PRESIDENTS COMMISSION

Commission endorses means for athlete representation

The NCAA Presidents Commission has endorsed three division-specific approaches for student-athlete representation in the new governance structure.

The Commission, which met June 25-26, concluded that in the new federated structure, the level of student-athlete involvement could vary from division to division.

Each of the division recommendations involves student-athlete representation on the appropriate management council. Division I student-athletes would have two nonvoting representatives at all Division I Management Council meetings; in Division II, representation would be accomplished through an annual "student-athlete summit" conducted with the Management Council; and Division III would have two voting student-athletes on its Management Council.

DIVISION I

Board chooses to explore more diversity options

The Division I Board of Directors Transition Team has formed a subcommittee that will solicit feedback from Division I conferences on ways to address diversity on the Division I Management Council.

One of the ways will be what the Manage-ment Council already has recommended: conferences offering more selections than there are positions. The other would involve achieving diversity through a rotation system.

In another action, the Board, which met June 25, approved nearly all of a series of recommendations concerning the division's substructure. It decided to sponsor legislation to create a four-cabinet concept as the core of the substructure. A recommendation to require at least 20 percent of the positions in the cabinets to be occupied by ethnic minorities was deferred, pending the report of the subcommittee.

DIVISION II

Presidents reach agreement on division substructure

The Division II subcommittee of the NCAA Presidents Commission has approved a proposed governance structure that features the creation of a Division II Administrative Committee and Budget/Finance Committee.

It also approved in concept a proposal to create eight division-specific committees.

The proposed Division II Administrative Committee could act on behalf of the Presidents Council and Management Council between meetings of those groups. The Division II Budget/Finance Committee would be charged with reviewing all preliminary matters related to the division's budget and financial affairs.

DIVISION III

Commission subcommittee approves enhancements

Enhancement of Division III championships for team sports other than football in which sponsorship exceeds 200 institutions was approved by the Division III subcommittee of the NCAA Presidents Commission. The changes will become effective during the 1997-98 academic year.

Models for subdividing and subgrouping Division III championships in those sports as well as football will be developed for presentation to the subcommittee in September, with a focus on the possibility of proposed legislation at the 1998 NCAA Convention.

LITIGATION

Appeals court denies NCAA's motion for stay

The Tenth Circuit Court of Appeals has denied the NCAA's motion for a stay and petition for writ of mandamus in the lawsuit against the Association involving its restricted-earnings coach legislation.

The petition was sought after a U.S. district court issued an order that requires all Division I institutions to provide information sought by the plaintiffs.

Judge Kathryn H. Vratil issued the order May 29; those interrogatories were sent to each Division I institution May 31.

ELIGIBILITY

Committee addresses noncertified student-athletes

Beginning with the 1996-97 academic year, the NCAA Eligibility Committee will impose conditions for restoration of eligibility on student-athletes who practice, play or receive financial aid before being certified by the NCAA Initial-Eligibility Clearinghouse. Staff contacts: Carrie Doyle.
