Editorial revisions/1997-98 NCAA Manuals
The following are editorial revisions that appear in the division-specific 1997-98 NCAA Manuals.
Such revisions do not represent substantive changes to any legislation but assist in clarifying the application of the legislation for the membership. These revisions were approved by the former NCAA Council at the recommendation of the former Legislative Review Committee.
The division references in each item indicate the division-specific Manual(s) in which the revision appears.
COACHING LIMITATIONS -- USE OF OUTSIDE CONSULTANTS
(Division I Manual)
Bylaws: Amend 11.7.1.1.1.4, page 61, as follows:
"11.7.1.1.1.3 Use of Outside Consultants. An institution may hire use or arrange for a temporary consultant to provide in-service training for the coaching staff, but no interaction with student-athletes is permitted unless the individual is counted against the applicable coaching limits."

TRANSPORTATION TO OCCASIONAL FAMILY MEAL
(Divisions I, II and III Manuals)
Bylaws: Amend 16.12.1.6, page 213 (1997-98 NCAA Division I Manual), page 182 (1997-98 Division II Manual) and page 140 (1997-98 Division III Manual), as follows:
"16.12.1.6 Occasional Meals. A student-athlete or the entire team in a sport may receive an occasional family home meal from an institutional staff member or representative of athletics interests under the following conditions:
[16.12.1.6-(a) and 16.12.1.6-(b) unchanged.]
"(c) Institutional staff members may provide reasonable local transportation to student-athletes to attend such meals. A representative of the institution's athletics interest may not provide reasonable local transportation to student-athletes to attend the meal function unless only if the meal function is at the home of that representative."

DONATIONS FROM OUTSIDE ORGANIZATIONS
(Divisions I, II and III Manuals)
Bylaws: Amend 12.6.2, pages 82-83 (1997-98 NCAA Division I Manual), page 72 (1997-98 Division II Manual) and page 68 (1997-98 Division III Manual), as follows:
"12.6.2 Nonprofessional Organizations (Other Than Professional Sports Organizations)
"12.6.2.1 Individual Athletics Performance. A member institution shall not accept funds donated from an nonprofessional organization (other than a professional sports organization) based on the place finish of a student-athlete or the number of student-athletes representing the institution in an event. However, the organization may donate an equal amount of funds to every institution with an athlete or team participating in a particular event.
"12.6.2.2 Team Rankings. A member institution may accept funds donated to its athletics program from an nonprofessional organization (other than a professional sports organization) based on the team's national or regional ranking.
"12.6.2.3 Academic Performance. A member institution may accept funds donated to its athletics program from an nonprofessional organization (other than a professional sports organization) based on an individual's or team's academic performance (e.g., the number of academic all-American award recipients)."

NONINSTITUTIONAL CAMP/CLINIC PROVIDING RECRUITING OR SCOUTING SERVICE
(Divisions I, II and III Manuals)
Bylaws: Amend 13.13.2.3.1, page 116 (1997-98 NCAA Division I Manual), pages 100-101 (1997-98 Division II Manual) and page 88 (1997-98 Division III Manual), as follows:
"13.13.2.3.1 Camp/Clinic Providing Recruiting or Scouting Service. No athletics department staff member may be employed (either on a salaried or a volunteer basis) in any capacity by a camp or clinic established, sponsored or conducted by an individual or organization that provides recruiting or scouting services concerning prospects. This provision does not prohibit an athletics department staff member from participating in an officiating camp where participants officiate, but are not otherwise involved in, a scouting services camp."

Bylaw 11:
(Division I Manual) 11.7.4.3 has been revised to clarify that in the sport of Division I-AA football, restricted-earnings coaches are permitted to contact or evaluate prospects off campus during an applicable recruiting period.
Bylaw 12:
(Divisions I, II and III Manuals) 12.1.1-(f) has been revised to delete the phrase, "or other entity to negotiate a professional contract" and a reference to 12.2.4.2.1 has been added.
(Divisions I, II and III Manuals) 12.5.1.10 (1996-97 Manual) has been deleted, inasmuch as it is covered in 12.5.2.3.3.
Bylaw 13:
(Divisions I and II Manuals) 13.13.1.3 has been revised to clarify that institutional camps/clinics may not be conducted during a dead period.
(Division III Manual) 13.4.4 has been revised to clarify that a Division III institution may provide a video to prospective student-athletes, provided the video is made available to all prospective students.
(Divisions I, II and III Manuals) 13.11.2 and 13.11.8 have been revised to clarify that publicity also may be released subsequent to signing a National Letter of Intent.
(Divisions I, II and III Manuals) 13.12.2.3 has been revised to clarify that the legislation is applicable in Division II.
Bylaw 14:
(Divisions I and II Manuals) 14.3.5.1.1 and 14.3.5.1.2 have been revised to clarify that a partial qualifier may continue to practice.
(Division II Manual) 14.4.3.3.2.2 has been revised to delete the first sentence, inasmuch as it no longer is applicable.
(Divisions I and II Manuals) 14.5.4.5 has been revised to clarify that a partial qualifier or nonqualifier is not permitted to use two-year college transfer exceptions or waivers.
(Divisions I, II and III Manuals) 14.5.5.3 has been revised to clarify that a student-athlete may not use four-year transfer exceptions or waivers at any time if the student has an unfulfilled residence requirement at the previous institution.
(Divisions I and II Manual) 14.5.6 has been revised to clarify that a student-athlete must complete an academic year of residence (instead of a calendar year of residence) unless the student satisfies the necessary conditions set forth in the legislation.
Bylaw 15:
(Divisions I, II and III Manuals) 15.01.5 has been revised to clarify the correct application of the legislation as follows:
"15.01.5 Eligibility of Student-Athletes for Institutional Financial Aid. A student-athlete must meet applicable NCAA (see Bylaw 14), conference and institutional regulations to be eligible for institutional financial aid. If these regulations are met, the student-athlete may be awarded institutional financial aid during any term in which a student-athlete is in regular attendance (i.e., was enrolled initially in a minimum full-time program of studies as defined by the certifying institution during that term; see 15.2.7 for summer-term exception) under the following circumstances:
"(a) For any term during which a student-athlete is in regular attendance (i.e., was enrolled initially in a minimum full-time program of studies as defined by the certifying institution during that term; see 15.2.7 for summer-term exception) as The student-athlete is an undergraduate with eligibility remaining under 14.2 (five-year/10-semester rule); or
"(b) To The student-athlete is a graduate student eligible under 14.1.7; and or
"(c) Within six years after initial enrollment in a collegiate institution (provided the student does not receive such aid for more than five years during that period); however, after the six-year period expires, this restriction shall apply only to unearned athletics aid for which the athletics department intercedes on behalf of the student-athlete."
(Divisions I, II and III Manuals) 15.02.6 has been revised to clarify that the award or grant must be publicized in the institution's catalog.
(Division II Manual) 15.5.3.3.1 has been revised to clarify that in order for an academic honor award to be exempt from an institution's sport limitations, it must meet 15.5.3.3.1-(a) and either 15.5.3.3.1-(b) or 15.5.3.3.1-(c).
Bylaw 16:
(Divisions I, II and III Manuals) 16.1.4.7-(b) (1996-97 Manual) has been deleted, inasmuch as there no longer are limitations on the number of awards banquets that may be conducted by an institution.
(Divisions I, II and III Manuals) 16.8.1.3-(c) (1996-97 Manual) has been deleted, inasmuch as such competition refers only to institutional foreign tours, which are covered in 16.8.1.2-(e).
Bylaw 17:
(Division II Manual) The limitations on the number of Division II student-athletes who may participate on outside teams outside the institution's playing season in all sports other than football and basketball have been deleted. Such limitations erroneously have appeared in the NCAA Manual for the past five years.
(Division I Manual) 17.10.6-(b) has been revised to clarify that a student-athlete's participation in countable athletically related activities during the spring practice period shall be limited to a maximum of four hours per day and 20 hours per week.
Bylaw 30:
(Division II Manual) 30.11.6-(g) and Figure 13-6 have been revised to clarify that in the sport of Division II football, authorized coaching staff members may evaluate a high-school football all-star game any time of the year, provided the game occurs within the state in which the member institution is located.
(Division I Manual) 30.7.4.1-(a) (1996-97 Manual) has been deleted, inasmuch as it no longer is relevant due to the new contest-exemption legislation.
Bylaw 17 changes
The following is a list of areas within NCAA Bylaw 17 that have been reformatted, refined or clarified in the division-specific 1997-98 NCAA Manuals. Reformatting, refinement and clarification represent modifications that do not change the actual legislation but either make it easier to read or understand. These changes were approved by the former NCAA Council at the recommendation of the former Legislative Review Committee. The division references in each item indicate the division-specific Manual(s) in which the modification appears.
(Divisions I, II and III Manuals) 17.__.8.1.3 (waivers/exceptions) (1996-97 Manual) has been deleted as unnecessary and redundant. Such legislation is already set forth in 14.7.5 and referenced in Bylaw 17.
(Divisions I, II and III Manuals) 17.02 (definitions and applications) has been reformatted by creating one "all-inclusive" list of countable athletically related activities as follows:
"17.02.1.1 Countable Athletically Related Activities. The following are considered countable athletically related activities and must be counted in the weekly or daily time limitations specified under 17.1.5.1 for Divisions I and II:
"(a) Practice, as specified in 17.02.12; which is defined as any meeting, activity or instruction involving sports-related information and having an athletics purpose, held for one or more student-athletes at the direction of, or supervised by, any member or members of an institution's coaching staff. Practice is considered to have occurred if one or more coaches and one or more student-athletes engage in any of the following activities:
"(1) Field, floor or on-court activity;
"(2) Setting up offensive or defensive alignment;
"(3) Chalk talk;
"(4) Lecture on or discussion of strategy related to the sport;
"(5) Activities using equipment related to the sport;
"(6) Discussions or review of game films, motion pictures or videotapes related to the sport, except for the observation of an officiating clinic related to playing rules that is conducted by video conference and does not require student-athletes to miss any class time to observe the clinic; or
"(7) Activities conducted under the guise of physical education class work (e.g., any class composed of or including primarily members of an intercollegiate team on a required attendance basis or where the class utilizes equipment for the sport).
"(b) Competition;
"(c) Required weight-training and conditioning activities held at the direction of or supervised by an institutional staff member;
"(d) Participation in a physical-fitness class (including a summer class) conducted by a member of the athletics staff, unless such a class is a regular physical education class listed in the institution's catalog and open to all students. Such a class may not include practice activities conducted under the guise of physical education class work;
"(e) In Division I sports other than football, participation outside the institution's declared playing season in individual skill-related instructional activities with a member of the coaching staff and that occur at the request of the student-athlete, except as set forth in 17.02.1.2.2 (see 17.1.6.2.1);
"(f) In Divisions I and II individual sports, participation outside the institution's declared playing season in individual skill-related instructional activities with a member of the coaching staff, except for individual workout sessions during the summer that occur at the request of the student-athlete;
"(g) Film or videotape reviews of athletics practices or contests required, supervised or monitored by institutional staff members;
"(fg) In Division II only, required participation in permissible tryouts of prospective student-athletes per 13.12.2.1. If participation occurs outside the institution's declared playing season it shall be counted as part of the conditioning activities specified in (c) above;
"(h) Required participation in camps, clinics or workshops;
"(i) Meeting initiated by coaches or other institutional staff members on athletically related matters;
"(ji) Individual workouts required or supervised by a member of the coaching staff, except as set forth in 17.02.1.2.1, 17.02.1.2.2 or 17.02.1.2.3 for those sports subject to the safety exception. A coach may design a voluntary general individual workout program for a student-athlete (as opposed to a specific workout program for specific days) but cannot conduct the individual's workout;
"(kj) On-court or on-field activities called by any member or members of a team and confined primarily to members of that team that are considered as a requisite for participation in that sport (e.g., captain's practices);
"(lk) Visiting the competition site in the sports of cross country, golf and skiing;
"(l) Use of an institution's athletics facilities when such activities are supervised by or held at the direction of any member of an institution's coaching staff. Facilities may be reserved for such use during the academic year. It is not permissible to reserve facilities during the summer, except in Divisions I and II, to participate in permissible individual workouts in individual sports at the request of the student-athlete(s). In the event the use of an institution's facilities is requested by a team composed partly of enrolled student-athletes and partly of individuals not otherwise affiliated with the institution, use of the facilities shall be consistent with the policies established for outside groups generally. In a Division III institution, the use of an institution's athletics facilities by a student-athlete shall be to the same extent that facilities are utilized by students generally;
"(m) Involvement of an institution's strength and conditioning staff with enrolled student-athletes in required conditioning programs. A strength and conditioning personnel may monitor voluntary individual workouts for safety purposes. If the strength and conditioning coach also is a countable coach, such assistance may be provided only if that strength and conditioning staff member performs such duties on a department-wide basis. In a Division III institution, assistance in conditioning programs for student-athletes shall be to the same extent that such assistance is provided to students generally.
"17.02.1.1.1 Summer Physical Fitness or Conditioning Class. Participation in a physical fitness or conditioning class held at the direction of or supervised by one of the institution's athletics department staff members is a countable athletically related activity and, thus, shall not occur during the summer unless it is a physical education class per 17.02.12.2-(a)."
"17.02.1.2 Noncountable Athletically Related Activities. The following are considered noncountable athletically related activities and are not counted in the weekly or daily time limitations specified under 17.1.5.1 for Divisions I and II:
"(a) Training-table or competition-related meals;
"(b) Physical rehabilitation;
"(c) Dressing, showering or taping;
"(d) Athletics department academic study hall or tutoring sessions;
"(e) Meetings with coaches on nonathletics matters;
"(f) Travel to an from practice and competition;
"(g) Visiting the competition site in sports other than cross country, golf and skiing;
"(h) Medical examinations or treatments;
"(i) Fund-raising activities;
"(j) Recruiting activities (e.g., serving as a student host for prospective student-athletes during official visits);
"(k) Public relations activities related to the student-athlete's sport (e.g., media days);
"(l) Participation in regular physical education classes, with or without credit, that are listed in the institution's catalog and open to all students, except as noted in 17.02.12.1-(h);
"(m) Voluntary individual workouts, provided these workouts are not required or supervised by coaching staff members, except that such activities may be monitored for safety purposes by the institution's strength and conditioning personnel. A coach may design a voluntary general individual workout program for student-athlete (as opposed to a specific workout program for specific days);
"(n) Individual consultation with a coaching staff member initiated voluntarily by a student-athlete, provided the coach and the student-athlete do not engage in athletically related activities;
"(o) The provision of videotapes to a student-athlete by an institution's coach that include a personalized message and athletically related information (e.g., discussion of plays, general workout programs, lectures on strategy related to the sport), provided the viewing of the videotape by the student-athlete is voluntary;
"(p) Use of an institution's athletics facilities (which may be reserved for student-athletes during the academic year but not during the summer except, in Divisions I and II, to participate in permissible individual workouts in individual sports per 17.02.1.2.2) by student-athletes, provided the activities are not supervised by or held at the direction of any member of an institution's coaching staff. In the event that use of an institution's facilities is requested by a team composed partly of enrolled student-athletes and partly of individuals not otherwise affiliated with the institution, use of the facilities shall be consistent with policies established for outside groups generally. In a Division III institution, the use of an institution's athletics facilities by a student-athlete shall be to the same extent that facilities are utilized by students generally;
"(q) Involvement of an institution's strength and conditioning staff with enrolled student-athletes either in a supervisory capacity for the institution's weight-training facilities or assisting in conditioning programs. Such assistance may be provided only if the strength and conditioning staff member, even if a countable coach, performs the strength and conditioning duties on a department-wide basis. In a Division III institution, assistance in conditioning programs for a student-athlete shall be to the same extent that such assistance is provided to students generally."
(Divisions I, II and III Manuals) 17.02.14 (practice, out-of-season) and 17.02.14.1 (activities not considered out-of-season practice) (1996-97 Manual) have been deleted, inasmuch as each sport bylaw now will specifically indicate that only limited countable athletically related activities are permissible outside the playing season. [Note: During its August 12-14, 1996, meeting, the Council agreed to sponsor noncontroversial legislation to delete 17.02.14.1-(b) as it appeared in the 1996-97 Manual.]
(Divisions I, II and III Manuals) The safety exceptions set forth in 17.02.1.2.1 (Divisions I and II) and 17.02.1.2.3 (Division III) and the permissible summer workout sessions set forth in 17.02.1.2.2 (Divisions I and II) have been moved into the bylaws for each applicable sport.
(Divisions I, II and III Manuals) The provisions of 17.02.11 (1996-97 Manual) have been deleted from the definitions and applications sections, inasmuch as it is included in 17.1.1.
(Divisions I, II and III Manuals) 17.1.8-(a) (1996-97 Manual) has been deleted, inasmuch as such legislation is no longer relevant.
(Divisions I and II Manuals) 17.__.6 (out-of-season athletically related activities) has been revised to clarify that the specified athletically related activities set forth in 17.1.6.2 (skill instruction -- Division I) may occur outside the playing season only during the academic year.
(Divisions I, II and III Manuals) 17.__.8.2 (medical examinations) (1996-97 Manual) has been deleted, inasmuch as such activities are not considered countable athletically related activities and, thus, may occur at anytime for student-athletes.
(Divisions I, II and III Manuals) 17.5.6 has been revised to read, "out-of-season athletically related activities" instead of "out-of-season practice." Further, 17.5.6-(a), 17.5.6-(b), 17.5.6-(c) and 17.5.6-(e) (1996-97 Manual) have been deleted, inasmuch as such legislation is commonly understood or included elsewhere in the Manual. [Note: During its August 12-14, 1996, meeting, the Council agreed to sponsor noncontroversial legislation to delete 17.5.6-(d) as it appeared in the 1996-97 Manual only in Divisions I and II.]
(Divisions I, II and III Manuals) 17.10.6 has been revised to read "out-of-season athletically related activities" instead of "out-of-season practice." Further, 17.10.6-(c) through 17.10.6-(f) (1996-97 Manual) have been deleted, inasmuch as such legislation is commonly understood or included elsewhere in the Manual.
(Divisions I, II and III Manuals) 17.30.3 (in-season foreign competition) (1996-97 Manual) has been deleted, inasmuch as such legislation is already included in each sport.
(Divisions I, II and III Manuals) References to 20.8.3.3 (Division I minimum contests and participants requirements for sports sponsorship), 20.9.3.5 (Division II) and 20.10.3.2 (Division III) have been placed in 17.__.5.1 (number of contests -- maximum limitations -- institutional) to remind institutions of minimum contests and, in individual sports, the minimum participants necessary to meet applicable divisional sport-sponsorship requirements.
(Divisions I, II and III Manuals) 17.__.5.3-(h) (annual exemptions -- national championship and international competition) (1996-97 Manual) has been deleted, inasmuch as such legislation is already included in 14.7.5.1 and 16.8.1.3.
