Noncontroversial legislative proposals

Division III

Pursuant to NCAA Constitution 4.7.3-(d) and 5.3.1.1.1, the NCAA Division III Management Council has determined that the following proposals are noncontroversial and necessary to promote the normal and orderly administration of the Association's legislation. The Division III Management Council, by a three-fourths majority of its members present and voting, shall have the authority to adopt noncontroversial amendments, subject to ratification by the Division III Presidents Council. Proposals that are ratified by the Presidents Council shall be effective as of the date identified in the proposal, published in The NCAA News and submitted as legislation at the 1999 NCAA Convention. Those items the Management Council has not yet reviewed in legislative form are marked with an asterisk (

    Legislative citations and governing bodies are reflected as they now appear in the 1997-98 NCAA Division III Manual. Further, inasmuch as a federated provision may be amended separately by each division, all federated proposals will be reflected as a division-only voting line.

    No. 1 DIVISION III CONFERENCE MEMBERSHIP

  • Intent: To permit a Division III conference with at least six active member institutions to be a member of the Association, even if the conference is comprised of one or more additional provisional members.

    Constitution: (a) Amend 3.3.1.2, page 13, as follows:

    "3.3.1.2 Composition of Conference. All of the members of the conference shall be active members of this Association, except that a conference with 40 or more at least six active members also may qualify as a member conference if 90 percent of its contain one or more provisional members institutions are active members of the Association. A conference may retain its membership even if it includes institutions that have been provisional members of the Association for at least one year."

    (b) Amend 3.3.4.4, page 14, as follows:

    "3.3.4.4 Composition of Conference. The member conference shall maintain a membership of institutions that are active members of this Association, except that a conference with 40 or more at least six active members also may continue to qualify as a member conference if 90 percent of its contain one or more provisional members institutions are active members of the Association."

    No. 2 DIVISION III PRESIDENTS COUNCIL AND MANAGEMENT COUNCIL -- GEOGRAPHICAL REGIONS

  • Intent: To eliminate the exception for an institution to transfer to a different region based on its conference affiliation for purposes of representation on the Division III Presidents Council, Management Council or general committees.

    Constitution: Amend 4.12.2.2, page 26, as follows:

    "4.12.2.2 Division III. The Division III geographical regions are as follows:

    "(a) Region 1 -- Connecticut, Delaware, District of Columbia, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, Rhode Island, Vermont, except for institutions transferred to Region III-2 due to conference affiliations;

    "(b) Region 2 -- New York, Pennsylvania, plus institutions transferred from Region III-1 due to conference affiliations and except for other institutions transferred to Region III-3 due to conference affiliations;

    "(c) Region 3 -- Alabama, Arkansas, Florida, Georgia, Indiana, Kentucky, Louisiana, Michigan, Mississippi, North Carolina, Ohio, Puerto Rico, South Carolina, Tennessee, Virginia, West Virginia, plus institutions transferred from Region III-2 due to conference affiliations; and"

    No. 3 ESTABLISHMENT OF WOMEN'S CHAMPIONSHIPS

  • Intent: To extend through 2003-04 the opportunity to establish a national collegiate championship or a division championship in a women's sport in which the Association does not already conduct a championship if at least 40 institutions sponsor the sport.

    Bylaws: Amend 18.2.4.1, page 234, as follows:

    "18.2.4.1 Exception for Women's Sports During the 1994-95 through 1998-99 2003-04 academic years. A National Collegiate Championship or a division championship may be established during the 1994-95 through 1998-99 2003-04 academic years in a women's sport in which the Association does not already conduct a championship if at least 40 institutions sponsor the sport."

    No. 4 HONORS COMMITTEE

  • Intent: To eliminate the requirement that the composition of the committee include one former NCAA president.

    Bylaws: Amend 21.1.3.1, page 264, as follows [common provision, all divisions, divided vote]:

    "21.1.3.1 Composition. The Honors Committee shall consist of eight members, including three nationally distinguished citizens, one former NCAA president, one former NCAA honors recipient and three four members selected at large. Two positions shall be allocated for men, two allocated for women and four unallocated."
