ACTION: Received a report on key Congressional and governmental activities of concern to the NCAA, including NCAA comments on proposed rules to implement Student Right-To-Know Act and Equity in Athletics Disclosure Act federal reporting requirements.
9. Second review of legislative proposals initially approved by the Management Council at the July 26-27 meeting (including membership comment).
a. Proposal No. 98-60 (MC2) -- Housing and Meals Vacation --Period Expenses. Intent: To specify that an institution may provide room and board expenses for specific period of time to student-athletes who return to the institution's campus during a vacation period following institutional competition.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (For 44.5, against 4, not present 2.5.) [See Vote No. 1.]
b. Proposal No. 98-68 (MC2) -- Recruiting Competition Against Prospects. Intent: To prohibit Division I women's volleyball teams from engaging in competition against outside teams that include prospects, except for exempted contests against a foreign team or a U.S. national team.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (Unanimous voice vote.)
c. Proposal No. 98-104 (MC2) -- Playing and Practice Seasons -- Contest Limitations. Intent: To permit a Division I institution to exempt preseason exhibition contests against a four-year collegiate institution, other than a NCAA Division I institution, as an alternative to exempting contests against foreign teams in the United States and USA Basketball club teams, as specified.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (Unanimous voice vote.)
d. Proposal No. 99-2 (MC2) -- Outside Competition -- Division I Basketball. Intent: To specify that a basketball student-athlete must complete competition in an NCAA-sanctioned summer basketball league not later than August 31 or the institution's first day of classes, whichever is earlier.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (Unanimous voice vote.)
e. Proposal No. 99-5 (MC2) -- Incidental-Expense Waivers. Intent: To specify that an institution may provide a student-athlete a specific expense that has been previously approved by the NCAA Division I Management Council, as incidental to the student-athlete's participation in athletics (without submitting a formal waiver request to the national office).
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (Unanimous voice vote.)
f. Proposal No. 99-11 (MC2) -- Playing and Practice Seasons -- Division I Basketball Preseason Women's National Invitation Tournament. Intent: In the sport of women's basketball, to specify that the starting date for the Preseason Women's National Invitation Basketball Tournament (WNIT) shall be no sooner than seven days prior to the starting date for the regular season.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (For 43.5, against 5, not present 2.5.) [See Vote No. 2.]
g. Proposal No. 99-23 (MC2) -- Amateurism -- Awards. Intent: To permit a prospect's educational institution to receive a financial award in conjunction with the prospect being recognized as part of a program in which overall athletics participation, interests or ability is a criterion in the selection process.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (For 46.5, against 1, abstain 1, not present 2.5.) [See Vote No. 3.]
h. Proposal No. 99-24 (MC2) -- Advertisements and Promotions -- Championship Posters. Intent: To permit an institution that hosts an NCAA or conference championship to produce a poster promoting the championship and send it to a high-school coach and/or his or her educational institution.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (For 41.5, against 7, not present 2.5.) [See Vote No. 4.]
i. Proposal No. 99-26 (MC2) -- De Minimis Violations. Intent: To specify instances in which a de minimis violation will not render a student-athlete ineligible while retaining the fact that such a violation shall be an institutional violation.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (For 46.5, against 2, not present 2.5.) [See Vote No. 5.]
j. Proposal No. 99-30 (MC2) -- Financial Aid -- Board Allowance. Intent: To permit an institution, at its discretion, to provide a student-athlete receiving financial aid that covers the cost of meals with a board allowance that consists of three meals per day, even if the institution's maximum permissible board allowance for all students represents a lesser cost figure.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (For 39.5, against 8, abstain 1, not present 2.5.) [See Vote No. 6.]
k. Proposal No. 99-32 (MC2) -- Permissible Benefits -- Reasonable Refreshments. Intent: To permit an institution to provide its student-athletes with reasonable refreshments for student-athlete educational and business meetings and, on an occasional basis, for celebratory events.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (Unanimous voice vote.)
l. Proposal No. 99-33 (MC2) -- Women's Championships Sponsorship Criteria -- Minimum Period. Intent: To specify that a new championship may be established in a women's sport if the minimum number of sponsoring institutions exist for one academic year (rather than for two consecutive academic years).
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (For 47.5, against 1, not present 2.5.) [See Vote No. 7.]
m. Proposal No. 99-34 (MC2) -- Committee On Competitive Safeguards And Medical Aspects Of Sports -- Composition. Intent: To increase the size of the Committee on Competitive Safeguards and Medical Aspects of Sports from 15 to 16 members; further, to specify that one member of the committee must have expertise in the area of drug education.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (For 47.5, against 1, not present 2.5.) [See Vote No. 8.]
n. Proposal No. 99-35 (MC2) -- Division I Golf Committees -- Men's And Women's. Intent: To establish separate Division I men's and women's golf committees, as specified.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (Unanimous voice vote.)
o. Proposal No. 99-36 (MC2) -- Committees -- Women's Gymnastics Committee. Intent: To specify that the six member Women's Gymnastics Committee include five members from Division I and one member from Division II or III.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (For 43.5, against 0, abstain 5, not present 2.5.) [See Vote No. 9.]
p. Proposal No. 99-37 (MC2) -- Permissible Benefits -- NCAA Research Studies. Intent: To permit student-athletes to receive compensation for participation in specified NCAA research studies.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (For 44.5, against 4, not present 2.5.) [See Vote No. 10.]
q. Proposal No. 99-50 (MC2) -- Permissible Benefits -- Postseason Events. Intent: To permit Division I institutions to secure or reserve lodging at postseason events at a reduced or special rate for the parents (or legal guardians) and relatives of student-athletes participating in the event.
MC ACTIONS: (Unanimous voice vote.)
(1) Amended the proposal to specify that it would apply to parents (or legal guardians) and members of the student-athlete's immediate family, not all relatives.
(2) Clarified that the proposal applies only to NCAA postseason championships and bowl games, not to conference championships, and that it is not permissible for an institution to cover any portion of the cost of lodging, including any cost associated with reserving or securing lodging.
(3) Gave final approval and forwarded the proposal as amended (Proposal No. 99-50-1) to the Board for adoption.
r. Proposal No. 99-51 (MC2) -- NCAA Championships -- Minimum Sponsorship Criteria -- Men's And Women's Lacrosse Championships. Intent: To create a protected status to continue a National Collegiate Championship or a division championship in the sports of men's and women's lacrosse.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (For 42.5, against 0, abstain 6, not present 2.5.) [See Vote No. 11.]
s. Proposal No. 99-53 (MC2) -- Division I Legislative Process -- Comment/Override Deadlines. Intent: To specify that the proposals receiving initial approval of the Management Council shall be published within 15 days of the adjournment of the Board of Directors' meeting immediately following the Management Council actions. Further to specify that the deadline for both the comment period and the override period be established as the date that is 60 days subsequent to the adjournment of the Board of Directors' meeting.
MC ACTION: Gave final approval and forwarded the proposal to the Board for adoption. (Unanimous voice vote.)
10. Cabinet reports.
a. Report of the September 14-16 Championships/
Competition Cabinet meeting.
MC ACTIONS: Received a report of the September 14-16 Championships/Competition Cabinet meeting and took the following actions:
(1) Division I Baseball Championship. Agreed to begin the Division I Baseball Championship one week later than currently scheduled, which would result in the championship beginning one week after Memorial Day and concluding the third week in June, effective in 2002. (For 30, against 16.5, abstain 2, not present 2.5.) [See Vote No. 15.]
(2) Gender identification of the Final Four. Approved the recommendations of the cabinet to trademark the term "Men's Final Four" as the primary brand for that event, to distinguish it from the Women's Final Four; and to direct the national office staff, in conjunction with trademark attorneys, to make use of the term "Final Four" to protect the Association's ownership of that trademark. (For 37.5, against 12, not present 1.5.) [See Vote No. 16.]
(3) Automatic qualification for the Division I Men's Lacrosse Championship. Upheld the decision of the cabinet to direct the Division I Men's Lacrosse Committee to: (For 25, against 19.5, abstain 5, not present 1.5.) [See Vote No. 17.]
(a) Award automatic qualification to four conferences into the 2000 and 2001 Division I Men's Lacrosse Championships, based on the computerized Rating-Percentage Index (RPI), and to select one team at-large from the West region; and
(b) Effective with the 2002 championship, provide access into the championship for all eligible conferences via automatic qualification and play-in games.
(4) Alcohol, Tobacco and Other Drugs Guidelines. Approved the Alcohol, Tobacco and Other Drugs Guidelines of the Committee on Competitive Safeguards and Medical Aspects of Sports, which will be included in the next revision of the Division I Athletics Certification Self-Study Instrument, NCAA Sports Medicine Handbook and Divisions II and III institutional self-study guidelines. (Unanimous voice vote.)
(5) Transportation expenses for play-in games. Noted that some team championships require play-in games (preliminary games) due to the number of eligible conferences, that these games are held at the site of the higher-ranked teams, and that the traveling team is responsible for its own transportation expenses (which can be considerable, depending on its location relative to its opponent).
Agreed to recommend to the Board of Directors that: (For 46.5, against 3, not present 1.5.) [See Vote No. 18.]
(a) The Association should reimburse transportation expenses for teams participating in preliminary games of NCAA team championships.
(b) The transportation costs for the 1999-00 academic year should be funded through unallocated surplus funds from the 1998-99 fiscal year, if available. [Note: There will be eight teams traveling to preliminary games during 1999-00 and the transportation costs are estimated to range from minimal ground transportation expenses to $150,000 (a worst-case scenario in which all eight teams would travel by air).]
(6) Waivers of the waiting period for automatic qualification. Agreed that the Management Council Subcommittee to Review Automatic-Qualification Requirements and the Championships/Competition Cabinet should consider whether the principles being developed by the subcommittee impact the decision by the Championships/Competition Cabinet to deny several waivers of the two-year waiting period for automatic qualification into a number of Division I championships.
b. Report from the September 9-10 Academics/Eligibility/Compliance Cabinet meeting.
MC ACTIONS: Accepted the report of the September 9-10 Academics/Eligibility/Compliance Cabinet and took the following actions:
(a) Clarification regarding corporate entities as athletics representatives. Noted that throughout the cabinet's amateurism deregulation efforts and presentations to various membership organizations, concerns have been expressed regarding the possible interference of outside organizations in providing increased athletics opportunities to prospects that may lead to recruiting activities.
Clarified through interpretation that the provisions of Constitution 6.4.1 (Responsibilities for Independent Agencies or Organizations) are applicable to corporate entities and other organizations (for example, apparel and equipment companies) and directed the Legislative Review and Interpretations Subcommittee of the Academics/Eligibility/Compliance Cabinet to incorporate the interpretation into Constitution 6.4.1 and 6.4.2 and Bylaw 13.02.12. (Unanimous voice vote.)
(b) Alternative language for the terms "amateur/amateurism."
At the request of the cabinet, referred back to the cabinet the recommendation that the terms "amateur/amateurism" in the NCAA Manual should be replaced with the terms "nonprofessionalism/athletics participation/NCAA eligibility" as appropriate. (Unanimous voice vote.)
(c) Interpretation regarding student-athletes practicing during the initial-eligibility waiver process. Agreed to make permanent and include in future editions of the initial-eligibility waiver application instructions a temporary revision to an August 29, 1996, interpretation that permits a student who has a pending initial-eligibility waiver request to continue to:
n Practice until the NCAA Division I Initial-Eligibility Waivers Committee's respective subcommittee (or the staff acting on behalf of the subcommittee) acts on the request.
n Receive benefits incidental to participation (i.e., room and board) until a decision has been reached on the waiver request. [Once classes begin, however, a student without a final decision from the subcommittee no longer may receive room and board.]
In issuing this interpretation, the Management Council reaffirmed the current practice of requiring that a waiver application be complete and that the institution (or student if self-filed) receive notice from the staff that all required documents have been received. (Unanimous voice vote.)
c. Legislative Review/Interpretations Subcommittee.
MC ACTION: Approved the minutes as submitted. (Unanimous voice vote.)
Pre-enrollment Amateurism Deregulation.
MC ACTION: Tabled Proposal Nos. 99-106 through 99-111 until April 2000, to provide conferences sufficient time to discuss and study the recommended changes; and agreed that the proposals would also be discussed during the January 2000 Convention. (For 47, Against 2, not present 2.) [See Vote No. 29.] [See Item No. 17zz below.]
11. Discussion regarding the Association-wide and Division I budget process.
MC ACTION: Reviewed the Association-wide and Division I budget time line and process; noted that Constitution 4.5.2-(j) authorizes the Management Council to develop and administer the annual budget of Division I with the approval of the Board of Directors; and discussed the following changes to the budget process:
* Association priorities will drive the budget process.
* The budget process will begin earlier, which will allow for a more structured decision-making process in accordance with Association-wide and Division I priorities.
* The Management Council, via its representatives on the Division I Budget Subcommittee, will be more involved throughout the budget process.
* The Management Council, as a whole, will not submit recommendations directly to the Board.
12. Committee reports.
a. Committee on Financial Aid.
MC ACTIONS:
(1) Student-athlete representation on the committee. Gave initial approval to Proposal No. 99-117, which would add a student-athlete to the committee in an advisory capacity. (Unanimous voice vote.)
(2) Compliance with Division I minimum financial aid requirements.
(a) Requested that NCAA staff draft legislation for Management Council review in April, which would amend Bylaw 20.3.5 to indicate that if an institution does not meet the Division I financial aid minimums, the institution may be placed in a restricted membership category for a minimum of one year and that an institution must submit the annual form regarding minimum financial aid awards to the NCAA by September 15.
(b) Approved several changes to the minimum financial aid awards form as recommended by the committee. (Unanimous voice vote.)
b. Student-Athlete Advisory Committee.
MC ACTIONS:
(1) Association-wide committee liaison. Appointed the following student-athletes to serve on Association-wide committees: (Unanimous voice vote.)
* Competitive Safeguards and Medical Aspects of Sports: Courtney Cutchell.
* Sportsmanship and Ethical Conduct: Bobby Darnell.
* Research: Lindsay Yednak.
* National Youth Sports Program: Tracy Biggs.
* Minority Opportunities and Interest: Joe Whitt.
* Women's Athletics: Kim Kutska.
* Olympic Sports Liaison: Crystal Hudek.
(2) Meeting attendance. Requested that the Student-Athlete Advisory Committee send conference offices a list of attendees following each meeting.
c. Committee on Infractions.
MC ACTIONS:
(1) Clarification of the definition of a prospective student-athlete. Noted that the Legislative Review/Interpretations Subcommittee of the Academics/Eligibility/Compliance Cabinet had previously agreed that Bylaw 13.02.10, regarding the definition of a prospective student-athlete, would be revised editorially as recommended by the committee.
(2) Coordinator of Appeals. Agreed to request that the Board of Directors use its emergency legislative authority, under Constitution 5.3.2.2.1.3, to add a ninth member to the Committee on Infractions whose only responsibility would be to process appeals to infractions cases on behalf of the committee. The coordinator of appeals would be present during committee hearings and deliberations, but would not be an active participant in either. The coordinator of appeals would represent the committee in proceedings before the Infractions Appeals Committee.
The Committee on Infractions made this request because it believes that, as the decision-making body in infractions cases, it is inappropriate for the committee to argue on behalf of its own decisions. Such an arrangement tends to compromise the committee's neutrality. By adding an additional committee member to process appeals, but who is not involved in the decision-making process, the committee is freed from the burden of responding to appeals and is able to maintain its neutrality. (Unanimous voice vote.)
d. Committee on Women's Athletics.
FYI: Received a report from the committee regarding a variety of issues, including the desire of the committee to increase opportunities for female student-athletes by fast-tracking the establishment of championships in women's ice hockey, water polo, squash and bowling.
e. Minority Opportunities and Interests Committee.
FYI: Received a report from the committee regarding a planned summit on women of color, coordinated with the Committee on Women's Athletics, and the development of a national data bank of ethnic minorities as a resource for NCAA members.
f. Committee on Athletics Certification.
FYI: Received a summary of the most recent certification decisions.
g. Postgraduate Scholarship Committee.
MC ACTION: Extended by one year, until September 1, 2001, the committee terms for Teresa R. Kuehn, West Coast Conference, and Rosalia N. Scripa, University of Alabama, Birmingham, due to the turnover of four committee members within a five-month period. (Unanimous voice vote.)
h. Satisfactory-Progress Waivers Committee.
MC ACTION: Received a summary report, as required under Bylaw 14.4.3.9, of the satisfactory-progress waivers considered from November 10, 1998, through September 7, 1999.
13. Report of Management Council subcommittees.
a. Administrative Review Subcommittee report of decisions.
MC ACTION: Received a report regarding decisions from June 1 through August 31, 1999.
b. Selection Review Committee.
MC ACTIONS:
(1) Committee appointment -- Committee on Athletics Certification. Appointed Alfonso Scandrett, North Carolina A&T State University, Mid-Eastern Athletic Conference, to the committee. (Unanimous voice vote.)
(2) Recommendations to change several composition requirements.
(a) Academics/Eligibility/Compliance Cabinet subdivisional requirements. Gave initial approval and circulated for membership comment Proposal No. 99-118, which would reduce the number of required directors of athletics positions on the cabinet in Division I-AA and Division I-AAA from three to two for each subdivision and increase the number of unallocated positions from one to two for each subdivision. (For 47, against 1, not present 3.) [See Vote No. 36.]
(b) Management Council terms. Gave initial approval and circulated for membership comment Proposal No. 99-119, which would maintain four-year terms for Management Council members, but would permit individuals to be eligible for immediate reselection and to serve an unlimited number of terms. (For 46, against 2, not present 3.) [See Vote No. 37.]
(c) Subdivision representation requirement among chairs. Agreed to recommend that the Board of Directors: (Unanimous voice vote.)
(i) Retain the current chairs of the Board (Division I-A), Management Council (Division I-A), Academics/Eligibility/Compliance Cabinet (Division I-AAA) and Championships/Competition Cabinet (Division I-A); and
(ii) Specify that the requirement in Constitution 4.5.3.3.2 (that at least one representative from each subdivision must serve as chair of these entities at any time) would be satisfied as the terms of the current chairs expire.
(d) Policy regarding at-large seats on the Management Council and Championships/Competition Cabinet. To provide more flexibility to conferences in appointing individuals to serve in at-large slots and to promote efforts regarding increasing diversity, the Management Council adopted a policy that would not count the time an individual serves as a Division I-AA or Division I-AAA at-large representative on the Management Council or Championships/Competition Cabinet toward the specified time limits for an individual's service on either body. Further, the time an individual serves as a conference representative on those groups would not impact that individual's eligibility to serve as an at-large representative. (3) Cabinet appointments.
(a) Championships/Competition Cabinet. Approved the individuals selected or reselected to serve on the Championships/Competition Cabinet by the Division I conferences, as submitted. (Unanimous voice vote.)
(b) Academics/Eligibility/Compliance Cabinet. Agreed that, to promote involvement of women and ethnic minorities, Jackie Campbell, Atlantic-10 Conference, could serve in a senior woman administrator slot and Melanie Richardson, University of New Orleans, and Gita Bolt, Texas Southern University, could serve in director of athletics slots. (Unanimous voice vote.)
Approved the individuals selected or reselected to serve on the Academics/Eligibility/Compliance Cabinet by the Division I conferences, as submitted. (Unanimous voice vote.)
c. Subcommittee to Review Automatic-Qualification Requirements.
MC ACTIONS:
(1) Automatic-qualification principles. Reviewed the draft report of the subcommittee, which included the following principles:
(a) "Core" refers to an institution that has been a member of Division I the eight preceding years.
(b) Only a "core" Division I member institution may represent a conference as an automatic qualifier in any sport.
(c) "Continuity" refers to at least six "core" institutions that have conducted conference competition together in Division I the preceding five years in men's basketball and two years in any other sport.
(d) Eligibility rules for automatic qualification that are applicable to Division I institutional/conference changes should not be designed to encourage or discourage realignments of "core" Division I members, but a reasonable waiting period should be expected to reestablish "continuity" and to permit sports committees and the Championships/Competition Cabinet to make adjustments, determine RPI, etc.
(e) A "member conference" must include eight "core" institutions and must show "continuity" to be considered eligible for automatic qualification in men's basketball and must include six "core" institutions and show "continuity" for automatic qualification in any other sport.
(f) A member conference that loses "continuity" of Division I members but retains the required number of "core" institutions must reestablish "continuity" to be considered for automatic qualification.
(g) No waiver of the waiting periods applicable to automatic qualification shall be provided for in the bylaws.
(h) These provisions shall be applicable to institutions and conferences that initiated application for Division I institutional or conference membership subsequent to July 27, 1999.
(i) All active Division I conferences as of September 1, 1999, may be considered eligible for automatic qualification under the less stringent of these provisions or those in effect in September 1999. These conferences, as well as any new conferences, must apply these new principles when changes in membership occur subsequent to September 1, 2003.
(ii) The eight-year "core" principle does not apply to any institution that was a provisional or Division I active member as of September 1, 1999. These institutions would be subject to the current rule that requires Division I active membership for two years to be eligible for automatic qualification in men's basketball and allows immediate automatic qualification in other sports. If there is a further change in the institution's Division I status after September 1, 1999, the new core principles would apply.
(2) Communication of principles to the membership and further Management Council review. Agreed that these principles should be communicated to the membership and discussed further by the Management Council in the following manner: (For 47, against 1, not present 3.) [See Vote No. 35.]
(a) NCAA staff will draft legislative proposals that reflect the proposed principles and that include a clear statement regarding the purpose for the changes, a comparison of the current rule and proposed changes, and the history of the fluidity of Division I and conference membership.
(b) The draft proposals will be mailed to conference offices by mid-November to provide an opportunity for conferences to discuss the proposals, request interpretations regarding the potential impact of these changes on its membership, and submit reaction and alternative options for Management Council discussion in January.
(c) NCAA legal counsel should review the principles, legislative proposals and constitutional guarantees and should assess the potential risk associated with modifying the requirements for conference and institutional access to automatic qualification and with establishing a different standard for automatic qualification to the Division I Men's Basketball Championship.
(d) The Management Council will review, at its January meeting, the draft proposals, conference reaction, legal opinion and issues related to the constitutional guarantees.
(e) It is anticipated that in January the Management Council will give initial approval to the proposals, including any revisions, and forward the proposals to the membership for a 60-day comment period, with final review in April.
(3) Constitutional guarantees. Requested that the Management Council Administrative Committee determine where to refer issues related to the championship access guarantees specified in Constitution 4.01.2.3.1, which include minimum field size, the number of at-large and play-in selections and other general protections.
(4) Unintended consequences. Agreed that the principles are not intended to negatively impact emerging sports, sports that currently do not provide for automatic qualification and single-sport conferences.
d. Subcommittee to Review the Report of the Working Group to Study Division I Basketball Issues.
MC ACTIONS:
(1) Working Group and alternative proposals. Reviewed 14 legislative proposals supported by the Working Group to Study Division I Basketball Issues and several alternative proposals submitted by conference members.
(2) Circulation for membership comment. Gave initial approval to the proposals developed by the Division I Working Group to Study Basketball Issues and the alternative proposals submitted by various Division I conferences solely for the purpose of initiating the 60-day membership comment period and without any substantive position. (For 40, against 7, abstain 1.5, not present 2.5.) [See Vote No. 13.]
[Note: The Management Council first defeated a motion to conduct straw votes of each Working Group proposal and to include the results when the proposals are circulated for comment. (For 16, against 31.5, abstain 1, not present 2.5.) [See Vote No. 12.]
(3) January review of other alternatives. Noted that conferences would be able to submit other proposals related to the recommendations of the Working Group by mid-December, for initial consideration by the Management Council in January and possible adoption in April.
(4) Management Council concerns/comments. Various members of the Management Council expressed the following concerns and comments:
n Initial counters. The proposal that would establish a limit of four on the number of initial counters should indicate that nonqualifiers would count during their first academic year while receiving athletically related financial aid. The effective date of the proposal may need to be adjusted to apply to the 2001-02 academic year because the limit would not have been in effect during the recruitment of prospective student-athletes for the fall of 2000.
n Summer financial aid. Not all institutions may offer during the summer the type of pre-enrollment courses that would be beneficial to prospective student-athletes prior to enrollment and it would be helpful to assess how many institutions offer these courses.
n CHAMPS/Life Skills. This proposal affects all student-athletes and should be reviewed by the Academics/Eligibility/Compliance Cabinet.
n Basketball Issues Committee. The integrity of the governance structure should be maintained and, thus, the Basketball Issues Committee should not report directly to the Board of Directors.
n Marketing Committee. The Management Council should be involved in decisions regarding marketing, licensing, promotions and public affairs.
(5) Review by legal counsel. Requested that NCAA legal counsel provide a report to the Management Council in January regarding whether all of the proposals and rationale statements contain sufficient reasons to distinguish men's basketball student-athletes from other student-athletes and any suggested alternative rationale statements.
(6) Review by cabinets. Requested the Academics/Eligibility/Compliance Cabinet and Championships/Competition Cabinet to review the original Working Group proposals and the new proposals submitted by the conferences, to evaluate the changes suggested by the conferences and to indicate which versions of the proposals are preferable. e. Process for appointing Management Council subcommittees on strategic planning, membership and Division I governance.
MC ACTION: Agreed that the Administrative Committee would make the appropriate appointments and consider the interests of the Management Council members.
14. Report of the October 17 Division I-AA Football Governance Committee meeting.
The Management Council received a report of the following Division I-AA Football Governance Committee actions:
a. Proposal No. 99-104 -- Recruiting -- Division I Football. Agreed to give initial approval to a proposal that would revise the current Division I football recruiting calendar as indicated, if Division I-A approves the proposal. (For 7, against 2.) [See Item No. 17xx below.]
b. Proposal No. 99-112 -- Weekly Hour Limitations -- Skill Instruction -- Division I-A and I-AA Football. Declined to approve a proposal to permit football student-athletes to participate in individual skill-related instruction outside the institution's declared playing season during the academic year, provided (a) the student-athlete requests such instruction; (b) such instruction does not involve the use of any pads or helmets; and (c) no more than four student-athletes are involved in skill-related instruction with their coaches at any one time in any facility. (Defeated -- for 2, against 7.) [See Item No. 17aaa below.]
c. Proposal No. 98-54 -- Recruiting -- Evaluations/Telephone calls -- Division I-A and I-AA Football. Declined to approve a proposal to expand the spring evaluation period to permit 30 consecutive days (excluding Memorial Day and Sundays), beginning April 15 through May 31. (Defeated -- unanimous voice vote.) [See Item No. 18b below.]
d. Proposal No. 98-102 -- State High-School Championships -- Division I-A and I-AA Football. Declined to approve a proposal to permit Divisions I-A and I-AA football coaching staff to attend the state high-school football championships within the state in which the institution is located without such attendance counting as a contact or an evaluation. (Defeated -- unanimous voice vote.)
e. At-large Division I-AA representatives. The committee confirmed that it is not necessary for the Division I-AA at-large representatives on the Management Council to attend the Division I-AA Football Governance meeting as their conferences are already represented on the committee.
f. Heritage Bowl. The committee reviewed a request to grant an exception to the legislation that allows the Heritage Bowl to occur the same weekend as the Division I-AA football championships as long as there is no conflict in the times of the contests.
g. January 2000 meeting. The committee agreed to meet on Friday, January 7 from 10 a.m. to noon Pacific time.
15. Report regarding the review of initial-eligibility standards.
MC ACTION: Received a status report regarding the discussions of the initial-eligibility consultants.
16. Permissible uses for the Student-Athlete Special Assistance Fund.

17. Initial review of legislative proposals.
a. Proposal No. 98-103 -- Permissible Medical Expenses. Intent: To permit institutions to provide student-athletes who are enrolled in the institution's summer term with necessary surgical expenses that may result from an injury that occurred while participating in voluntary summer physical activities on the institution's campus; further, to permit institutions to provide medication and physical therapy to student-athletes who are enrolled in the institution's summer term.
MC ACTION: Tabled the proposal until the Academics/Eligibility/ Compliance Cabinet reviews and forwards to the Management Council Proposal No. 99-68, which also addresses expanding permissible medical expenses for student-athletes. (Unanimous voice vote.)
b. Proposal No. 99-4 -- Institutional Control -- Outside Income. Intent: To specify that the permissible general prior written approval that may be granted by the chief executive officer for athletically related income and benefits from sources outside the institution (as set forth in 11.2.2.1) may be approved by a designee of the chief executive officer; further, to increase the permissible dollar limit for general prior written approval from $500 to $1,000.

c. Proposal No. 99-4-1 (CC) -- Institutional Control -- Outside Income. Intent: To specify that the permissible general prior written approval that may be granted by the chief executive officer for athletically related income and benefits from sources outside the institution may be approved by a designee (outside the athletics department) of the chief executive officer; further, to require an institution's director of athletics to approve such income and benefits.

Intent: To revise the current women's basketball recruiting calendar as follows: (a) to eliminate the AAU Women's National Championship competition as a permissible evaluation period unless the event occurs during the July 8 through July 31 evaluation period; and (b) permit institutional coaching staff members to place one telephone call to a prospect [or the prospect's parents or legal guardian(s) between April 24 and May 15 of the prospect's junior year in high school and three calls from June 21 through July 31(with no more than one telephone call per week).
MC ACTIONS:

Intent: To revise the current Division I football recruiting calendar as follows: (a) to expand the spring evaluation period from April 15 through May 31 to permit four weeks of evaluation (Monday through Saturday) selected at the discretion of the institution; (b) to permit two evaluations per prospect during the spring evaluation period (one evaluation to assess the prospect's athletics ability and one evaluation to assess the prospect's academic qualifications); (c) to reduce the number of fall evaluations days from nine to six; and (d) to modify the winter contact period to provide for a total of 42 contact days (six contact weeks Sunday through Saturday) and reduce from seven to six the number of contacts per prospect during the period.

n Proposal No. 99-106 (AEC) -- Eligibility -- Seasons Of Competition. Intent: To specify that in all Division I sports, a student-athlete who does not enroll full-time in a collegiate institution within one calendar year or one season of competition in the applicable sport subsequent the date that the individual's high-school class normally graduates (i.e. the last class of which the student was a member while enrolled in high school) shall lose a season of competition for each year or sport season in which the student has participated in organized competition; further, to specify that subsequent to the one year or one season-of-competition time period, the student-athlete who has engaged in organized competition must fulfill an academic year in residence upon matriculation at the certifying institution prior to representing the institution in intercollegiate competition.
MC ACTION: Requested that the Amateurism and Agents Subcommittee of the Academics/Eligibility/Compliance Cabinet develop for Management Council review in January an alternative version of the proposal that would eliminate the "year of grace" so that the Management Council and membership could consider both versions at the same time.

Intent: To permit an individual prior to initial full-time collegiate enrollment to accept compensation (for example, stipend, educational expenses) for athletics participation without jeopardizing intercollegiate eligibility.
aaa. Proposal No. 99-112 (CC) -- Weekly-Hour Limitations -- Skill-Instruction -- Division I-A And I-AA Football. Intent: In Divisions I-A and I-AA football, to permit football student-athletes to participate in individual skill-related instruction outside the institution's declared playing season during the academic year, provided (a) the student-athlete requests such instruction; (b) such instruction does not involve the use of any pads or helmets; and (c) no more than four student-athletes are involved in skill-related instruction with their coaches at any one time in any facility.

Intent: To revise the current men's basketball recruiting calendar by (a) reducing the summer evaluation period by 10 days; (b) increasing the academic year evaluation period from September 5 to May 31 (with the exception of current dead periods); (c) permitting 70 evaluation days during the academic year evaluation periods; (d) permitting coaching staff members to evaluate only basketball activities and events approved, sanctioned, sponsored or conducted by the applicable state high-school association, National Federation of State High School Associations or National Junior College Athletic Association (other than contests that are part of the prospect's normal high-school, preparatory-school or two-year-college season); (e) increasing the time period for making contacts during the fall; (f) precluding telephone contact between coaching staff members and individuals involved with prospects in nonscholastic basketball activities between April 1 and August 1; and (g) permitting (in men's and women's basketball) one telephone call to a prospect during his or her junior year in high school from April 24 to May 15, and three additional telephone calls from June 21 through July 31, with the understanding that no more than one call may occur per week.
MC ACTION: Defeated the proposal, noting that the recommendations from the Working Group to Study Division I Basketball Issues superceded the calendar in the proposal. (Unanimous voice vote.)
b. Proposal No. 98-54 (MC1) -- Recruiting -- Evaluations/Telephone Calls -- Divisions I-A and I-AA Football. Intent: In Divisions I-A and I-AA football, to expand the spring evaluation period to permit 30 consecutive days (excluding Memorial Day and Sundays), beginning April 15 through May 31; further, in Division I-A football, to permit one telephone call to a prospect [or the prospect's relatives or legal guardian(s)] during the institution's designated spring evaluation period.

c. Proposal No. 98-75 -- Financial Aid -- Summer School.
